HomeMy WebLinkAbout1954-06-09 Bozeman, Montana :~Ht June 9, 1954 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, June 9, 1954 at 1;00 o'clock P. M. Present were Mayor Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following proceedings were had; I Minutes of the last session were read, and it was moved by Commissioner Healy, seconded by Mayor Lowe, that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Kayor Lowe and Commissioner Healy; those voting No, none. Fetition ~o Continue North-South Alley in Block 7, Fairview Addition Mr. Howard Nelson was present and presented a petition of owners of proper~ in Block 7, Fairview Addition, requesting that the south 268 feet (approximate) of this alley, which was vacated many years ago but which has been used since on an unofficial basis as an alley, be re-established or re-designated as an alley. It was pointed out to Mr. Nelson that the best procedure in this case would be for owners of properties abutting this proposed alley to deed sufficient ground on which to establish an alley and that all owners involved. except Mr. C. R. Anthony, have indicated their willingness to do so. Mr. Anthony, at a oonference with the City Manager on June 5, 1954, indicated that he may deed the west 7t feet' of this proper~, which would aocomplish the desired purpose, and that he would be able to give a definite answer very soon on what he will do. After oonsideration, it was moved by Commissioner Healy, seoonded by Mayor Lowe, that the petition be aocepted and filed and action be deferred pending receipt of further information from Mr. Anthony as to what he will do regarding deeding a portion of his property for alley purposes, and the motion was I oarried by the following Aye and No vote; those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Claims for Month Claims Nos. 9679 to 9718 inclusive were presented on the various funds as follows; Band . 6.76 Cemetery 546,76 Cemetery Perm. Care 325.00 General 675.67 Garbage 187.38 Library 84.08 Park 496.72 Parking Meter 12.00 S. D. S. Revenue 825.68 Street 1,242.09 Water 4,086.94 Total -- -- $8,488.06 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Boteman and reoommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission and checking against the Claim Register, it was moved by Commiasioner Healy, seconded by Mayor Lowe, that the claims be approved and warrants drawn for their payment, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe I and Commissioner Healy; those voting No, none. Froposed Standard Station - Main & Grand A oommunication from the Standard Oil Company, accompanied by a plan fOr the construction of a service station at the corner of Grand Avenue and Main Street, was presented and read. Their property at this location has a frontage of 60 feet on Main Street and 120 feet on Grand Avenue. Their letter requested permission to remove or eliminate the curb for 59 feet on Main Street and 108 feet on Grand Avenue. Upon the grounds that this would be an excessive and unreasonable amount of driveway for the property, it was moved by Mayor Lowe, seconded by Commissioner Healy, that the request be denied and 382 that it be suggested to the applicant to present a new application and plan with driveway lengths cut to such length as would actually be necessary and reasonable for a service station at this loca- tion and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Budget Requests by Fire Chief Budget recommendations. as prepared by the Fire Chief for the Fire Department, were read. I Agreement for Gaging Station Approved A communication from U. S. G. S. was read stating that the office of the Montana State Engineer will contribute $100.00 in the fiscal year toward operation of the Gaging Station on the East Gallatin River and it would therefore be possible to continue this operation if the City of Bozeman would con- tribute $200.00 of the cost as it has done in fanner years. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the action taken on May 19. 1964 regarding this agreement be rescinded and that the City of Bozeman enter into said agreement for another year under the proposed conditions, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Soap-Box Derby -- Barricading Sixth Avenue The Manager reported that verbal request has been made for the barricading of Sixth Avenue for the Soap Box Derby as has been done in former years. It was moved by Commissioner Healy, seconded by Mayor Lowe, that tile City Manager be authorized to have the necessary barricades on Sixth Avenue erected for the Soap Box Derby and the City furnish police service and the necessary street cleaning be done. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. I Public Hearing - Vacation of Portion of East Main Street This being the time and place set for the hearing of protests to the vacation of a triangular portion of East Main Street west of vacated Aylsworth Street, the affidavit of publication of the Notice and the Service of the Notice on abutting property owners were presented. There was no one present to protest and no protests having been filed, it was moved by Commissioner Healy, seconded by Mayor Lowe, that the City Attorney be instructed to prepare an ordinance vacating said part of East Main Street, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No. none. Lease Agreement - I. O. O. F. Lot at Willson and Babcock A Lease Agreement between Western Star Lodge #4. I. O. O. F. and the City of Bozeman, under which this Lodge leases Lots 1 and 2, Block B, Alderson's Addition (corner of Babcock Street and Willson Avenue) to the City for use as a parking lot for ten years at a monthly rental of $75.00. was presented and read. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the agreement be accepted and approved, subject to a certified copy of the minutes of said Lodge being furnished authorizing the Trustees of said Lodge to enter into the agreement, and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman, and the motion was carried by the following I Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Liability Insurance on Swimming Pool & Playgrounds An insurance policy covering personal liability at the swimming pool and two playgrounds with $10,000.00 $50,000.00 limits of liability was presented. The policy was approved as to form by the City Attorney. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the policy be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. :388 Sale of Note of Jack French, Jr. The City of Bozeman holds the note of Jack French, Jr. in the amount of $600.00. This is the last of the assets in the D. L. Henry case which have not been converted into cash. The Security Bank and Trust Company will purchase this note at face value subject to indorsement to them with recourse. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the Director of Finance be I authorized to sell said note to the Seourity Bank & Trust Company under these terms and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Heal y; those voting No, none. Reports The following reports for the month of May, 1954 were presented: Chief of Pol ice Cashier Gas & Plumbing Inspector and the report of the Gas & Plumbing Inspector for the months of March and April, 1964. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Water Bill for Jaycee Sponsored Circus Waived It was reported that, through a misunderstanding regarding the license fee paid by the Jaycees for the circus sponsored by their organization on June 7, 1964, the oharge for water used by the circus has not been paid. It was moved qy Commissioner Healy, seoonded by Mayor Lowe, that the water charge be waived this time only, and the motion was oarried by the following Aye and No vote: tho se voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. I Request of Northern Auto to Move Building on Used Car Lot A request of the Northern Automobile Company to move the temporary office building on their used car lot at the corner of Grand and Babcock to their used oar lot at 215 West Main Street was reported. It was moved by Commissioner Healy, seoonded by Mayor Lowe, that the request be granted, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Request to Cut Curb -- Lot 3, Block C, Story's Addition A request from the Northern Automobile Company to cut the curb for a driveway on to Lot 3, Block C, Story's Addition was presented. It was moved by Commissioner Healy, seconded by Mayor Lowe, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. Agreement for Water Main Construction on East Main Street An agreement between the City of Bozeman and property owners on East Main Street to be benefited by the extension of a water main was presented, whereby the owners agree to pay a portion of the cost of said extension. The agreement was approved as to form by the City Attorney, and it was moved by Commissioner Healy, seconded by Mayor Lowe, that the Mayor and the C~rk of the Commission be I authorized to sign the agreement .~~r,the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy; those voting No, none. Resolution No. 763 -- Intention to Create S. I. D. 379 The City Attorney as instructed has prepared the resolution of intention to create Special Improvement District No. 379, paving on North Willson Avenue from Lamme Street to Villard Street. Resolution No. 763 was presented, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMMl TO CREATE A SPECIAL IMl?:FiOVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMFROVIi}dENT DISTRICT NO. 379 OF' THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND 384 INSTAILING A PAVEMENT PROJECT ON NORTH WILLSON AVENUE FROM WEST LAMME STREET TO WEST VILLARD STREET, SAID PAVEMENT PROJECT TO INCLUDE THE INSTALLATION OF CRUSHED GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE, AND CONCRETE CURBS WHERE NOT ALREADY PLACED AND IN SATISFACTORY CONDITION. It was moved by Commissioner Healy, seoonded by Mayor Lowe, that the resolution be passed and adopted and June 30, 1954 be set as the date for the hearing of protests, and the motion was oarried by the following Aye and No votel those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none. I License Fee fo r Carnival to be Sponsored by Amerioan Legion It was reported that the Amerioan Legion proposes to sponsor a carnival within sixty days and ask that the license fee be set the same as the fee for similar activities sponsored by other civic organi- zations. It was moved by Commissioner Healy, seoonded by Mayor Lowe, that the lioense fee for the carnival to be sponsored by the Amerioan Legion be set at $100.00 per day, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner He&y, seoonded by Mayor Lowe, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Healy; those voting No, none.
