The Commission ot the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, March 4, 1953 at 1:00 o'clock P. M. Present were Mayor Secor,
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:

Minutes of the last regular session Were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Kayor Secor, Commissioner Lowe, Commissioner Erwin;
those voting No, none.
Claims for the Month
Claims Nos. 5809 to 6014 inclusive were presented on the various funds as follows:

The Manager stated he has audited these claims and finds them to be true and lawful claims
aga~st the City of Bozeman and recommends that warrants be drawn for their payment. Af'ter examina-

tion of the claims in detail ~ the City Commission, it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, the. t the claims be approved and warrants drawn for their payment, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner
Lowe, Commissioner Erwin; those voting No, none.
Claim for Gas Tax Refund
A Claim to the State Board of Equalization in the amount of $752.40 for state gas tax refund was
presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the claim be
properly executed and presented for payment and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.

Resolution No. 734 -- Abandoning S. I. D. 151
Resolution No. 13i, abandoning Special Improvement Distriot No. 151 and the maintenance of the

parking on the east side of Fifth Avenue from Olive to Koch Street was presented, entitled:

BOZEMAN SPECIAL: IMFROVEMENT DISTRICT NO. 151 AND ABANDONING THE MAINTENANCE OF STRF.:ET
PARKINGS 'THEREUNDER; PURSUANT TO THE STATUTES IN SUCH CASES MADE AND. PROVIDED. AND PUR~
SUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 732 AS FASSED AND AOOPTED BY
SAID CITY COMMISSION ON THE 4th DAY OF FEBRUARY, A. D. 1953.

Street Light -- Grand & Lincoln
The Manager reported a request for a street light at the corner of Grand Avenue and Lincoln Street.
After consideration, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, tlB. t the City
Manager be authorized to order the Montana Power Company to install a street light at this inter-
section, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Secor, Commissioner Lowe, Commissioner Erwin, those voting No, none.

Manager & Police Chief to Idaho Falls
The Manager reported an Interstate Conference on Parking Problems to be held in Idaho Falls.
March 23. 1953. After consideration. it was moved by Comndssioner Lowe. seconded by Commissioner
Erwin. that the City Manager. the Chief of Police and such members of the City Commission as can. be
authorized to attend this conference and their expenses be paid from the General Fund. and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe.
Commissioner Erwin; those voting No. none.
Purchase of Cast Iron Fipe & Fittings
Roy Houser. owner of Royal Vista Addition. proposes that. when the water main is installed this
year on North Seventh Avenue. he will. at his expense. extend a six inch main on Birch Street and North
Eighth Avenue. in Royal Vista Addition. a distance of approximately 900 feet. He requests that he be
permitted to purchase. from city stocks. the pipe and fittings required for this water main. It was
the opinion of the Commission that. since Mr. Houser proposes this improvement to be made entirely at
his expense. the City should co-operate in every way possible. So that the City will have sufficient
stocks of pipe and fittings on hand to meet these requirements. it was moved by Commissioner Erwin.
seconded by Commissioner Lowe. that the City Manager be and is hereby authorized to purchase. for Water
Stores account. cast iron pipe and fittings as required during March. 1953 in amounts not to exceed
$950.00 and to purchase like amounts of such pipe and fittings in April. 1953. and the motion was
carried by the following Aye and No vote: fuose voting Aye being Mayor Secor. Commissioner Lowe.
Commissioner Erwin; those voting No. none.
Franchise for Television
In further consideration of the request of Norman Penwell. of Radio Station KBMN. for a franchise
or contract to install a wire system in Bozeman over which to transmit television. attention was called
to Chapter 3. Section 70-301. R. C. M. 1947. which permits telephone. telegraph. electric light and
electric power companies to install and maintain pole lines and other necessary structures on highways
and streets. Mr. Penwell was informed that his first step should be to negotiate contracts with the
Mountain States Telephone and Telegraph Company and the Montana Power Company for using their poles
to carry his proposed "T. v." wires and that. upon his presentation of such contracts in acceptable
form. and subject to the legality of the use of those pole lines for such purpose. the City will look
with favor on approving such contracts. Mr. Penwell was further informed that his alternate proposal
to erect and install pole lines and other required structures for an independent "T. V." distribution
system in the City would require a franchise and that a franchise could only be granted by a vote of
the citizens.
