May 26, 1954 at 1:00 o'clock P. M. Present were Mayor Lowe, Commissioner Erwin. Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk. when the follow- ing proceedings were had: Minutes of the last session were read, and it was moved by Commissioner Erwin. seconded by I Commissioner Healy. that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Erwin, Commissioner Healy; those voti:ag No. none. Claim - Lovell Clay Products Company Claim No. 9464 of the Lovell Clay Products Company in the amount of .421.43, was presented. The claim being subject to a 2% oash discount, it was moved by Commissioner Heuy, seconded by Commissioner Erwin, that the claim be approved and a warrant drawn for its payment, end the motion was oarried by the following Aye and No vote: those voti.ng kJe being Mayor Lowe, Commissioner Erwin. Commissioner Healy; those voting No. none. Purchase of Sodium Silicofluoride Authorized It was reported that, by ordering sodium silicofluoride as a part of a oarload lot, a savings in price oan be made of approximately It per pound. It was moved by Commissioner Erwin, seconded by Commis doner Healy, that the City Manager be authorized to purchase 9000 pounds of sodium silicofluoride and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No. none. Closing City Offices May 31st, 1954 I The Commission stated that the City Offices should be closed on Monday. May 31st, 1954, since May 30th, (Memorial Day) falls on Sunday. Resolution No. 762 -- Vacating a Fortion of East Main Street A resolution of intention to vacate a small, triangular, unused portion of East Main Street, a8 originally platted. was presented. The area extends west from Aylsworth Avenue (vacated) and became unused and unusable as street or highway when East Main Street was relooated in its present looation. The resolution is entitled& A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA DECLARlllG IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF EAST MAIN STREET IN SAID CITY OF BOZEMAN . It wes moved by Commissioner Erwin, seoonded by Commissioner Healy, that the resolution be passed and adopted and June 9th, 1954 be set as the date for hearing protests, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Extension of Water Main on East Main Street Referring to a proposed extension of water main on East Main Street. which WQuld include replace- ment of the present main between Buttonwoed and Cypress Avenues and installing a new 6" main easterly I from Cypress Avenue a distanoe of approximately 717 feet, the Manager reported on a meeting of owners of properties which would be benefited by the proposed installation. The Engineer's estimate of cost of the new main is $3.826.69. Property owners have agreed to pay $3,500.00 of this cost. Consideration was given to the difficulties whioh would be involved in attempting to create a Special Improvement District for this installation. Further reference is made to the aotion of this Commission at their meeting on May 19, 1954. It was moved by Commissioner Healy, seconded by Commissioner Erwin, that the Ci ty Engineer be instructed to prepare necessary plans for this installation and that, upon payment by owners of the $3,500.00 as agreed upon, the City Manager be and is hereby authorized to purchase the 877 required materials and to have this installation made by water department personnel using City equipment and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lawe~ Commissioner E~in, Commissioner Healy; those voting No, none. City Business License for Greyhound Busses Correspondence between the City Attorney and an Attorney for the Greyhound Bus Lines regarding a city license for the Greyhound Lines was reviewed. The attorney for Greyhound Lines, Ino., contends I that Greyhound busses do not use city streets for loading and unloading, the bus depot is operated on a oommission basis by a looal re8ident~ and Montana statutes prohibit imposing additional licenses on busses operating inter-state. The present city business lioense ordinance provides a fee for busses using oi ty streets for parking or stopping. The present operator of the bus depot now has a city license for city taxis operating from this depot. The City Attorney advised the Commission that~ in his opinion, a license could not be legally assessed and oollected from this oompany under existing laws and ordinanoes. Based on this information, the City Attorney was instruoted to inform the attorney for Greyhound Lines~ Inc, that no further action toward collection of this license will be made unless and until present statutes and ordinances are ohanged. Freliminary Report by State Highway on Traffic Survey Henry Helland and Paul DeTlne, Engineers of the State Highway Department, met with the Commiss ion . to present and discuss a rough draft of the report on the traffio survey which was conduoted in Bozeman dur ing the summer of 1963. A general review was made of the report and these engineers informed the Commission that the report in final form is expected to be ready in about one month.
