The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
building, Wednesday afternoon, August 12, 1953 at 1:00 o'clock F. M. Present were Mayor Secor,
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Cle rk
when the following proceedings were had:
Minutes of the last regular session of August 5th and of the adjourned session of August 8th
were read, and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes
be approved as read, and the motion was carried by the following Aye and ~o vote: those voting Aye
being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No. none.
Bids for S. T. D. s #371 & #372
Bids for Special Improvement Districts No. 371 and No. 372 were further considered. City Engineer
Waldorf stated that the low bids were as follows:

The City Engineer reported that, from his investigation. he finds that the Long Construction Co.
does not have equipment with which they could produce "Hot Bent Mix" material to fully comply wi th
the specifications and therefore. in his opinion, bid received under Alternate No.3 of the proposal
is not acceptable. He stated further that, in his opinion, bids submitted on ai thar AI ternate No. 1
or No.2 might be accepted but that, if it is desired to have these projects built under Alternate No.3,
"Hot f1ant Mix" surface. it would be necessary to reject all bids and re-advertise for bids.
It was moved by Commissioner Erwin, that the bid of the Standard Construction Company for Travel
Plant Mix (Alternate No.2) be aocepted. There was no second to the motion and the disoussion continued.
Because of the additional oost for a Travel Plant Mix over Road Mix, it was deemed advisable that
the property owners be advised of the types of paving available and the cost and to get an opinion from
them as to the type of paving they are willing to pay for.
It was moved by Commissioner Lowe. seoonded by Commissioner Erwin, that action be deferred for
one week and the property owners in the two districts be notified of a meeting so that their desires as
to type of f6.ving can be known and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
Publio Hearing on Budget 1953-54
The Manager stated this was the time and place set for ~.ublio hearing on the budget for the f1sCEl_l
year ending June 30, 1954. He presented the affidavit of publication of the Notice of Hearing. The
written protest of Mrs. H. C. Good, protesting the additional one mill levy and use it is to be put,
was presented and read.
There being no one present to protest and no other protests having been filed, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the Appropriation Ordinance No. 771 be ordered
published, and August 26. 1953 be set as the date for final adoption, and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin;
those voting No, none.
Permission to Remove Curb -- Church & Main
A request to remove approximately fifteen feet of curb at the Texaco Station at the corner of
Churoh and Main Street on the Church Street side was presented. After examination of the proposed
plan for relocating the gas pumps at this looation, it was moved by Commissioner Erwin, seoonded by
Commissioner Lowe, that permission to remove the curb be granted, and the mocion was carried by the

following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin;
those voting No, none.
Resignation of Lovelace from Adjustment Board
The written resignation of W. H. Lovelace as a member of the Board of Adjustment was read. It
was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the resignation be accepted, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor,
Commissioner Lowe, Cownissioner Erwin; those voting No, none.
Bond for Gas Fitter -- Oliver-Stout Hardware Co.
A continuation certificate for the bond of the Oliver-Stout Hardware Company as a gas fitter was
presented. The bond was approved as to fonn by the City Attorney. It was moved by Commissioner Erwin,
seconded by Commissioner Lowe, that the bond be approved and accepted and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Conmissioner
Erwin. those voting No, none.
Reports
The following reports for the month of July, 1953 were presented:
Building Inspector
Plumbing Inspector
Sanitary Inspector
Sewage Plant Operator
and the annual report of the Fire Chief. It was moved by Commissioner Lowe, seconded by Commissioner
Erwin, that the reports be accepted and ordered filed, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those
voting No, none.
Petition for Paving Arthur Street
A petition of property owners to establish a Special Improvement District to pave Arthur Street
from Willson Avenue to Third Avenue was presented. It was moved by Commissioner Erwin. seconded by
Commissioner Lowe. that the City Engineer be instructed to prepare an estimate of cost and a description
of the proposed district and, based on that preliminary data. the City Attorney be instructed to prepare
a resolution of intention to create this district. and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin. those voting No.
none.

The Manager stated that he has audited these c18 1ms and finds them to be true and lawful claims
against The City of Bozeman and recommends that warrants be drawn for their payment. After examination
of the clallns in detail by the City Commission and checking them against the claim register, it was
moved by Commissioner ErWin. seconded by Commissioner Lowe. that the claims be a~proved and warrants
drawn for their payment, and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none.
