HomeMy WebLinkAbout1954-11-17 Bozeman, Montana 448 November 17, 1964 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, November 17, 1954 at laOO o'clock P. M. Present were Mayor Lowe, Commissioner Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following prooeedings were hada I Minutes of the last session were read, and it was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swenson; those voting No, none. Endorsement of G. O. C. Program Lt. Robbins and Sgt. Diamond, Public Relations Officer, of the Ground Observer Corps, U. S. Air Force, were present to seek endorsement of the G. O. C. program by the City Commission and to request cooperation of the City of Bozeman in setting up this program. They stated that the present set-up in Bozeman is inadequate and the program is one of vital importance for the protection of the oitizens. They also asked for assistance of the Police Department in reporting aircraft passing over Bozeman between mid-night and 6aOO A. M., and for payment by the city of the monthly electric current cost for the post, also for financial assistanoe in the construction of such a post. After oonsideration, the City Commission stated they should co-operate in this program and it was moved by Commissioner Erwin, seconded by COmm1ssi oner Swanson, the. t the City of Bozeman go on record as endorsing the Ground Observer Corps program, and the motion was carried by the following Aye and No votea those voting Aye being Mayor Lowe, Comndssioner Erwin, Commissioner Swanson; those I voting No, none. Claim of Frank J. Trunk & Son, Inc. Frank J. Trunk of Frank J. Trunk & Son, Inc. was present to discuss a claim presented by his company against the City, in the amount of $440.27, for labor and materials furnished at the Swimming Pool between July and October, 1964. Principal items in the claim were for a new coil in the boiler to heat water for showers and for labor in connection with this coil. City Manager Henderson explained that a coil for this purpose was first installed in the boiler by Frank Trunk & Son, Inc., in 1962. The cost of the coil was approximately $275.00 and the cost of installation approximately $225.00. At the end of each of the two seasons in which this coil was used, Frank Trunk & Son, Inc., were employed to drain the heating system, including this coil, to make it ready for winter. Again, at the beginning of each of these two seasons, this firm was employed to ready the heating system for the summer operations. After the pool was put into operation in 1954, Joe Trunk came to the City Manager r s office, said that the coil was "Limed up" and leaking and that he was attempting to repair it. The coil was re-installed but broke open a short time later. Upon examina- tion then by the City Manager end the Recreation Direotor it was found that the leaks in the coil were caused by it having been frozen so that the tubes burst. It was necessary to order a new I replaoement coil. City Manager Henderson contends that damage to the coil was due to failure of an employee of Frank Trunk & Son, Ino. to properly drain it and thereby letting it freeze and burst and that some of the other work cll.arged on the bill was unsatisfactory. He stated the. t he considered the claim exorbitant and unreasonable. Mr. Trunk was requested to present his arguments. He did not deny that misrepresentation had been made relative to freezing of the coil. He said that he believes that lime accumulation in the coil was partially the cause of its not being properly drained. He admitted that some of the workmanship had been poor but contended that it was the best that could be expected and therefore he did not consider any adjustment due the City on the claim. The Mansg er thereupon recommended that, rather than to refuse payment of the claim and thereby forcing it to be 44~ taken into court for settlement, it be paid. It was moved by Commissioner Erwin, seconded by Conmissioner Swanson, that the claim be approved and a warrant issued for its payment, and the motion was can-ied by the following Aye end No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Reports The report of the Cemetery Board for the month of October, 1954 was presented. It was moved by Commissioner Swanson, seoonded by Coxmnissioner Erwin, that the report be aocepted and ordered I filed and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. City Manager Henderson reported to the City Commission regarding his visitation to other cities as authorized November lOth, 1954. Problems Involving New High School Disoussed Problems which might be encountered in the oonstruotion of the proposed new High School building were disoussed. Adjournment There being no further business to come before the Commission at this time. it was moved by Commissioner Erwin, seconded by Commissioner Swanson. that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe.
