The Corrnnission of' the City of Bozeman met in ree;ular session in the Commission Room, City Hall
Building, Wednesday afternoon, January 20, 1954 at 1:00 o'clock F. M. Fresent were Mayor Lowe,
Commissioner Erwin, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk,
when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded

by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those
voting No, none.
Application for Beer License
The application of the Parkway Grocery for a retail license for sale of beer for "Off Premise"
consumption was presented. It was moved by Commissioner Erwin, seconded by Commissioner Healy, that
the application be aPFroved Mld the license issued and the motion was carried by the following Aye
and No vote: those voting; Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those votinE
No, none.
Cost Schedule for Appraisal of City Buildings
Communications from the General Appraisal Company and the U. S. Appraisal Company were read giving
a schedule of costs for appraisal of city buildings for fire insurance purfoses.
Protests and Sectioning of Special Improvement Districts Discussed
The City Attorney' reported that he has investigated the law in regard to protests for Special
Improvement Districts and that, even though the lot abutting on the improvement is assessed at doutle
I the area, protests on such lots are to be figured on actual area.
The matter of setting up special improvement districts in sections to moke the assessment more
equitable was discussed. The City Attorney reported there is no authority to put improvement districts
in sections but that this has been done in the past and bonds have been fur('liBsed by bonding companies,
And the sectioning of districts was not questioned. He advised that, in his opinion, the Commiss ion
could set up districts in sections. It was decided that the }Jroposal to pave North Fifth, North Fourth
and Villard Street should be set up in five sections with protests to be figured on the actual area.
Traffic Light for Main and Seventh Avenue
The matter of the installation of a traffic light at the intersection of Main Street and North
Seventh Avenue was discussed. It was decided that a traffic light should be installed at this inter-
section, and it was moved by Commissioner Healy, seconded by Commissioner Erwin, that the City Manager
be instructed and authorized to have one of the traffic lights which was recently taken down on Main
Street installed at this intersection, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner HelliYi those voting No, none.
Communication Re: Derosi t on Car by D. L. Henry
A communication from Mr. Ludlam, Los Angeles Attorney handling the city's interest in the recovery
I of' money deposited by D. L. Henry with the Muntz Car Agency was read, stating he believes that the
Muntz Car Agency will pay up to $750.00 for a settlement on the der,osit made by Henry.
After ditcussion, it was thought that a summary of the expenses incurred by the car Flgency in having
a new engirle installed in the car should be asked for and the City Attorney was authorized to make
another offer of settlement in the amount of $1,250.00.

The annual rerort of the Chief of Police was presented and filed.
AdvertisinG for Bids -- Sewer Tile for Addi tion to West Trunk Sewer
The matter of havinE; sewer tile on hand for the construction of an addi bon to the West Side 1'runk

Sewer was discussed. Approximately 4000 feet of 12-inch tile will be required for this project and
the advisability of purchasing this tile in advance was considered so that the material would be on
hand and I;ossible delays in deliveries avoided 'when the project is ready for construction in the
spring. It was moved by Commissioner Erwin, seconded by Commissioner Heal y, that, based on }-hns and
sj:;ecifications 0 f the City Engineer, the Clerk of the City Commission be authorized to advertise for
bids for vitrified clay pipe and fittings as required for an extension of the west trunk sewer from I
Durston Road to Curtiss Street, And the motion was carried by the followinG Aye and No vote: those
voting Aye being; Mayor Lowe, Commissioner Erwin and Commissioner Healy; those voting No, none.
Dance Hall Licenses
Inquiry has been received regarding proposed licensing and operation of a dance hall on the
second floor of the buildinG at 27 West 11ain Street which adjoins the Arcade Bar and Lounge building.
The proposed plan would be to have a door cut 'through the partition so as to provide cormection and
access between the second floors of the two buildings, the Arcade Lounge being on the second floor
of that building.
After consideration by the Commission, the City Attorney was instructed to prepare a wri tten
opinion dealing with the subject of licensing of dance halls under these conditions.
Business License for Cleaning Establishment at 219 West Main Street to be Approved
It was reported that the Barrel Cleaners are moving their dry cleaning establishment into the
building at 219 West I'.!1ain Street and have already expended considerable amounts in installation of
special equipment and work on the building in preparation for this move. Section 1008 of Ordinance
685, the Building OrdinAnce, was read. It states in part, "Dry cleaning };-lants in which combustible
solvents are used or stored shall be Type I construction and shall not exceed one story in height". I
The Commission considered the fOllowinE points:
1. The equipment being installed is relorted to be of new modern desiGn in which fire and
explosion hazards have been largely eliminated.
2. The building to be used i.s of brick wall construction and well maintained.
3. Operation of a dry cleaning plant in this building would create no greater hazard than
is created by other such plants in the city.
It was moved by Commissioner Healy, seconded by Commissioner Erwin, that, upon presentation by
the Barrel Cleaners of a proper application for a license to operate their dry cleaninE llent at 219
"West Main Street. the license be granted and the mot.ion was carried by the following Aye and No vote:
Ulose voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner Healy; those voting No, none.
Schedule of Bonds for City Employees
After extended study and investigation. the City Commission set the following amounts on bonds
for City employees:

tions on the blanket bond.

Over-all master planning for the Cit;y and reviewing; of present ordinances was again discussed
by the City Commission.
Adjournment
There being no further business to come before the Commission at this time, it was moved
