The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, Januery 13, 1954 at 1:00 o'clock P. M. Present were Mf\yor Lowe,
Commissioner grwin, Commissioner Healy, Ci ty Manager Henderson, City Attorney Lovelace and the Cle rk,
when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by COJilltlissioner Erwin, seconded I
by Commissioner Healy, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those
voting No, none.
Frogress Relort on Paving and Trunk Sewer Extension
A progress report was made on engineering work being done by the City Engineer and his staff.
As instructed by the City Commission, the Engineer has prepared descriptions, preliminary plans and
estimates of cost on the following proposed paving districts:
1- Arthur Street between Willson Avenue and Third Avenue,
2. North Willson Avenue between Menderiliall and Lamme Street.
3. South Bozeman Avenue between Story and Koch Street,
4. North Fifth Avenue from Lamme Street to Durston Road
and North Fourth Avenue from Villard to Durston Road
and Villard Street between Fourth and Fifth Avenue.
These data are being turned over to the City Attorney for his rreparation of Resolutions of
Intention to create these districts.
It was al so reported thAt pI ens and sIecifications will be completed in the near future for a
sanitary trunk sewer line from Ninth and Villerd to Curtiss Street. These should be finished so that
call for bids on the project can be made in the early spring.
Furchase of Water Meters I
'fhe Manager asked authority to purchase, from the Hersey Meter Company. twenty-five water meters
to cost between ~500.00 and $600.00 for use in the Water Department. It was moved by Commissioner
Healy. seconded by Commissioner Erwin, tha.t this purchase be authorized and the motion was carried
by the following Aye and No vote: those voting Aye being Ma~/or Lowe, Commissioner Erwin. Corruniss ioner
Healy; those voting No, none.
Plat for Eck Addition to City of Bozeman
A proposed plat and dedication for the Eck Addition to the City was presented. It was moved by
Commissioner Healy, seconded by Commissioner Erwin, that the City Attorney be instructed to prepare
a resolution to bring this tract of ground into the City and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; tho s e
voting No, none.
Applications for City Beer & Liquor Licenses

It was moved by Commissioner Erwin, seconded by Commissioner Healy, that the applications be
approved and the licenses issued and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Lowe, Corr:Jllissioner Erwin, Commissioner Healy; those voting No, none.
Communication from State Highway DeIJartment -- Re: Street ImI,rovements
A communication from the State Highway Engineer was read acknowledging receipt of Ie tters
written to them regarding street improvements for South Eighth Avenue, North Rouse Avenue, a truck :321
route, and North Seventh AVenue. It was stated that the letters have been referred to the Planning
Survey Engineer for study and comment and not later than the middle of March, 1954 a visit will be made
to Bozeman to clear up the questions asked and the questions be confirmed in writing.
Request to re-open Driveway -- 237 East Main Street
A request from Veryl Haverly, of the Bozeman Carburetor Company was read requesting that one
I parking ;JJeter be removed so that the driveway at 237 East Main Street could be re-opened and used for
his place of business. It was pointed out that the curb has been previously cut and a driveway from
Main Street has served this building before. It was moved by Commissioner Erwin, seconded by
Commissioner Healy, that the request be granted and the motion was carried by the following Aye ~ld No
vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none.
Request for Driveway on Grand Avenue for Property 201 West Main
A request to erect "No Parking" signs to f,rovide a driveway to the rear of the building from
Grrold AVenue at 201 West Main Street was considered. It was pointed out that the vacant lot at the
rear of this property is used for public parking and also that there is no curb on the street at
this property and a driveway cannot be designated except by signs. It was moved by Commissioner Healy,
seconded by Commissioner Erwin, that the request be granted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those
voting No, none.
Re}.'orts
The following reports for the month of December, 1953 were presented:

and the November report of the Building Inspector and the Gas & Flumbing Inspector and the annual
report of the Building Inspector and the Gas & Plumbing Inspector. It was moved by Commissioner ErWin,
seconded by Commissioner Healy, that the retorts be accepted and ordered filed and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin,
Commissioner Healy; those vo ting No, none.
Payment by Insurance Company for Damage to Light F'ost -- 411 S. Willson
A letter from the claims office of the General Insurance COlnpany, Butte, Montana was read stating
that the cost of re1-air for the damaged light post near 411 South Willson would be mailed to the City
upon receiving a signed release by a city official of all future claims. A letter suggesting that
the check be mailed to their local agent and delivery of the check to be made upon receipt of the
signed release was read. After discussion, it was moved by Commissioner Healy, seconded by Commissioner
Erwin, that the Mayor be authorized to sign the release for the City of Bozeman, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Erwin,
Corrmissioner Bealy; those voting No, none.
Zoning -- He; Basement Afartment on South Eighth Avenue
I It was reported that the new owner of the property at 306 South 8th Avenue had inquired regarding
the construction of a basement apartment in this residence and because of the recent court decision
regarding basement apartments the owner was informed that a basement apartment could be installed here.
It was pointed out that the apartment does not have the required floor space for this district and that
the court decision had to do with light and height above ground level for basement apartments. It was
decided tha t the matter should be referred to the B09rd. of Adjustment for a public hearing.
Signs - 27 East Main Street and 130 East Main Street

It was reported that the sign on the building at 130 Eust Main Street has been taken down and

moved to 27 East Main Street; that this sign is of' wooden letters and has a wooden structure on the
back on which the letters are fastened, and the, t a new sign to be erected at 130 East Main has a wooden
structure on the back for fastening tile letters. The sign ordina.nce requires that signs of this
type and size be made of incombustible material. The City Commission setting as a Board of Appeals
discussed the matter and it was thought that the hazard would not be any greater than it had been
and the larger portion of the signs are made of' incombustible material. I
It was moved by Commissioner Healy, seconded by Commissioner Erwin, that sign permits be issued
to Gamble's to erect the sign at 27 East Main Street and Coast to Coast Stores be issued a permit to
erect a sign at 130 East Main Street, and the motion was carried by the following Aye and No vote:
those voting Aye being Mnyor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved
by Cornmis sione r Healy, seconded by Commissioner Erwin, that the meeting adjourn and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Erwin and Commissioner Healy; those vo ting No, none.
