The Commission of the City of Bozeman met in regular session in the Commission Room6 City Hall
building6 Wednesday afternoon, December 26 1953 at 1:00 o'clock P. M. Present were Mayor Secor6
Commissioner Lowe6 Commissioner Erwin6 City Manager Henderson6 City Attorney Lovelace and the Clerk
when the following proceedings were had:

Re: Completion of Traffic Survey
Conununication
A communication from the State Highway Commission was read6 stating that the preliminary report
regarding the traffic survey in Bozeman made during the summer of 1953 will be submitted to the Bureau
of Public Roads about March 16 19546 but that6 if the City has some speci& problems on which they
would like information6 it might be possible to get this information before that time.
It was decided that a letter should be written requesting recommendations on one-way alleys and a
traffic control light for Seventh Avenue and Main Street.

Resolution No. 753 -- Certifying Delinquent Taxes for 1953
The resolution certifying the delinquent city special assessments for the year 1953 in the amount
of $5,304.16, to the County Treasurer and the County Clerk and Recorder was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING CERTAIN SFECIAL ASSESSMENTS
AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND PAYABLE NOVEMBER 30TH 1953, AND UNPAID AS
OF THAT DATE, AND CERTAIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF SFECIAL ASSESSMENTS,
DUE AND PAYABLE NOVEMBER 30TH 19536 AND UNPAID, DELINQUENT, AS PROVIDED BY ORDINANCE NO. 594,

It was moved by Commissioner Erwin, seconded by Lowe, that the reports be accepted and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Secor, Commissioner Lowe, Commissioner Erwinj those voting No, none.
Sewer Charge for 803 North Wallace
Attention was called to the fact that it has now been determined that Rusoh's Cold Storage Plant,
803 North Wallace, has never been connected to the sanitary sewer system but that the sewer for this
plant dumps directly into Bozeman Creek at Tamarack Street and that a sewer service charge has been
paid at this address since May, 1948. After consideration, the City Manager was authorized to make
a settlement by refunding up to 50% of the sewer charge which has been paid on the condition that this
property is connected to the sanitary sewer at once.
Covering Irrigation Ditch at Eighth Avenue and Beall Street
The request of J. Kolokotrones to have the city cover the irrigation ditch that crosses North
Eighth Avenue between Beall Street and Villard Street was considered. It was decided that the Con-
struction cost of covering this ditch would not be a maintenance cost for city streets, and it was
moved by Commissioner Lowe, seconded by Commissioner Erwin, that the request be denied, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Comnlissioner Lowe,
Commissioner Erwinj those voting No, none.

The Manager stated he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examina-
tion of the claims in detail and checking against the Claim Register, it was moved by Commissioner
Erwin, seconded by Commissioner Lowe, that the claims be approved and warrants drawn for their pay-
ment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Secor, Commissioner Lowe, Commissioner Erwinj those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe,
Commissioner Erwinj those voting No, none.
