The Commission of the City of Bozeman met in regular session in the Commission Room, City Hell
Building, Wednesday afternoon, February 3, 1954 at 1:00 o'clock F. M. fresent were Mayor Lowe,
Commissioner Erwin, Commissioner Healy, City MAnager Henderson, City AttornejT Lovelace and the Clerk,
when the following proceedings were had:

Claims for the Month
Claims Nos. 8595 to 8808 inclusive were presented on the various funds as follows:

The Manflger stated that he has aUdi~.these claims and finds them to be true and lawful claims
I ageinst the City of Bozeman and recommends that warrants be drawn for their payment. After examinat.ion
of the claims in detail by the City Commission and checkinG the claims aLainst the clrdm register, it
was moved by Cow~ssioner Healy, seconded by Commissioner Erwin, that tile claims be apfroved and
warrants drawn for their fayment and the motion was carried by the following Aye and 10 vote: tho se
votinG Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those votinG 10, none.

Corrunission, it was moved by Commissioner Healy, seconded by Commissioner Erwin, that the position of
Administrative Assistant to the City Manager be and is hereby created and authorized for the City of
Bozeman and the announcement of openinb for the position be apfroved and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Lowe, Commissior:er Er""Nin, Co'mnissione, Hoaly;
t,hose voting No, none.
It was suggested that a panel of' local citizens be appointed to review aprlications, intervi ew
applicants, and act in an advisory capacity in the selection of' a man for the proposed new position.

The aHJlication of Theodore J. Stump for a wholesale beer license was preser:ted. It wes moved bJT

issued and the motion was carried by the following Aye and No vote. those voting Aye being Mayor Lowe,
Commissioner Erwin, Cownissioner Healy; those voting No, none.
Service Station -- Seventh Avenue Bn() Durston Road
The 8l-':rlicetion of the Union Oil Company to construct a service station at the corner of North
Seventh Avenue and Durston Road and the letter written to them giving; the information as set forth at
the regular meeting of January 27th. 1954 were reviewed by the City Conunission. Mr. Hayes. Sales I
ManaGer, and Mr. Ashby, Construction Engineer, of the Union Oil Com:rany had come to Bozeman during the
Fast week to discuss this mstter. They contend that, since Durston Road is not paved, it will be
necessary to have two driveways for this station on :Ko. 7th Avenue. They also advanced the argument
that the cBnory which will be built over the rump islAnds at this stat ion is, in fact, a marquee and
should therefore be pennitted to be built to the property line or to extend over street area.
The City Commission concurred iTl the opinion that the proI,osed canopy would be a part of the building
and could not extend closer than 10 feet to the property line. On the quest ion of two driveways from
7th Avenue, it was agreed that these woul~ not be in accordftnc~ with present policy of this City on
service ste tion dd veways but that, if special reasons are presented why the~T should be F~rmi tted in
this case, the COTffinissi on will be Clpd to reconsider this ro1 icy.
l'roposed Zoning Ordinance
A draft of the prOI-os6cl ZoninG Ordinance was f.resented and considered by the City Commission.
After reviewinG the }'roposed draft, it was moved by Commissioner Healy, seconded by Cownissioner Erwlll,
that the pro},osed orc.i!jance be referred to the Zoning Board. for study and I-ublic hearing as provided
by 1 aw, and the motion was carried by the foll owing Aye and No vote: those voting Aye being Ma;yor
Lowe, Commissioner Erwin, Commissioner Healy; those votinG No, none. I

There bein6 no further business to come before the Commission at this time, it was moved by
Commissioner F,rwin. seoonded by Mayor Lowe, that the meeting adjourr: end the motion was carried by the
followinG Aye and 1;0 vote: those voting A":fT8 being Mayor Lowe, Commissioner Erwin and Commissioner
Heal;y; those voting No, none.
