The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building. Wednesday afternoon. February 4. 1953 at 1;00 o'clock P. M. Present were Mayor Secor.
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following prooeedings were had;

Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by CoJllDli8lllioner Lowe. that the minutes be approved as read, and the motion was carried by 1ihe-following
Aye and No vote; those voting ~e being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those
voting No. none.
Poppy Day for Legion Auxiliary
A request from the American Legion Auxiliary. presented at the last regular meeting of the
Commission. to have May 23rd. 1953 designated as Poppy Day. was considered. The Manager reported that
similar requests in past years have been approved. It was moved by Commissioner Lowe. seconded by
Commissioner Erwin, that this request to have Kay 23. 1953 designated as American Legion Poppy Day be
approved and the mo~ion was carried by the following Aye and No vote; those voting Aye being Mayor
Secor. Commissioner Lowe, Commissioner Erwin; those voting No. none.
Action Denying Permit to Monarch Lumber Company Rescinded
At the last regular meeting of the Commission, the Manager was instructed to deny the application
of the Monarch Lumber Company to operate a portable conorete mixing plant on their property at Church
and Mendenhall Street. A letter from H. M. Gay, Manager of the Monarch Lumber Company was presented
at this time in which he called attention to Sub-seotion XIII-D of Ordinance No. 711, the Zoning

Ordinance. The contention of this letter was that the operation of the proposed plant is an allowable
use or oocupancy under the present ordinance. Upon further examination of the ordinance, it was
the opinion of the Commission that the contention was correct and it was moved by Commdssioner Lowe.
seconded by Commissioner Erwin. that the action of the Commission taken at their meeting of January
28, 1953. wherein the City Manager was instruoted to deny the application herein referred to, be ani
is hereby rescinded on the grounds that no permit for this operation. if oarried on as incidental to
the present operation of the Monarch Lumber Company, is required and the motion was oarried by the
following Aye and No vote; those voting Aye being Mayor Secor. Commissioner Lowe, Commissioner Erwin;
those voting No, none.
The Manager was instructed to point out to the Monaroh Lumber Company that, if at any time the
operation of this proposed mixing plant proved to be detrimental to the health, welfare or safety
of the public or neighboring properties, it would be subject to abatement as a nuisance.
Resolution No. 732 -- Intention to Abolish S. I. D. No. 151,
The Manager stated the City Attorney. as instruoted. has prepared a resolution of intention to
abandon Speoial Improvement Distriot No. 151 and the care of the parking in said district. which
includes the east side of Fifth Avenue from Olive Street to Koch Street. He presented Resolution No.

STATUTES IN SUCH CASES MADE AND PROVIDED.
It was moved by Commissioner Erwin. seoonded by Commissioner Lowe, that the resolution be passed
and adopted and February 18th, 1953 be set as the date for hearing protests. and the motion was carried
by the following Aye and No vote: those Toting Aye being Mayor Secor. Commiasioner Lowe. Commissioner
Erwin; those voting No. none.

Gas & Plumbing Continuation Certificates
The continuation oertificate of the gas bond and the plumbing bond of J. s. Budd was presented.
The certificate was approved as to form by the City Attorney. whereupon it was moved by Commissioner
Erwin, seoonded by Commissioner Lowe, that the certifioate be approved and aocepted. and the motion
was oarried by the following ~e and No vote: those voting Aye being Mayor Seoor, Commissioner Lowe.
Commissioner Erwin; those voting No, none.
Claims
Claims Nos. 5603 to 5807 inclusive were presented on the various funds as follows;

The Manager stated he has audited these claims and finds them to be true and lawful olatms against
the City of Bozeman and recommends that warrants be drawn for their payment. After examination of the
olaims in detail by the City Commission. it was moved by Commissioner Lowe. seconded by Commissioner
Erwin. that the olaims be approved ani warrants drawn for their payment. and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commiasioner
Erwin; those voting No, none.

It was moved by Comndssioner Erwin. seoonded by Commissioner Lowe, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No. none.
Police Chief to Billings to Have Cycle Overhauled
It was reported that the Police Motoroycle needs to be overhauled and that the nearest cyole
shop is in Billings, Montana. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that
the Police Chief be authorized to take the police oyole to Billings for an overhaul job, and his
expenses be paid from the General Fund, snd th e mati on was carried by the following Aye and No vote;
those voting Aye being :Mayor Seoor, Commissioner Lowe, CommilSioner Erwin; those voting No, none.
West Side Improvements -- Assistance from M. S. C.
The City Engineer and the City Manager reported on a meeting with Montana State College
officials. regarding assistance in financing the cost of a stor.m sewer district in the west part of
the City, whioh would also take care of storm sewer drainage from the oollege oampus. It was reported
that college officials looked with favor on paying a portion of the co st of the storm sewer. _ a
monthly payment basis.

There being no further business to come before the Commission at this time, it was moved by Commis-
sioner Lowe. seoonded by Com.m1uioner Erwin. that the D18eting adjourn, and 'the motion was carried by the
