The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, December 15, 1954 at 1:00 o'clock P. M. Present were Mayor Lowe,
Commiss ioner Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the
Clerk, when the following proceedings were had:
Minutes of the last session were read, and it was moved by Commissioner Erwin, seconded by I
Commissioner Swanson, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson;
those voting No. none.
Resolution No. 784 -- Assessing W & C 1954
The resolution levying the assessment for the construction and/or repair of sidewalks for the
year of 1954 in the amount of $2,178.39, was presented entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SFECIAL ASSESS-
MENT OF TAXES UPON CERTAIN ProPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF
MON T.AN A, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING MISCELLANEOUS
SIDEWALKS AND CURBS DURING THE YEAR 1954.
It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that the resolution be
provisionally adopted and December 22nd, 1954 be set as the date for the hearing of protests. and the
motion was carried by the following Aye ani No vote: those v oting Aye being Mayor Lowe, Commies ioner

Erwin, Commissioner SWanson; those voting No, none.
Reports
The following reports for the month of November, 1954 were presented:

and the re:t.ort of the Building Inspector for the month of October, 1954.
It was moved by Commissioner Erwin, seconded by Conunissioner Swanson, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: thos e voting Aye being
Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none.
Request to Locate Gas Tank in Street Area - Montana iower Company
A request from the Montana Power Company for a permit to install a gas tank and pump in the street
area at their warehouse located at the corner of Mendenhall and Ida Street was presented. Action on
this request was deferred until the next regular meeting.
Froposed Municipal Legislation Disoussed
Senator Herman H. Dokken and Walter Sales and "Bud" Purdy, Representatives from Galla tin County
to the State Legislature, met with the Commission to discuss legislation affecting municipalities
which is expected w be br::>ught up at the 1955 session of the Montana Legislature. Representative
Dean Chaffin was unable to be present but has requested that he be given full information on legisla-
tion proposed. Phil ip Goan, representative elect from Yellowstone County, was also present because
of his interest in these legislative matters.
Relocation of Headgate at Dump Grounds I
A copy of an aerial map showing the location of the East Gallatin River and an irrigation ditch
at the city dump grounds was presented. Present dumping at the dump grounds is now blocking the
old river bed used by the ditch company to get water into the irrigation ditch from the main ohannel
of the river. At the present time. it will be necessary for the irrigation users to construct a new
headgate and considerable brush will have to be ta.ken out in order to get to the headgate for the
construotion work. It was pointed out that, if the headgate could be relocated to the north, more
usable ground would be available to the ci ty for the dump grounds. After consideration, it was
proposed that, if the ditch company would relocate the headgate, the city would clear the brush

from the site.
rroposed Truck Route
Copies of a plat showing the proposed location of a truck by-pass to be designated as a Federal
Aid Urban Route. as suggested by the State Highway Commission. were presented. After examination
of the proposed route, the City Attorney was instructed to prepare a resolution requesting that the
I route be designated as a portion of the Federal Aid Urban System.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Swanson, seconded by Co~nissioner Erwin. that the meeting adjourn and the motion was
carried by the following Aye and No vote, those voting Aye being Mayor Lowe, Commissioner Erwin,
Commissi oner Swanson; those voting No. none.
