The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
building, Wednesday afternoon, October 14, 1963 at 1100 o'clock P. M. Present were Commissioner
Lowe, Commissioner Erwin, City Manager Henderson and the Clerk when the following proceedings were had:
Minutes of the last regular aeasion were read, and it was moved by Commissioner Erwin, seoonded
by Commissioner Lowe, that the minutes be approved as read, and the motion was oarried by the follow-
ing Aye and No vote: those voting Aye being Co.-lssioner Lowe, Commi.sioner Erwin; those voting No,
none.
Commissioner Lowe Chosen President Pro Tempore
In the absenoe of Mayor Seoor, it was moved by Commissioner Erwin, seconded by Commissioner Lowe,
that Corruniasioner Lowe be chosen President Pro Tempore and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Lowe, Commissioner Erwin; those voting No, none.
Protest to Closing Slaughter House Road
Mrs. Lillian Gardiner Young was present to again request that the road known aa the "Slaughter
House" road, which was olosed in 1942 on request of and by agreement with the Northern Pacific Railway
Co., be re-opened. She was informed that the status regarding this road has not changed and that her
only recourse would be to file a suit and have the court deoide whether or not this road should be
re-opened.
Sale of S. I. D. 370 Bonds
The Manager stated this was the time and place set for reoeiving bids for the sale of the bonds
of Special Improvement District No. 370 bonds, in the approximate amount of tl,700.00. He presented
the affidavit of publication of the Notice to Bidders. It was moved by Commissioner Erwin, seconded
by Commissioner Lowe, that the bids be opened and read, and the motion was oarried by the following
Aye and No vote: those voting Aye being Commissioner Lowe. Commissioner Erwin; those voting No, none.
No written bids having been filed, the President Pro Tempore stated that oral bids would be
received. The following oral bids were heard:

Security Bank & Trust Co. par interest
F. E. Herrett par 5% interest
Seourity Bank & Trust Co. par 4-7/8% interest
F. E. Berrett par ~~~ interest

No further bids being heard, it was moved by Commissioner Erwin, seoonded by Commissioner Lowe,
that the bid of the Security Bank & Trust Company of par and ~ interest for the bonds of S. I. D.
No. 370 being the best bid be acoepted. and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Lowe, Commissioner Erwin; those voting No, none.
Platting of Eck's Addition
A written proposal was presented from Hugo and Dorothy N. Eck in which they state that they will
prepare the necessary plat and petition to bring their property, adjoining the city limits at the
south end of Langohr's Addition, into the City by January 1, 1964.
It was moved by Commissioner Lowe. seconded by Commissioner Erwin that, in view of this proposal,
a water oonneotion be authorized from the water main on Garfield Street to serve the property of Mr.
Eck, and the motion was carried by the following Aye and No vote, those voting Aye being Commissioner
Lowe, Commissioner Erwin; those voting No, none.
Investigation of Traffic Accidents -- Lamme and Grand
Investigation of the traffic accident record at the corner of Grand and Lamme Street shows that
three accidents occurred at this intersection last year, and two aocidents so far this year.
After consideration by the Commission, the City Manager was instructed to order "Bad Corner"

warning signs to be placed at this intersection and also at the intersection at Tracy and Peach
Street as a tempora~ measure awaiting the recommendations of the traffic survey by the State
Highway Department.
One-Way Alleys
Discussion was had regarding the recommendations of the Chief of Police for a one-way alley

south of Main Street from Willson Avenue to Bozeman Avenue. travel to be in a westerly direction and
for a one-way alley north of Main Street from Grand Avenue to Bozeman Avenue. travel to be in an
easterly direction. No action was taken pending a report from the State Highway Department regarding
the traffic survey made by them.
Final Adoption Resolution No. 749
Garbage Assessment
The Manager stated this was the time and place set for the hearing of protests to the final
adoption of the resolution levying the assessment for the collection of garbage for the year 1953.
He presented the affidavit of publication of the Notice. and stated that no protests have been filed.
and no one is present to protest. He presented Resolution No. 749. entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN. MONTANA. LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES uPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN. COUNTY OF GALLATIN,
STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR
1953, TO DEFRAY THE COST AND EXPENSE OF COLLECTING .A1rrJ DISPOSING OF GARBAGE UNDER THE PRO-
VISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZE2lAN.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be
finally passed and adopted and the motion was carried by the following Aye and No vote: those voting
Aye being Commdssioner Lowe. Commissioner Erwin; those voting No. none.
Resolution No. 750 -- Weed Assessment

The Manager stated the resolution levying the assessment for <<utting of weeds during the year
1953 in the amount of $102.14, has been prepared. He presented Resolution No. 750, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN. COUNTY OF GALLATIN.
STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR
THE YEAR 1953 PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 428 ENTITLEDI ",AN ORDINANCE
DEFINING AND pmVIDING FOR THE PUNISHMImT AND ABATEMENT OF CERTAIN NUISANCES."
It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the resolution be
provisionally adopted. and Ootober 21st, 1963 be set as the date for the hearing of protests. and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe,
Commissioner Erwin: those voting No. none.
Resolution No. 751 -- ABsessment for S. I. D. 367
The Manager stated the Resolution leYJing the assessment for the construotion of Special Improvement
District No. 367. water main on North Seventh Avenue from Durston Road to the north City Limits in the
amount of $15.163.55 has been prepared. Resolution No. 751 was presented, entitled:

It was moved by Commissioner Lowe. seoonded by Commissioner Erwin, that the resolution be
provisionally adopted and Ootober 21st, 1953 be set as the date for hearing protests. and the
motion was carried by the following Aye and No votel those voting Aye being Commissioner Lowe.

State Examiner's Report Reviewed
The report of the State Examiner for the period ending July 16th. 1953 was reviewed and the
recommendations and comments in it were discussed in detail. The City Commdsslon was informed what
is being done to comply with these reooDlD.endations.

It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the reports be accepted

There being no further business to come before the Commission at this time, it was moved by
