The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, April 7, 1954 at 1:00 o'clock P. M. Present were Mayor Lowe,
Commissioner Erwin, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk,
when the following proceedings were had:
I Statement of Mayor Lowe -- Re: Employment by City
Mayor Lowe pointed out that, at the opening of the special meeting held on Monday, March 29, 1954,
he had made the following statement:
"Before taking up consideration of final settlements of losses in the Donald L.
Henry embezzlement case and so as to make this of permanent !-,ublic record, and
to make a specific answer to unfounded rumors which have come to my attention,
I wish to state and want it thoroughly understood that I am not now an appli-
cant nor have I at any time been an applicant for any position of the City of
Bozeman nor would I consider employment in any position with the City of Bozeman
except the position of City Commissioner and Mayor to which offices I have been
regularly elected by the votors of this ci ty."
Mayor Lowe requested that, since this statement was not made a regular part of the minutes of the
s~ecia1 meeting of March 29, 1954, it be made a part of the minutes of this meeting.
Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by Commissioner Healy, that the minutes be approved as read, and the mation was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those
I voting No, none.
Communication -- State Highway Re: Road froblems in City of Bozeman
A communication from Scott Hart, State Highway Engineer, dated April 1, 1954, was read, in which
it was stated that representatives from the State Highway Department and the Bureau of Public Roads
would be in Bozeman within ten days or two weeks to discuss road problems with the City Commission.

It was moved by Commissioner Healy, seconded by Conunissioner Lowe, that the reI-,orts be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting; Aye
being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none.
Contract for Tenth Avenue Trunk Sewer
The contract wi th Haggerty-Messmer Company for the construction of the Tenth Avenue Trunk Sewer
was presented. The contract having been prepared by the City Attorney, it was moved by Commissioner
F;rwin, seconded by Commissioner Healy, that the Mayor and the Clerk of the Commission be authorized
to sign the contract for the City of Bozeman. and the motion was carried by the following Aye and No
I vote: tl.ose voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Healy; those voting No, none.
Tag Day -- May 1st -- Referendum #57 & 58
It was reported that inquiry has been made for permission to have a tag day on Saturday, May 1st,
1954, to raise funds to promote the passage of Referendums No. 57 & 58 which would permit the sale of
bonds for the expansion of state institutions at Warm Springs and Boulder, Montana. It was moved by
Commissioner Healy, seconded by Commissioner Erwin, that permission for this tag day be granted and
tile motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe,
Commissioner Erwin, Commissioner Healy; those voting No, none.

Renewal of folicy -- Collision on Folice Cars
A renewal insurance policy with the Trucker Insurance Exchange covering collision on the police
cers was presented. It was moved by Commissioner Healy, seconded by Commissioner Erwin, that the
policy be approved and accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner He&y; those voting No, none.
Bond of Director of Finance Shadoan
The bond of Lawrence G. Shadoan, Director of Finance, in the amount of $60,000.00 for a one- I
year period beginning April 28, 1954 was presented. The bond was approved as to form by the City
Attorney. It was moved by Commissioner Erwin, seconded by Corrnnissioner Healy, that the bond be
approved and accepted and the motion was carried by the following Aye and No vote; those voting Aye
being Mayor Lowe, Commissioner ErWin and Commissioner Healy; those voting No, none.
Payment of Claim of Joselh Gary Deferred
The claim of Joseph B. Gary for $150.00 for legal services rendered in July, 1953 in connection
wi th recovery of assets of Donald L. Henry in San Francisco, California when Mr. Gary as Deputy
County Attorney and Sheriff C. E. Rice went to San Francisco to return D. L. Henry to Bozeman follow-
ing his apprehension by the F'. B. I. This claim was presented without recommendation for payment by
the City Manager. It was moved by Commissioner Erwin, seconded by Commissioner Healy, that action
on this claim be deferred pending further investigation as to whe~~er or not it is a true and lawful
claim against tile City and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Lowe, Commissioner Erwin and Commissioner Healy; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against The City of Bozeman and recommends that warrants be drawn for their payment. After examination
of the claims in detail by the City Commission and checking with the Claim Register, it was moved by
Commissioner E~in, seconded by Commissioner Healy, that the claims be approved and warrants drawn for
their payment, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Erwin and Commissioner Healy; those vo ting No, none.
Committee Rez One-Way Alley in Block A, Story's Addition
Dave Vaughan, Frank Brown, H. C. Young, Robert Dye, J. A. Dixon, Don Hamilton and Eugene Graf, I
representing businesses in Block A, Story's Addition, were present and urged the establishment of a
one-way alley in this block as requested in a petition previously filed.
,!'hose present were infonned of form.er discussions by the City Commission on this subject and
also of difficulties encountered in detennining the direction of travel and other questions relative
to traffic in alleys.
After further di scussion, it was recommended that this delegation get together with truckers,
the City Manager and Chief' of' F'olice, and other interested persons, reach an agreement on what

is wanted, and present detailed and definite recommendations on just what traffic regulations
should be established and enforced in the alley in question.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Healy, seconded by Commissioner Erwin, that the meeting adjourn and the motion was
