Wednesday afternoon. September 9. 1953 at 1:00 o'clock P. M. Present were Mayor Secor. Commissioner Lowe. Commissioner Erwin. City Manager Henderson. City Attorney Lovelace and the Clerk when the following proceedings were had: I Minutes of tile last regular session were read. and it was moved by Cormnissioner Erwin. seconded by Commissioner Lowe. that the minutes be approved as read. and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none. Bids for S. I. D. No. 370 The Manager stated this was the time and place set for the opening of bids for the construction of Special Improvement District No. 370. sanitary sewer on South Church Avenue from Story Street approximately 400 feet south. He presented the affidavit of publication of the Notice to Bidders. It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that t}~ bids be opened and read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Corrmissioner Lowe. Commissioner Erwin; those voting No, none. The following bids were opened and read: Allen Edens Standard Construction Co. Haggerty-Messmer Company T. G. Taylor $1, 816.50 l.452.95 2,101.25 2.195.60 It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the bids be referred to the City Engineer for tabulation and checking, and the motion was carried by the following Aye and No I vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none. The City Engineer, after checking the bids. stated they were as above listed. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the contract be awarded to the Standard Con- struction Company. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe, Commissioner Erwin; those voting No, none. Final Passage Resolution No. 745 -- Parking Maintenance The Manager stated this was the time and place set for the hearing of protests to the final adoption of the resolution levying the assessment for the maintenance of parkings for the year 1953. He presented the affidavit of publication of the Notice and stated that no protests have been filed and no one is present to protest. He presented Resolution No. 745. entitled: A RESOLUTION OF THE COMMISSION OF THE CITY Ot' BOZEMAN. LEVYING AND ASSESSING A SFECIPL ASSESS- MENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF' BOZEMAN. COUNTY OF GALLATIN. STATE OF MONTANA. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being I Mayor Secor. Final Passage Resolution No. 746 -- Lighting Assessment The Manager stated this was the time and place set for the hearing of protests to the final adoption of the resolution levying the assessment for lighting maintenance for the year 1953. He presented the affidavit of publication of the Notice and stated that no protests have been filed and no one is present to protest. M. 1947. 280 It was moved by Commissioner Erwin. seconded by Corr~issioner Lowe. that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Secor. Final Fassage Resolution No. 747 -- Sprinkling Assessment The Manager stated this was the time and place set for the hearing of protests to the final adoption of the resolution levying the assessment for street sprinkling for the year 1953. He presented the affidavit of publication of the Notice. and stated that no protests have been filed. and no one is present to protest. He presented Resolution No. 747, entitled: A RESOLUTION OF THE COlviMISSION OF' THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON ALL THE PROFERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN. COUNTY OF GALLATIN. STATE OF' MONTANA. TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SF-RINKLING STREETS WlTHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FUR THE YEAR 1953. It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being; Mayor Secor. Contract for Sidewalk Installation for 1953 The Manager stated that due to the lateness of the season and in order to expedite the installa- tion of sidewalk where official notice has beeL given to make new installation or repair. it would be possible to get estimates from contractors and have the work done by the contractor with the lowest estimate. It was moved by Commissioner Lowe. seconded by Commissioner Er'Win. that the City Manager be authorized to hire a contractor to make the installation or repair of sidewalk where official notice has been given and tIle work has not been done. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Er'Win; those voting; No. none. Gas & Plumbing Continuation Certificates for McCay Hardware The continuation certificates for the Gas Fitter's Bond and the Plumbing Bond of K. J. Stimson I of McCay Hardware were presented. The certificates were approved as to form by the City Attorney. Service Station 1215 East Main Street A proposal to construct a service station with overhead storage tanks for gasoline at 1215 East Main Street was considered. No objections were raised to the proposed construction as it does not conflict wi th existing ordinances. Misc. Reports The Follovd.ng reports for the month of August, 1953 were presented: Sanitary Inspector Cashier Fire Chief folice Chief and the report of the Director of Finance for the month of July, 1953. It was moved by COMllissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Sewer for Hugo Eck -- South of Langohr's Addition A written request from Hugo Eck to connect with the sanitary sewer being installed in the alley west of Langohr's First Addition was read. The City Attorney reported that the easement for water line for the City of Bozeman provides that the owner will have the privilege of making sewer connections I on Black Avenue, Tracy Avenue or Willson Avenue sewers. After consideration, it was thought that Mr. Eck should be permitted to connect with this sanitary sewer under the following conditions: 1. That thG installation of the sewer from Mr. Eck's residence to the manhole in the alley will be a private sewer and will be made entirely at his exp ense. 2. That any maintenance of this private sewer will be at his expense. 3. That Mr. Eck will pay monthly sewer service charge at the same rate as houses wi tLin the city. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. that Mr. Eck be permitted to connect with said sewer, and the City Attorney be instructed to preFars an agreement with Mr. Eck covering the above conditions, and the motion was carried by the following Aye and No vote: those 282 voting Aye being Mayor Secor, Conunissioner Lowe. Commissioner Erwin; those voting No. none. Conunissioner Lowe asked to be excused and rermission was granted. Petition for One Way Alley A petition of property owners and lessees in Block A. Story's Addition, was presented and read requesting that the alley between Tracy and Willson Avenue in this block be made a one-way alley. travel to be from west to east. Action was deferred on this petition pending further study of one- way alleys botl, on the north end south Gidos of lillain Street and also any recommendations from the State Highway Traffic Survey. Purchase of Uniforms for folice Department It was moved by Commissioner Erwin. seconded by Mayor Secor. that the City Manager be autr.orized to purchase uniforms anCi ur.iform items for the rolice Department in the apFroximate amount of $700.00, and the mot ion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. After examina- tion of the claims in detail by the City Commission and checking the claims egainst the Claim Register. it was moved by Commissioner Erwin. seconded by Mayor Secor. that the claims be all-roved and warrents drawn for their payment. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor.
