The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, Maroh 3, 1954 at 1:00 o'clook F. M. Present were Mayor Lowe,
Commissioner Erwin, City Manager Henderson and the Clerk of the Commission, absent Commissioner Healy,
when the following prooeedings were had:
I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seoonded
by Mayor Lowe, that the minutes be approved as read, and the motion was oarried by the f~1lowin, Aye
and No vote: those voting Aye being Mayor Lowe and Commiuioner Erwin; those voting No, none.
Bids for Sewer Pipe
The Manager stated this Was the time and plaoe set for the opening of bids for sewer tile for the
Tenth Avenue Trunk Sewer. He presented the af'f'idavit of publication of the Notioe to Bidders. It
Wes moved by Commissioner Erwin, seoonded by Mayor Lowe, that the bids be opened and read and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commiss ioner Erwin;
those voting No, none.
The i'ollowing bids were opened and read,

Lovell Clay Products Co. 4,107.84
It was moved by Commissioner Erwin, seconded by Mayor Lowe, that the ccntract for sewer tile be
awarded to the Lovell Clay Products Company end the motion was oarried by the following Aye and No
vote; those voting Aye being Mayor Lowe and Commissioner Erwin; those voting No, none.
Bids for Construction of Tenth Avenue Trunk: Sewer
It was moved by Commissioner Erwin, seconded by Kayor Lowe, that the City Engineer be instructed
I to prepare detailed plans and speoifioations for the construotion of the Tenth Avenue Trunk Sewer and
based on these plans and speoifioations the Clerk of the Ci~ Commission be authorized to advertise
for bids for installing this sewer, the bids to be opened on Maroh 31, 1954, and the motion was oarried
by the following Aye and No vote: those voting Aye being Mayor Lowe and Commiss ioner Erwin; those
voting No, none.
Claims for the Month

The Manager stated that he has audited these olaims and finds them to be true and lawful claims against
The City of Bozeman and reoommends that warrants be drawn for their payment. After examination of the
cla~s in detail by the City Corundasion and cheoking against the Claim Register, it was moved by
Commissioner Erwin, seoonded by Mayor Lowe, that the olaims be approved and warrants drawn for their
payment and tie motion was carried by the following Aye and No votel those voting Aye being Mayor
Lowe and COmmissioner Erwin; those voting No, none.
Construotion of Root Beer Stand -- Blook 52, Capitol Hill Addition
w. D. Howells, Building Contractor, was present to discuss proposed oonstruction of a root-beer

stand on the southeast corner of Block 52, Capitol Hill Addition. He stated tl'a t the owners would
like to remove the curb and gutter along College Street and build the building as near College Street
as possible. The Commission told Mr. Howell that it is their policy not to grant unnecessary driveway
space end that a plan showing location of the building on the lot and the amount of driveway space
required should be prepared and presented for consideration before any driveways could be approved.
Salvage of Tin Cans from City Dump
A proposed contract between The City of Bozeman and P. F'. Yarzombek, Butte, Montana, pertaining I
to salvage of tin cans from the ci~ dump was read. Several points in the proposed contract were con-
sidered unacceptable &ld the City Attorney was instructed to prepare a new proposed contract to be
presented to Mr. Yarzombek for his consideration and approval
Traffic Survey To Be Finished Near April 1st
A communicat ion from Mr. Helland, Planning Survey Engineer of the State Highway Department, was
read, stating the preliminary report of the traffic survey conducted in Bozeman would be ready about
April 1st, 1954.
Blanket Bond Approved
A blanket bond, written in the General Casualty Company of America, to cover all employees of
this city except seven positions specifically cited, the said bond in the amount of $2,500.00 with
$2,500.00 excess indemnit.y on the position of Chief of police, was presented. It was moved by
Commissioner Erwin, seconded by Mayor Lowe, that, subject to its aIJproval as to fom by the City
Attomey, this bond be approved and accepted and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Lowe and Commissioner Erwin; those voting No, none.
It was moved by Commissioner Erwin, seconded by Mayor Lowe, that, since the position of City
Engineer is now covered by the blanket bond, the bond now carried in the Standard Accident Insurance I
Company to cover S. D. Waldorf in his position as City Engineer be cancelled and terminated as of
February 20, 1954 and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe and Commissioner Erwin; those voting No, none.
Plans for Widening Driveway at Post Office Approved
plans for the proposed widening of the driveway on Babcock Street to the rear of the Post Office
with a driveway extending to the alley north of the Post Office were presented. It was moved by
Commissioner Erwin, seconded by Mayor Lowe, that the plans be aIJproved an d the City Manager be
authorized to endorse the approval on the plans, and the motion was oarried by the following Aye and
:No vote: those voting Aye being Mayor Lowe and Commissioner Erwin; those voting No, none.

Erwin, seconded by Mayor Lowe, that t!~ reports be accepted and ordered filed and the motion was

Discontinuance of Taxi Stands to be Discussed
Questions relative to parking spaces now being used as taxi stands were discussed. Complaints
have been received ti~t the stand on Willson Avenue at the Baxter Hotel is seldom used by the Taxi and
not much use is made of the Taxi Stand at Tracy Avenue on the corner of Mendenhall Street. The City
Manager was instructed to notify Mr. Skoog, the proprietor of the City Taxi, that it is proposed to
discootinue these two taxi stands and that the matter will be discussed further at the Commission
meeting of March 17, 1954. 841.
Policeman Attendance at Trial in Logan, Utah Approved
A communication from the District Attorney of Logan, Utah, requesting the presence of Police
Captain Saunders and Patrolman Bennie Davis to attend and testify at 8 trial for murder of a
prisoner a~prehended in Bozeman, was read. It was moved by Commiss ioner Erwin, seconded by Mayor
Lowe, that their attendance at this trial be authorized, and the motion was carried by the following

There being no further business to come before the Commission at this time, it was moved by
Commissioner Erwin, seconded by Mayor Lowe, that the meeting adjourn and the motion was oarried by
the following Aye and No vote: those voting Aye being Mayor Lowe and COllunissioner Erwin; those
voting No, none.
