SUBJECT: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Sidewalk Improvements Project to AV Construction Inc., Bozeman, MT, in
the amount of $278,375.70.

RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Sidewalk Improvements Project to AV Construction Inc., Bozeman, MT, in
the amount of $278,375.70.
BACKGROUND: Bids were opened May 24, 2017, for the 2016 Sidewalk Improvements
Project. The project consists of installation of a new concrete sidewalk along the Bronken Park frontage of Cottonwood Road (Schedule 1), sidewalk repairs that were ordered at various
locations (Schedule 2), installation of street corner pedestrian ramps (Schedule 3), and widening
of the sidewalk on the south side of Oak Street from N. 7th to N. 5th. Four bids were received for
the project, with the low bid being submitted by AV Construction Inc, Bozeman, MT, in the
amount of $278,375.70. The bids appear to be competitive with the low bid being approximately 1.5% above the construction estimate ($278,342.00). A copy of the Certified Bid Tabulation is
attached.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: The cost of Schedule 1 (Bronken Park sidewalk) has been
budgeted for in the Parks Budget. The cost of Schedule 2 (sidewalk repairs) will be billed to
property owners, with some repairs that are the responsibility of the city funded out of Street
Maintenance. The cost of Schedule 3 (street corner ramps) will be funded by Street Maintenance
and Stormwater funds. The cost of Schedule 4 (Oak St sidewalk widening) will be funded by the
N. 7th TIF district.

PROJECT: City of Bozeman 2017 Sidewalk Improvements Project
CONTRACT FOR: installation and repair of concrete sidewalks, and installation of street corner
pedestrian ramps (Schedules 1, 2, 3, and 4).
You are notified that your Bid dated May 24, 2017, for the above Contract has been considered. You are
the apparent Successful Bidder and have been awarded a Contract for installation and repair of concrete
sidewalks, and installation of street corner pedestrian ramps
The Contract Price of your Contract is: two hundred eighty two thousand three hundred seventy five
and 70/100 Dollars ($282,375.70).
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date of
this Notice of Award, that is, by .
1. You must deliver to the OWNER 3 fully executed counterparts of the Agreement including all
the Contract Documents and Drawings.
2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the
Instruction to Bidders (page 7), General Conditions (paragraph 5.01) and Supplementary
Conditions (paragraph SC-5.02).
3. List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03) and Supplementary Conditions (paragraph SC-5.04).
Failure to comply with these conditions within the time specified will entitle OWNER to consider
your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited.
Within ten (10) days after you comply with these conditions, OWNER will return to you one fully
signed counterpart of the Agreement with the Contract Documents attached.
