The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon. January 28, 1953 at 1;00 o'olock P. M. Present were Mayor Secor.
Commissioner Lowe, Commissioner Erwin, City Manager Henderson. City Attorney Lovelaoe and the Clerk
when the following proceedings were had:

Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by Mayor Secor. that the minutes be approved as read, and the motion was oarried by the following Aye
and No vote: those voting Aye being Kayor Secor, Commissioner Lowe. Commissioner Erwin; those voting
No, none.
Application for Beer License
The application of T. E. Stump for a wholesale beer license was presented. It was moved by
Comndssioner Erwin, seoonded by Commissioner Lowe, that the application be approved and the license
issued and the motion was oarried by the following Aye and No vote; those voting A'3e being Mayor
Secor, Commissioner Lowe, Commissioner Brw1D; those voting No. none.
Application for Warehouse & Cement Mixing Plant
An informal applioation from the Monarch Lumber Company for a permit to construot a warehouse and
to operate a portable concrete mixing plant on their property located in the Main Business Distriot
at the corner of )(endenhall and Church Avenue was presented end read.
The proposed warehouse raises no question as it would comply with building and zoning regulations
in the Main Business District but question was raised as to whether or not the operation of a ooncrete
mixing plant would be allowable in this distriot. There is no specific definition in ordinances of

this city of what oonstitutes an industry as compared to what constitutes a business. .After discussion.
it was the opinion of the City Commission that a oonorete mixing plant should be classed as an industry
and therefore limited to operation in the Industrial Zone and it was moved by Commissioner Lowe,
seoonded by Commissioner Erwin, that the City Manager be instructed to deny that part of the applica-
tion of the Monarch Lumber Company pertaining to this plant and the motion was oarried by the following
~e and No vote; those voting Aye being Mayor Secor. Commissioner Lowe, Commissioner Erwin; those
voting No, none.
Application for Circus - Shrine Club
An informal written request from the Gallatin Shrine Club for a oity license for the Geld Gray
Shrine Circus for two days during the week ending June 20, 1953 was read. It was moved by Commissioner
Lowe. seoonded by Commissioner Erwin that. upon presentation of the required applioation form and
payment of a license fee at the rate at .100.00 per day, the application be approved and the lioense
issued. and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Secor, Commissioner Lowe, Commissioner Erwin; those voting No. none.
Fetition to Abolish Parking Maintenance District No. 151
A petition from the owners of 69.8% of the property in Parking Maintenance District No. 151.

requesting that this district be disoontinued. was presented and read. This particular district is
for the maintenanoe of the 18 rking on the east side only of Fifth Avenue in the two blooks between
Olive and Kooh streets.
It was moved by Commiesioner Erwin, seoonded by Commissioner Lowe, that the City Attorney be
instructed to prepare the documents neoessary to start the legal prooedure required tor disoontinuin~
this district and the motion was carried by the following ~e and No vote; those voting Aye being
Mayor Secor. Commissioner Lowe and Commi8sianer Erwin; those voting No, none.

American Legion Auxiliary Foppy Day
A written request from the Amerioan Legion Auxiliary to set aside May 23. 1963 as American
Legion Poppy Day was read. Action on this matter was deferred pending a oheck being made to deter-
mine how similar requests had been handled in for.mer years.
Amending State Law -- Annual Audit
The City Commission having disoussed proposed amendment of state law relative to annual audit and
the City Manager having been instruoted to get information from nearby states on this question, telegrams
from League Offioes of other states were read. This information showed that. in the several states
checked, examination and audit of the reoords and aocounts of cities is not made by a State Examiner.
In view of this infonnation. the Commission was of the opinion that this City should not propose or
support legislation in the present session of the Montana State Legislature whioh would ohange present
Montana law relative to audits of cities operating under the Commission-Manager form of government.
Report
The City Manager reported on the meeting of the Executive Committee of the Montana Municipal
League which he attended in Helena on January 28-30, 1953.
Street Improvements on West Part of City
City Engineer Waldorf presented some figures on estimated cost of storm sewers in the west part
of the City. Street improvement and storm sewer costs were disoussed and it was decided to contact
Montana Ste. te Coll ege to see if they will participate in the cost of draining this area. When full
information and estimated cost of such improvements is obtained, it was deoided that a meeting of all
property owners. affected in such an improvement district, should be held at which this infor.mation could
be given to them and they, in turn, could decide whether or not further aotion should be taken toward
establishing an improvement district or distriots for making suoh street improvements.
