HomeMy WebLinkAbout1953-12-09 Bozeman, Montana December 9, 1953 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall building, Wednesday afternoon, December 9, 1953 at 1:00 o'clock P. M. Present were Mayor Secor, Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk when the following prooeedings were had: I Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Appointment of Mrs. Haggerty to Library Board Mayor Secor announced the appointment of Mrs. T. G. Haggerty to fill the unexpired term of Mrs. Edna T. White as a member of the Library Board, and as a regular member of that Board for the term ending January 1, 1956.. It was moved by Conunissioner Erwin, seconded by Commissioner Lowe, the t the appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. "No Left-Turn" SiE;ns on Main Street Advisabili ty of changing the design and location of "No Left Turn" signs now being used at certain intersections on Main Street was discussed. No action was taken. ~uotations on Blanket Bond for City Employees The City Manager presented quotations which he has received from G. C. Waite, representing the Bozeman Insurance Association, on premiums on various types of "Blanket Bonds" to cover city employees. I The quotations excluded coverage for the Director of Finance, for the Mayor and City Commissioners and did not state whether or not assistants to the Director of Finance would be excluded. A particular point on Which the City had hoped to receive some advice or recommendations from Bonding Companies was as to what might be considered a reasonable or average amount of bond to require for the various positions of city employees. The Manager stated that Mr. Waite informed him that neither he, as an agent, nor bonding companies woul d make reconunendations as to the amount of bond to be carried. From this inforIIB tion, the advantages which might be gained from carrying a "Blanket Bond" would be limited and it will still be the full responsibility of the City Commission to fix, within the limits set by state law, the positions of' city employees to be oovered by bonds and the amount of suoh bonds. Action in this matter was deferred pending further study. Frogramming for Improvement of South Eighth Avenue "& Other Streets The Manager reforted on a Chmnber of Commerce meeting held on Deoember 8, 1953 where Soott Hart, State Highway Engineer, and other State Highway and U. S. Bureau of Public Roads officials outlined a five year plan for construction and reconstruction of roads on the primary, secondary and urban systems of Federal aid highways in Gallatin County. A conference was held with City Engineer Waldorf, the City Manager and Mr. Hart on December 9th at which plans and possibilities for street construotion or I reconstruction in Bozeman were discussed. These included plans for So. Eighth Avenue, North Rouse Avenue, a truck route through this city, and North Seventh Avenue. At the suggestion of Mr. Hart and by direction of the City Commission the City Manager is to write to the State Highway Department in an attempt to secure specific written information on the status and possibilities on each of these four projeots. Status of Henry Case Recoveries in cash to date on the D. L. .Henry embezzlement are $62,346.85 leaving a net shortage of $19,706.06. aU7 3US The City Attorney reported that he has obtained a promissory note for $1~200.00 from Jack F'rench~ Jr. which note is secured by a chattle mortgage on the 1952 DeSoto sold to French by D. L. Henry. The net shortage cited above is therefore reduced by this $1~200.00. The City Attorney also read correspondence from James E. Ludlam~ the attorney in Los Angeles who is representing the City of Bozeman in the matter of securing a refund on the $2,000.00 cash deposit made by D. L. Henry on a car which he ordered from the Muntz car agency. This firm offers $500.00 in settlement of the claim. The City Commission considered this an unreasonable offer. They instructed the City Attorney to make a last attempt, through the Los Angeles attorney, to secure a fair settlement but, if that cannot be done without further delay. to have suit filed against the car agency for recovery of the full $2.000.00. A letter, dated December 7. 1953. from the Commercial National Bank~ Bozeman. was read wherein this bank refuses to make payment for the $6..600.00 check as described and for which payment was demanded in a letter to the bank from L. G. Shadoan, Director of }'inance, on July 18, 1953. The City Attorney was instructed to prepare a memorandum on this matter from which the City Commission can decide whether or not to take further action against the Commercial National Bank. A letter from Percy Wylie II, Special Agent. F. B. I., Butte, was read in which it was stated the. t a camera was noted in the effects of D. L. Henry at his apartment.. 605 E. B2nd Street. by Agents of the New York Office.. F. B. I. and was not removed by them. Henry has made a statement that there was supposed to be a pair of binoculars, two cameras, and miscellaneous photographic equipment in a carrying case in this apartment. The City Attorney was instructed to contact Cahill, Gordon, Zachry and Reindel.. the attorneys who handled the D. L. Henry case in New York for the City of Bozeman and attempt to locate and recover this equipment. Reports The following reports for the month of Novem.ber~ 1953 were presented: Police Chief Fire Chief Sewage Plant Operator and the report of the Director of Finance for the month of September. 1953. It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin; those voting No, none. Claims Claims Nos. 8329 to 8368 inclusive were presented on the various funds as follows: Cemetery Garbage General Library Park Parking Meter SDS Revenue Street W-H Tax Water $ 42.99 92.76 335.94 109.51 93.25 54.75 212.25 295.14 2..343.70 424.24 Tot a 1 - - $4.004.53 The Manager stated he has audited these claims and finds them to be true and lawful claims against The City of Bozeman and recommends that warrants be drawn for the ir payment. After examination of the claims in detail by the City Commission and checking against the Claim Register, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the claims be approved and warrants drawn for their payment~ and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Adjournment There being no further business to come before the Commission at this time. it was moved by I I I Commissioner Erwin, seconded by Commissioner Lowe, that the meeting adjourn, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
