April 6. 1955 at 1:00 o'clock P. M. Present were Mayor Lowe. Commissioner Erwin, Commissioner Swanson. City Manager Henderson. City Attorney Lovelace and the Clerk. when the following proceedings were had: Minutes of the last session were read. and it was moved by Commissioner Erwin. seconded by I Commissioner Swanson. that the minutes be apfroved as read. and the motion was carried by the following; Aye and No vote: those voting Aye beinE Mayor Lowe, Commissioner Erwin, Corrunissioner Swanson; those voting No. none. Hearing -- S. 1. D. 381 'This being the time and place set for public h~arinE on the proposal to Create S!-,ecial Improve- ment District No. 381. paving on NOrth Willson from Villard to Cottonwood Street. the affidavit of publi ca tion of the Notice was presented. tOEether wi th the mailing certificate of the Clerk of the Commission that all property owners have been notified. The written protests of owners of 46.25% of the total property were presented. All those rresen t were given an opportunity to be heard. After discussion. it was moved by Commissioner Swanson. seconded by Commissioner Erwin. tha t the hearing be continued until the next regular meeting. April 13, 1955. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Erwin, Commissioner Swanson; those voting No. none. Claim -- Cecil Badgley Mr. Cecil F. Badgley appeared before the Commiss ion to discuss a claim presented by him for the construction of two hoists. two stainless steel bins and certain tracks or frames for the handling I of fluorides at the wa ter reservoirs. The total amount of the claim was $949.86. The City Manager had informed Mr. Badgley that he would not approve the c leim for this amount and suggested that Mr. Badgley attend this Commission meeting when the matter would be discussed. Mr. Badgley explained that he had submitted a bid on the two hoists at $113.10 each less 10% or a total of $203.60 but tha t bid did not include ei ther the stainless steel bins or hoppers or the frames or track devices which he buil t and installed to move the bins from the hoists to position over the fluoridatinE machines. :jp746.26 of the claim was for the bins and track devices. The Manager explained tha t he had g;one over the proposal with Mr. Badgley at ,tile building; where one of the installations was to be lIlBde and was led to believe that making the bins and track devices would be rather a simfle thing to do. In this belief. he had authorized Mr. Badgley to }roceed with the work and had been given no further information on it until he was informed that the work was completed and Mr. Badg;ley presented his claim. The Manager contended that. in froportion to the bill of $203.60 for the two hoists, the bill of $746.26 for the otiler work end material was entirely unreasonable and exorbitant. It was proposed tha t the Mayor and Commissioners Co to one of the reservoirs where tilis equipment has been installed so that it could be examined in detail by them and action in the matter was deferred until that could be done. I Shipping; Instructions fOr Fire Truck The City Manager read a letter he had written to Peter Pirsch & Sons. giving instructions that the fire truck recently purchased should be shiFped directly from the factory via the Noriliern Pacific Railroad. Gas Fitter's Bond Cancelled -- Brown's Hardware A communication from Heidel-Vandenhook Agency was read. stating tila t Frank Brown. doing business as Brown's Hardware. is no longer encaged in the gas fitter's business. and asked that the bonding 4H~) company be relieved of any liability after March 3ls t. 1955. It was moved by Commissioner Brwin, seconded by Commissioner Swanson. that the bond of Frank Brown be cancelled as of March 31st. 1955. and the motion was carried by the following Aye and No vote: those voting Aye be ing; Mayor Lowe. Commissioner Et"Nin. Commissioner Swanson; those voting No, none. Approval of Additional Charge for Sewer Service by Montana State College A communication from R. R. Renne of Montana State College was read. stating; that MOntana State I College will pay an sddi tional charge of ~lOO.OO per month for 120 months beginning Sel-'tember 1. 1955, in the form of additional sewer service charge. as their estimated share of the cost for the construc- tion of a new trunk sewer which is to be extended from lOth Avenue and Curtiss Street to the campus to ca rry sewage from Montana State Colleg;e buildings. Officials to Attend Meeting;s -- Police Chief and Recreational Director Request qf F'olice Chief Haas to attend the Western Crime Conference in Idaho Falls. May 16th through 18th and request of Recreation Director .Whi te to attend the Northwest Dis trict Recreation Conference in Boise. Idaho. AI- ril 18th throuEh 20th. were 1 resented. Request to Connect to Water Main for Fire Protection -- Montana Flour Mills A request was presented from the Montana Flour Mills to connect an S" main to the city's 18" main at the lower mill for operation of an automatic fire I-rotection sf.rinkling system. _After considera- tion. it was moved by Co~nissioner Erwin. seconded by Co~missioner Swanson, that this requ est be granted, I conditioned on the installation being made at their eXFense. and water from this connection to be used for no other purpose except for operation of the sprinkler system in case of fire. and tile motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Will iams to have the MarNyn Rearrangement of the Northern Facific Ado ition zoned as 8.n "A" Residence District was read. It was moved by Commissioner Swenson. seconded by Commissioner Erwin, that the matter be referred to the Board of Adjustment. and the motion was earried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Et"Nin. Commissioner Swanson; those voting; No, none. Development of Water Supply from Wells A communication from Morrison-Maierle. <':onsulting Engineers of Helena. Mon tana. regardi ne; the Iossibility of the development of additional city water supplies from wells, was read. After e:xamination of' the claims in detail and checking against the Claim Register, it was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the claims be approved and warrants drawn for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No. none.
