The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
building, Wednesday afternoon, October 7, 1953 at 1:00 o'clock F. M. Fresent were Mayor Secor,
COHunissioner Lowe, Commissioner Erwin, City Manager Henderson and the Clerk when the following pro-
ceedings were had:
Minutes of the last regular session were read, and it was moved by Commissi oner Lowe, seconded
by Commissioner Erwin, tha t the minutes be aT-proved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those
voting No, none.
Fla tting of Land -- Third & Durston Road
I~. E. Spieth and Don Spieth were present and presented a I-roposed ple t of a tract of ground
264 X 165 at the southwest corner of Third Avenue and Durston Road. After examination of the }-la t by
the Commiss ion, Messers S1-ieth were infonned tLa t, if a platting is made as I-,rol-'osed, it will be
aPfroved by the City Commission.
Petition for Stop Street at Lamme & Grand
Mrs. La rry Binder and Mrs. Harry Richter apI-eared before the Commission and Iresented a Feti tion
requesting that a Stop be established at the corner of Grand Avenue and Lamme Street. They stated tllere
has been several accidents at this intersection, the most recent accident being quite serious; that
visibility is poor at this intersection and many children live in this vicinity. They also stated that
traffic is heavy on North Grand because of the many public activities in the north part of the City.
These ladies were informed that all intersections present a traffic problem and tlwt the accident
reports of the I'olice Depa rtment will be cheeked to determine the number at this intersection. and that
action \'/i11 be deferred on the matter until further inv8stigation car be made.
Flatting by Hugo Eck -- Land south of Langohr' s Addition
Mr. HUbO Eck appeared before the Cornrnis~;j on to inquire regardiq; weter service for his 1'1'operL;1'
south of Langohr's Addi ti on. He was again infonned that the City of Bozeman has fulfilled its obligu-
tion in t;l,e easement agreement and the most satisfactory way to get ci ty water would be to plat his
propert); as an addi tiou to the City. Mr. Eck stated he would prepare such 8. I,lat, but to assure a
water service at the earliest possible date, the Commission stated they would accert a written statement
stating that his propcrt~{ would be platted as an adcliUon to the City within a reasonable time, aIld then
a water service could be laid to serve his re~idence.
Bond
A. W. Coleman -- Gas & Plumbing Inspector
The Eond of Archie W. Coleman as Gas & Plumbing Inspector and Assistar.t Building Inspector in the
amount of $1,000.00 was presented. It was moved by Commissioner Lowe, seconded by Corr~issioner l~rwin,
that the bond be all~roved ar.d accepted subject to the apl:roval of the bond by the City Attorney. and the
motion was carried by the following Aye and No vote: those voting Aye beir.;; Mayor Secor, Commissioner Lowe,
Corrunissioner Erwin; tLose voting No, none.
Gas Heat for Boy Scout Cabin
It was decided that gas heat for the Boy Scout GabirJ be permitted provi.ding installation is made
at U;e eXl ense of Scout Troops using the building and that they IJay for the gas consumed.
Ci ty I S Contribution to Hospi tel-Medical Insurance
It was rerorted that it is the desire of the majorit;y of city employees to carry hospital-medical
insuranc'9 with the Mor,tana Physicians' Service. It was moved by Commissioner Lowe, seconded by
GOlTUllissioner Erwin, the_t the city pay *1.00 per month on the monthly premium for each emI-loyee who takes
this c()VeraE8, and the motion was cerried by the following Aye arld No vote. those voting; Aye being Mayor

The Manager stated he has audited these claims and finds them to ,.e true and lawful claims against
The City of Bozeman and recommends that warrants be drawn for their pe,yment. After examination of the
e1eims in detail and checking against the Claim Register by the City Commission. it was moved by
Commissioner Erwin, seconded by Commissioner Lowe, that the cla ims be approved and warrants drawn for
their payment. and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
Resolution No. 749 -- Garbage Assessment
The resolution levying the Assessment for the collection and disposition of garbage for the year
1953 in the amount of $27.764.62 was presented, entitled:

Recovery in Henry Case - Manager to Deer Lodge
The Manager reported that a cbeck made payable to Donald L. Henry for a refund on his payments
to the Publio Employees Retirement System has been received, and that D. L. Henry has requested that a
watch and camera given to him by his mother be returned to him. It was moved by Commissioner Lowe,
seconded by Commissioner Erwin, that the City Manager be authorized to go to Deer Lodge to get an
endorsement on the check. and he also be authorized to return the watch and the camera, if the camera
is received by the City from the New York FBI, to D. L. Henry. and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin;
those voting No, none.
Sale of Henry's Personal Property
It was moved by Commissioner Lowe. seconded by Commiss ioner Erwin, that the City Manager be

authorized to arrange for an auction sale at the earliest possible date to dispose of the personal
property of D. L. Henry, and that bids may be taken on individual items prior to the auction, and the
motion was carried by the following Aye and No vote: tilose voting Aye being Mayor Secor, Commissioner
Lowe. Commissioner Erwin; those voting No, none.

It was moved by Commissioner Erwin, seoonded by Commissioner Lowe. that the City Manager be
authorized to make a settlement of :jj.l,200.00 with John French, Jr. for the equity that D. L. Henry has
in a DeSoto car sold to him. and the 1Il0tioIl was carried by the following; Aye and No vote: those voting
Aye being; Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
Tag Day -- Women of the Moose
The Commission stated they have no objection to the Women of the Moose Lodge having a Tag Day
sele on Saturday, October, 17th, 1953.

It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the rerorts be accepted

Report of State Examiner
The rel,ort of the State Examiner for the year eno.ing; June 30th, 1953 was presented to the
Commission for study. The comments and recommendations in the report will be discussed at the next
regular meeting.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Corr~issioner Erwin, that the meeting adjourn, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe,
