M. Present were Mayor Lowe, Commissioner Erwin, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, when the i'ollowing proceedings were had; Minutes of the last regular session were read, and it was moved by Com~issioner Healy, seconded I by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none. Resolution of Intention to Extend City Limits to Include Eck's Addition The City Attorney, as instruc ted, has prepared a resolution of intention to extend the ci ty limits to include the property owned by Hugo Eck, lying south of Langohr's Addition. CertifyinG Unpeid Special Tax Dnd Attendance at Tax Sale Authorized It was reported thet the following; described properties are being sold at tax sale of February I 6th, 1954, arld the unpaid special assessment on these properties are as follows: Lots 11 & 12, Block 4, West fa rk Addi tion . . . . . ~.123.05 All of lots 1 to. 12 lyinG south of Gallatin Vulley Railway Company right-of-way in Block 20, Butte Addition . . 292.80 It was moved by Commissioner Healy, seconded by Commissioner Erwin. that the amount of these unpaid Bssessments be certified to the County Treasurer and that the Mayor and the Director of Finance be authorized and designated to attend this tax sale and bid up to the total amount of delinquent taxes and assessments against these properties, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Heal y; those voting No, none. Attendance to Executive Committee of A. W. W. A. Meeting Authorized It was reIorted that the Executi ve COJIL~i ttee of the Montana Section of the A. W. W. A. will meet in Helena on February 6, 1954 to IllEJke [Inns for their annual meeting to be held in Bozeman this sI-;rin;.:. It was moved by Commissioner Erwin, seconded by Commissioner Healy, thAt the City Menager and one other representative of this city be authorized to Bttend this meeting and tlleir eXfenses be raid from the Yinter Fund, and the motion was carried by the following Aye and Ko vote: those voting Aye being Mayor Lowe, Com~issioner Erwin, Commissioner Healy; those voting No, none. License for Jaycee Auto Thrill Show Waived Verbal inquiry has been received from the Bozeman Jurdor Chamber of Conanerce as to the amount of ci ty license which would be charged for an "Auto Thrill Show" which is being considered for being held s.t the Gallatin County Fair Grounds in July under their sI.onsorship. It was pointed out that this will be a spectator type show and not of the carnival type. It was moved by Commissioner Healy, seconded by Cownissioner Erwin, that a show of this type, under sIonsorship of the "Jaycees", would not be required to secure a city license and the motion was carried by the following Aye and No vote: those voting Aye being; Mayor Lowe, Corrunissioner Erwin, Commissioner Healy; those voting No, none. Proposal for Federal Tax on City Revenue Bonds :327 A corrununication from the National Institute of Municipal Law Officers was read, statinz that a I-rofosal to make munic ipal revenue bonds subject to federal income taxes Vlould be considered by the House Ways and Means Committee. After discussion, it was decided that this matter should be taken up by the Montana Municipal League. Ground Plan for Service Station at Durston Road and Seventh Avenue I A cround flan showing building location and other details of' a service station proposed to be erected at North Seventh and Durston Road by the Union Oil Company was presented and examined by the Conuniss ion. After examination of the plan as presented, it was decided that the Union Oil Company should be given the information: 1. The Co;nmission does not look with favor on two driveways on l\orth Seventh Avenue. 2. The present Ordinance, does not permit placing the Gas pumps on the Iroperty line. 3. A canopy over the pumps could not be closer than ten feet to the Froper~y line, 4. Waste water from a car wash rack should be taken into a sump. 5. That, if the present irrigation ditch is moved, it will have to be relocated on their own property, 6. That connection to the Sanitary sewer could be made at the present line at Seventh and Durston Road, but this would not relieve this property from sI-ecial assessment on any 18teral sewer which might be extended in the future to serve the propert:,. Erection of Pole for Traffic Light at 7th & Main Street The Manager reported that, preliminary investigation regarding; the installation of a traffic control light at Seventh and Main Street, shows that the I-,resent pole at the northwest Corner of the intersection will serve for one pole from which to suspend the traffic liGht but the t an additi:.mal I role will have to be erected on the property of Embry and Jordan and guy wires to surI-ort this pole will also have to be installed on their property. After discussion, the City Manager was instructed to arrange by corres;t;ondence for r-errnission and authority to erect the necessary poles and guy wires on the property of ~illlbry end Jordan. Revision of Zoning Ordinance Discussed It was reported that tIle Board of Aojustment has recommended that at the time the Zoning Ordinance is revised, Business-Residence No. 1 should be included and made a part of the Main Business District. It was decided that the portion of Business- Residence District No. 2 located in Block F, Story's Addition should also be included and made a rert of the Main Business District. It was also decided that the requirements for light and ventilation for apartments s}lOuld be the requirements as set up by the Federal Housing Authority. The City Attorney stated that the amendments to the rresent Zoning Ordinance will be incoq:,orated into one ordinance and presented to the Zoning Board for' consideration. City Attorney's Opinion -- Re: Dance Hall License The City Attorney reported that, in connection with instructions Eiven to him at the last meeth<.; to prepare a wri tten opinion regarding licensing of' a dance hall in a building adjacent to one where I beer And liquor is sold, he now has been infonned that the person who sought information on the subject has had his plans chanced and no longer needs the information. He therefore recommended that, ur,til a wri tten application for license to operate a dance hall under such conditions, which apl-lication is aI-I roved by the owner and the lessee of the building where the dance hall is to be operated, is presented, no written opinion on the question should be prepared. His recommendation was nrproved. .- Adjournment There being no further business to come before theComrnission et this time, it was moved by Commissioner Erwin. seconded by Commissioner Healy, that the meeting adjourn and the motj on was 328 carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Corrunissioner Erwin and Commissioner };ealy; those votinG Lo, none.
