The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday afternoon. February 18. 1953 at 1:00 o'clock P. M. Present were Mayor Secor.
Commissioner Lowe, Commissioner Erwin. City Manager Henderson. City Attorney Lovelaoe and the C~rk
when the following proceedings were had:

Minutes of the last regular session were read, and it was moved by Commissioner Lowe. seconded
by Commissioner Erwin, that the minutes be approved as read. and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Seoor. Commissioner Lowe. Commi.sioner Erwin; those
voting No. none.
Furchase of Caulking Lead
The Manager stated that. in connection with the installation of water mains on North Seventh
Avenue. the City of Bozeman is to purohase all materials and it will be necessary to purchase caulking
lead in the amount of $577.50. It was moTed by Commissioner Lowe. seconded by Commissioner Erwin.
that the City Manager be authorized to purchase caulking lead in this amount. and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Seoor. Commissioner Lowe. Commissioner
Erwin; those voting No. none.
Furchase of Road Oil
The following resolution authorizing the purchase of 25.000 gallons of road oil from the State
Highway Department was presented and read:
llESOLUTION
I
WHEREAS the City of Bozeman will have need during 1953 for road oils for U$e
in repairing streets and for sealing certain seotions of existing pavement within the
City. and
WEEREAS the City of Bozeman does not have proper facilities for handling and
storing the needed quantities of such oils. and
WHEREAS the Montana State Highway Department does have storage faoilities and
normally does have quantities of the required types of oils stores in Bozeman from which
it can supply the quantities needed by the City of Bozeman.
NOW. THERER>RE. BE IT aBSOLVED:
That an emergenoy does exist relative to the procurement of road oils by the
City of Bozeman and the City Manager is hereby authorized to purchase from the Montana
State Highway Department. from its stocks in storage in Bozeman. approximately twenty
five thousand (25.000) gallons of road oil. this to be purchased from time to time dur-
ing the year. 1953. as needed by the City of Bozeman for repair and sealing of existing
pavements. end these quantities of road oils to be purohased at cost plus normal handling
charges.
Passed and adopted by the City Commission of Bozeman, Mantana. at a regular
meeting of said Commission held on the 18th day of February, 1953.

Use of Steam Cleaning Equipment of State Highway
The following resolution authorizing the Ci~ of Bozeman to contract from time to time for
the use of the steam cleaning equipment of the State Highway Department was presented and read:

WHEREAS the City of Bozeman owns and operates equipment. including Toad graders.
truoks and other machines. for maintenanoe of its streets. water utility. and other city
governmental funotions. md
WHEREAS there is need from time to time to steam clean some of this equipment
so that it can be painted or otherwise properly maintained. and
~ the City of Bozeman has no facilities for steam cleaning its equipment.
and
WHEREAS. the Montana State Highway Department does have facilities established
in Bozeman for steam c leaning trucks l!Il d other heavy equipment. and.
WHEREAS the District Maintenanoe Engineer of the Montana State Highway Depar~.Dt
in Bozeman has indioated that it will be possible to steam clean equipment owned by the
City of Bozeman in the facilities owned by the Montana State Highway Department at times
when those facilities are not being used by that Department;
NOW. THERE'FORE. BE IT RESOLVED,
That the City Manager of the City of Bozeman is hereby authorized to verbally
contraot from t1m.e to time, as needed, with the District Maintenance Engineer. Montana
State Highway Department in Bozeman. to have equipment. owned by the City of Bozeman.
steam oleaned in the facilities owned by the Montana Stat~ Highway Deps.rtment and that. for
any such services received, the City of Bozeman will pay the Montana State Highway Depart-
ment on the basis of labor and equipment rental cost plus normal overhead charges.

Adverti sement of Bids for S. 1. D. 367
The Manager reported the plans and specifioations for the oonstruction of Special Improvement
District No. 367. water main on North Seventh Avenue. have been prepared. It was moved by Commissioner
Lowe. seconded by Commissioner Erwin, that the Clerk of the Commission be authorized to advertise for
bids to be opened March 11th. 1963. and the motion was oarried by the following Aye and No vote; those
voting Aye being Mayor Secor. Commissioner Lowe, CommiSSioner Erwin; those voting No, none.
Hearing -- Abandonment of S. I. D. No. 151
The Manager stated this was the time and plaoe set for the hearing of protests to the abandonment
of Special Improvement District No. 151. maintenanoe of parkings on the east side of Fifth Avenue from
Olive to Koch Street. He presented the affidavit of publication of the Notioe. and stated that no
protests have been filed and no one is present to protest. It was moved by Commi8sioner Lowe, seconded
by Cornmissioner Erwin. that the City Attorney be instruoted to prepare the resolution abandoning
Speoial Improvement Distriot No. 161, end the motion was oarried by the following Aye and No vote:
those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none.
Request for Parking Space During Convention
It was reported that the DeMolay organization has requested special parking privileges on the
east side of Tracy Avenue from Main Street to the alley during registration at their oonvention to
be held April 9th to 11th. 1953. After disoussion. it was pointed out that this has not been done
in the past and that, with proper administration of the traffic ordinance and with due consideration
for convention member's cars, it should not be neoessary to reserve the parking spaoes for this con-
venti on.

Adjustment Sewer- Rat e -- 210 East Main
A communioation from Gallatin Valley FUrniture Company. who occupy the building at 210 East
Main. was read. requesting an adjustment in their monthly sewer service oharge. The sewer rate at
this address is based on water usage while the building was occupied by a grocery store and, during
the put ten months. the water bill of the Gallatin Valley Furniture Company has been the minimum

charge. After oonsideration by the Commission, it was moved by Commissioner Erwin. seconded by
Commissioner Lowe, that the sewer charge be adjusted on the basis of a minimum charge for water.
and the motion was oarried by the following Aye and No vote; those voting Aye being Mayor Seoor.

Zoning -- Use of Warehouse. Story & Eleventh
Mr. James Pardew has made inquiry regarding building a residence at the oorner of Story
Street and Eleventh Avenue and using the present warehouse on this proper~ as a garage. It was
pointed out that this property is looated in the "B" Residenoe District and there is nothing in
present regulations to prevent Mr. Pardew from using the building now on these premises as a private
garage. Mr. Pardew is engaged in taking orders for building materials. hauling suoh materials in
by truck from distant points. and delivering them to his oustomers. The Manager was instructed to
notify Mr. Pardew in writing that. if he stored building materials in the warehouse or on the
property in question and made sales, either at retail or wholesale. from such stored materials. he
would be in violation of the Zoning Ordinance and action would be taken against him.
