The Connnission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Wednesday afternoon, December 29th, 1953, at 1:00 o'clock P.M. Present
were Mayor Secor, Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City
Attorney Lovelace and the Clerk, when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Lowe,

seconded by Commissioner Erwin that the minutes be approved as read, and the motion was

Communication -- Nat'l Safety Council - Re: Right Turn on Red Signal
A communication from the National Safety Council was read answering the City's in-
quiry regarding making a right turn on a red Signal. The letter stated thft, while
some cities do permit "right turns on a red light", it is not considered good practice
and should never be permitted unless there ere special control devices such as a sep-
arate green signal light with an arrow to show the permitted turn or a special traffic
lane for right turning traffic with a dividing or safety island.
Application for Beer & Liquor Lie en"e
The following applications for city beer and liquor licenses were presented:

It was moved by Commissioner Erwin, seconded by Commissioner Lowe that subject to
proper and acceptable signatures being furnished on the application of the Rocking R
Bar, the applications be and are hereby approved, and the motion was carried.
Water & Sewer Connection for State Fish & Game Buildings Outside City Limits
Verbal information has been received from Gene Sherman, District Game Warden, that
the Fish and Game Department of Montana has taken an option on approximately ten Beres
of ground fronting on North Seventh Avenue (projected) and situated approximately 800
feet north from the city limits. Mr. Sherman states that tentative planning is under
way for construction of a Fish & Game Department District Headquarters on this property
and he has made inquiry as to whether or not the Ctty would permit city water and sewer
facilities to be extended to the property. In disucssion of the matter, it was pointed
out that it is normal policy of this city not to extend or pe~nit use of its water and
sewer facilities outside the city limits but this would be a case of more than ordinary
public benefit and that a deviation from normal policy could well be made. The City
Manager was instructed to advise Mr. Sherman informally that, if a written application
for the proposed water and sewer connections, showing that they would be made without
expense to the City of Bozeman, is presented, it will be given favorable consideration.
Discussion on Proposed One-Way Alleys

Lester Gee, George Sikonia and Charles Proffit, representing local truckers, K. W.
Skeen representing the Montana Power Company and Chief of Police Haas were present to
discuss the proposal to establish one-way alleys in certain blocks in the Main Business
District. These gentlemen all spoke in favor of one-way alleys but brought up numerous
problems on loading or unloading at specific business locations. They all spoke in
favor of prohibiting the use of alleys for parking except to load and unload. In view
of the numerous points brought out in this discussion, it was decided to defer action
on one-way alleys until the matter can be given further stujy.
Credit for Water Service for Business Properties
I Reference is made to Special Rules and Regulations - Rule E-2 as amended November
27, 1939 - of the Public Service Commission of Montuna for the Water Department of the
Ci ty of Bo zeman. Under that rule, an owner for whom a new water service is installed
is required to make a deposit to cover installation cost. This deposit is in effect a
payment in advance for water to be used through the service. From a search of the records
it appears that, beginning from and since 1942, this has been construed to apply to
residence properties and not to business pro:~rties. No official record has been found
to establish this as a rule or policy of the water department. After full consideration
it was moved by CommissionerErwin, seconded by Commissioner Lowe, that rule E-2 of Public
Service Commission regulations shall apply to all new water services installed from and
after January 1, 1953 and that, where services installed are larger than the normal 3/4
inch residential service, credit shall be allowed the owner on the basis of a normal
3/4 inch service only and the motion was carried by the fallowing Aye and No vote; those

Objection to Closing Ha.yes Street
A communicati~n was read from Mrs. Herold Murdock stating she is opposed to the
closing of Hayes street.

Action on Check Paid by Commercial National Bank on Unauthorized Signature
The City Attorney presented a memorandum to the City Commission regarding check No.
12003 in the amount of $6,600.00 which had been paid by the Commercial National Bank on
an authorized signature.
After discussion, it was moved by C01missioner Lowe, seconded by Commissioner Erwin
that the City Attorney be instructed to prepare a written demand on the Commercial National
Bank, for the signatures of the Mayor and the Clerk of the City Commission for payment
to be made on this check and informing said bank that, unless payment is made on this
demand within twenty days, suit will be filed to make recovery on this check and the mo-
tion was carried by the following Aye and No vote; those voting Aye being Mayor Secor,
Commissioner Lowe and Commissioner Erwin; those voting No, none.
Adjournment
