HomeMy WebLinkAbout1954-07-21 :398 Bozeman, Montana July 21, 1954 The Commission of the Ci~ of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, July 21, 1954 at 1:00 o'clock P. M. Present were Mayor Lowe, - Commissioner Erwin, Commissioner Healy, City Attorney Lovelace and the Clerk, when the following proceedings were had: Minutes of the last session were read, and it was moved by Commissioner Healy, seconded by I Commissioner Erwin, that the minutes be approved as read. and the motion was carried by the following .Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Request to Block Street for 90th Anniversary Celebration Mr. Leo Noel of the Jaycees was present and requested that Main Street be blocked off from 7:00 F. M. to midnight on the following dates: July 31st, August 7th and August 11th for the purpose of holding a kangaroo court and street dance in connection with the celebration of the 90th Anniversary of the City of Bozeman. The Commission expressed approval of blocking the street and stated that the details should be worked out with the Police Chief and the Fire Chief. Request to Use Lindley i'ark During 90th Anniversary Celebration Mr. Ed. Sedivy was present and requested the use of Lindley Park for an encampment of Indians that will be here during the 90th Anniversary Celebration. The Commission expressed approval of use of Lindley Park for this purpose and asked that the details be worked out with the Fire Chief and the Park Superintendent. Mr. Sedivy also asked permission for a street parade on the afternoon of August 11, 1964. l'he City Commission expressed approval of this request. I Inquiry Re: Band Budget for 1954-56 Mr. Ed. Sedivy also inquired regarding the budget for the City Band for the coming fiscal year, stating that he had made request for additional personnel and two French Horns. He was informed that the Band Fund for the coming fiscal year was limi tedto cash on hand and income from maturing invest- ments, but that the City would do what could be done on the money available. Provisional Passage Ordinance No. 774 - Approrriation Ordinance Ordinance No. 774, the Appropriation Ordinance, for the fiscal year ending June 30, 1955 was presented, entitled: AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITUUS DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETORY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNM1l:NT OF THE CITY OF BOZEMAN. MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1955. It was moved by Commissioner Healy, seconded by Commissioner Erwin, that the ordinance be provisionally adopted and August 4, 1954 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Lease Agreement -- Linfield Froperty The lease agreement and option to purchase Lot Three and the North five feet of Lot Four, I Block B, Alderson's Addition, between F. BertH Linfield and Ruth H. Linfield and The City of The agreement was approved as to form by the City Attorney. I. D. No. 379 It was stated this was the time and place set for the opening of bids for the construction of Special Improvement District No. 379, paving on North Willson Avenue from Lanme Street to Villard Street. The affidavit of publication of the Notice to Bidders was presented. It was moved by Commissioner Healy, seconded by Commissioner Erwin, that the bids be opened and read, and the motion I was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. The following b ids were thereupon opened and read: I Basic Bid Al ternate 11 Alternate #2 Alternate #3 I (Road Mix) Travel Plant Mix Hot Pl ant Mix Standard Construction Company $4,531.80 - - $2,327.50 - - Long Construction Company 4,894.50 .2,194.00 - - $3,222.00 The bids were referred to the City Engineer for checking and recommendations. Ordinance No. 775 - Salary Ordinance 1954-55 The ordinance setting the monthly salaries of the heads of departments and the employees of the City Commission for the fiscal year ending June 30, 1955 was presented, entitled: AN ORDINANCE OF THE CITY OF BOZEMAN, MONTMJA FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS, AND THE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW. It was moved by Commissioner Erwin, seconded by Commissioner Healy, that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Zoning Ordinance No. 776 Adopted I The City Attorney stated that he has incorporated the recommendations of the Board of Adjustment and other recommended changes by the City Commission in the Zoning Ordinance. He presented Ordinance No. 776, entitled: AN ORDINANCE CLASSIFYING, REGULATING AND RESTRICTING THE LOCATIONS OF TRADES AND INDUSTRIES AND THE LOCATION 01" BUILDINGS DESIGNED FOR SPECIFIED USES; REGULATING AND LIMITING THE HEIGHT AND FLOOR AREA OF BUILDINGS HEREAFI'ER ERECTED OR ALTERED; REGULATING AND LIMITING THE INTENSITY OF THE USE OF LOT .AREAS, AND REGULATING AND DETERMINING THE AREA OF YARDS, COURTS, AND OTHER OPEN SPACES WITHIN lIND SURROUNDING SUCH BUILDINGS; ESTABLISHING DISTRICTS AND BOUNDARIES THEREOF -FOR SAID PURFOSES; :AND PRESCRIBING PENALTIES FOR THE VIOLATING OF ITS PROVISIONS; AND REPEALING ORDINANCE NUMBERED 711 AS AMENDED BY ORDINANCES NUMBERED 739, 753 AND 764 OF THE CITY OF BOZEMAN. It was moved by Commissioner Erwin, seconded by Commissioner Healy, that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Healy, seconded by Commissioner Erwin, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner Heal y; those vat ing No, none.
