The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, August 25, 1954 at 1:00 o'clock P. M. Present were Corr~issioner
Erwin, Commissioner Healy, City Manager Henderson and the Clerk, when the following proceedings
were had,
Minutes of the last session were read, and it was moved by Commissioner Erwin, seconded by I
Commissioner Healy, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: tilose voting Aye being Commissioner Erwin and Commissioner Healy; those votin~ No,
none.
Final Adoption of AlproI,riation Ordinance No. 774
This being the time and place set for the final adoption of the AFFropriation Ordinance for the
fiscal year ending June 30, 1955, the affidavit of publication of the ordinance was presented. There

was no one present to inquire or protest and Ordinance No. 774 was presented, ent itled:
AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE
WITH BUDGETORYREQUIREMENTSFOR MAl NT ENANCTi: ETC., OF THE MUNICIPAL GOVERNMENT OF THE
CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1955.
It was moved by Cornnissioner Erwin. seconded by Commissioner Healy. the t the Ordinance be finally
passed and adopted and the motion was carried by the following Aye and No vote: th os e vot ing Aye
being Commissioner Erwin and Commissioner Healy; those voting No, none.
Public Hearing S. 1. D. 380
This being the time and place set for public hearing on the creation of Special Improvement
District No. 380, paving on North Tracy Avenue from Short Street to Peach Street, the affidavit of
publication of the Notice m d the Clerk's Mailing Certificate were presented. There was no one I
present to protest and. no protests having been filed. it was moved by Commissioner Healy, seconded
by Commissioner Erwin, that the City Attorney be instructed to prepare the resolution creating the
district and the City Engineer be instructed to prepare the detailed rlans end specifications for tile
district, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Erwin and Commissioner Healy; those voting No, none.
Montana Flour Water Ri,:;ht in Bozeman Creek
It was reported that a representative of the Montana Flour Mills Company has made an informal
offer to The City of Bozeman to sell their water right of 800 inches of water in Bozeman Creek to
the City of Bozeman. The Manager reported that, after investigation and conference with O. W. Monson,
of Montana State College, the following conclusions were reached:
1. That the source of supply of the 800 inches of water in Bozeman Creek is just south
of the city limits,
2. That it is not possible to get this amount of water into the city's system at the
settling basin,
3. That if the water is taken out at the present source of supply, it would require a
tank for storage and pressure, pumping, fil tration and treatment before it could be
used,
4. That a better source of additional water supply might be secured from a well which I
could be drilled southwest of the City.
Based on these facts, it appears that the City of Bozeman could not make practical use of this water
right and no action was taken relative to the informal offer which had been received.

Blanket Liability Insurance
The Manaf:;er reported that, as instructed, he has received quotations on blanket liability
insurance policies for the City with various limits of liability. It was moved by Comrniss ioner Healy,
seconded by Commissioner Erwin, that the City Manager be authorized to order a liability policy, with
limits of 50M-IOOM-50M.provided such a policy can be secured for consideration of the Commission

end examination by the City Attorney without obligation on the City to purchase it, and the
motion was carried by the following Aye and No vote: those voting Aye bein~ Corrrmissioner Erwin and
Commissioner Healy; those voting No, none.
Bids for Billing & Posting Machine
In line wi th recommendation of the State Examiner that machine accounting be used in the Water
Depa rtment, investigation has been made regarding machines for this purpose and the cost of such a
I machine would require advertising for bids. It was moved by Commissioner Erwin, seconded by
Commissi:mer Healy, that the City Manager be instructed to prepare the necessary sfecifications and the
Clerk of the Commission be authorized to have a notice of call for bids on an ec~ountir~ machine for
the Water Department published as required by law, and the motion WAS carried by the following Aye and
Novo te : those voting Aye being Commissioner Erwin and Commissioner Healy; those voting No, none.

The report of the Director of Finance for the month of July, 1954 was presented. It was moved
by Commissioner Healy, seconded by Commissioner Erwin, that the report be accepted and ordered filed
and the motion was carded by the following Aye and No vote: those votinp; Aye beinG Commissioner
Erwin and Commissioner 'J.1e!'ly; those voting No, none.
Bids for Used Tractor
Need for a track-type tractor with b1Jlldozer for work at the city dU~D nnd for numerous oth~r
types of work has '!leen discussed from time to time. The Mana<cer reported tbet a good usen machine
wonld be satisfa~t:)ry for this 'WOrk and that :it should be possible to purchase such a machine for in
the approxiJTl8te price range of $3,000.00.
It was moved by Commissioner Erwin, seconded by Commissioner Healy, that the City Manager be
I A.uthorized to prepare specifications for a second-hand tractor the cost not to exceed $3,500.00 and
the Clerk of the Cornmiss ion be authorized to publish the call for bids on such a machine, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Erwin and
Commissioner Healy; those voting No, none.
Comrrwnication -- Alcoholics
A communication from Richard Lubben, Superintendent of the Deaconess Hospital, was read giving;
costs for the care of alcoholics at his institution, information as to the number of cases handled
durinrr, the lest year !Xl d stating that su ch cases would not be taken at the hospi ta.l unless payment and
provisions for their CAre was guaranteed by a j!overnmental a!,,:encv. The matter was taken under
advisement.
Adjournment
There being no further business to come before the Commission at thjs time, it was moved by
Commjssioner Healy. seconded by Commissioner Erwin, that the mer:>+i:ng adj ourn and the motion was
