HomeMy WebLinkAbout1953-09-26 274 Bozeman, Montana August 26, 1953 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall building, Wednesday afternoon, August 26, 1953 at 1 :00 a' clock P. M. Present Were Mayor Secor, Conmissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Co:nmissioner Lowe, that the minutes be approved as read, and the motion was carried by the fol1ow- ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Communication from Long Construction Co. Re: Gradation Control A communication from the Long Construction Company, contractor for the construction of Special Improvement Districts No. 371 and 372 was read, stating they will provide storage bins and suitable screening device on their present equipment for the gradation of material after it comes from the drier, and chat by such installation, their equipment to be used on these improvements will meet the speci fications. Bond & Contract of Long Construction Co., Re: S. I. D. 371 The bond and contract of the Long Construction Company for the construction of Special Improvement District No. 371, paving on South Third Avenue from Garfield to Lincoln Street were presented. The bond and contract Were approved as to form by the City Attorney. It was moved by Corrumissioner Lowe, seconded by Commissioner Erwin, that the bond and contract be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Bond & Contract of Long Construction Co., Re: S. I. D. No. 372 The bond and contract of the Long Construction Company for the construction of Special Improvement District No. 372, paving on South Fifth Avenue from Garfield to Lincoln Street were presented. The bond and c antract were approved as to form by the City Attorney. It was moved by Commiss ioner Lowe, seconded by Commissioner Erwin, that the bond and contract be accepted and approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Resolution No. 744 -- Designating Depository Banks A resolution designating the banks in Bozeman as depository banks for City of Bozeman funds, and naming city officials who are authorized to sign checks against the account was read. Resolution No. 744 was presented, entitled: A RESOLUTION OF TEE CITY COMMISSION OF' THE CITY OF' BOZEMAN, MONTANA, DESIGNATING DEPOSITORY BlINKS FOR FUNDS OF' THE SAID CITY OF BOZJilvWJ AND DESIGNATING nOSE EMPLOYEES AND/OR OFFICERS OF l'RE SAID CITY 01" BOZEMAN AUTHORIZED TO SIGN CHECKS AND DRAJ1'S AGAINST SUCH FUNDS. It was moved by COlmIlissioner Lowe, seconded by Commissioner Erwin, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Bond Sale for Bonds of S. I. D. No. 371 & 372 It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Clerk of the Commission be authorized to advertise for the sale of Special Improvement District No. 371 bonds in the approximate amount of $27,000.00 and Special Improvement District No. 3'12 bonds in the ap}-1roximate amount of $26,000.00, bids to be opened September 23, 1953, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Final Adoption of Ordinance No. 771 -- Appropriation Ordinance The Manager stated this was the time and place set for the final passage and adoption of the I I I Appropriation Ordinance for the fiscal year ending June 30, 1954. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Ordinance be finally passed and adopted and the motion was carried by the following Aye and No vote: those I voting Aye being Mayor Secor, COlmnissioner Lowe, Commissioner Erwin; those voting No, none. Resolution No. 748 -- Creating S. I. D. No. 370 The Manager stated that the City Attorney as instructed has prepared the resolution creating Special Improvement District No. 370, sanitary sewer on South Church Avenue from Story Street, south approximately 400 feet. He presented Resolution No. 748, entitled: A RESOLUTION Olt' THE CITY COMMISSION OF THE CITY Of' BOZmAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOW!i; AlW DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 370 F'OR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SAN ITARY SEWER IN SOUTH CHURCH AVENUE FROM STORY STREET SOUTH FOR A DISTANCE OJ.' AYPROXIMATELY FOUR HUNDRED (400) FEET. AND TO SPECIALLY ASSESS THE COST OF' SUCH CONSTRUCTION AND INSTM..LATION AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF' SAID SPECIAL IMPROVEMENT DISTRICT SO CREATED ON A FRONT FOOT BASIS, PURSUANT TO TH~ STATUTES IN SUCH CASES MADE .!IND JROVIDED AND PURSUANT TO AND IN CONFORMITY WITH COMtJISSION RESOLUTION NTJMBER 733 Of. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the resolution be passed and adopted and September 9th, 1953 be set as the date for the opening of bids, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Zoning -- Royal Vista Addition as nAif Residence District I The Manager reported that the Board of Adjustment at their meeting of August 24, 1953 approved the re-zoning of the Royal Vista Addition as an itA" Residence District. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Attorney include this chance in the revision of the Zoning Ordinance, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those votinr; No, none. Results of Frimary Nominating Election The certificate of the Clerk of the City Commission showing the results of the Primary Nominat- ing Election was presented as follows: Joe Buckmaster 142 votes J. Harry Healy - 269 votes Charles N. Caughlen - 98 votes Vllm. c. Nickel 45 votes Chris A. Haeckel - 201 votes Donald Henry 1 vote After Checking the results wi th the poll books and tally books of the judges and clerks of election and the results found to be as above stated, the certificate was ordered filed. Reports The following reports were presented: Cemetery Board for the month of' July, 1953 Water Collector for the month of August, 1953 Annual Report of the Recreation Director I It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed &Id the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Appointment -- Goodson to Adjustment Board Mayor Secor announced the appointment of Frank Goodson to fill the unexpired term of Vi'. H. Lovelace as a member of the Board of Adjustment.
