HomeMy WebLinkAbout1953-04-15 228 Bozeman, Montana April 16, 1963 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall building, Wednesday afternoon, April 15, 1953 at 1:00 o'clock P. M. Present were Mayor Secor, Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the minutes be approved as read. and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe, Commissioner Erwin; those voting No, none. Bids for Traffic Signals Report was made of the detailed check and tabulation made by the City Engineer and City Manager of bids received at the last regular meeting on traffic control signals. Their report showed the bid of Arthur L. Stuart. doing business as the Bozeman Electric. as the lowest and best bid and recommended that it be accepted subject to the following conditions: 1. That technical discrepancies in the form in which the bid was submitted be waived. 2. That the total amount of the bid be reduced $4.00 due to an error of such amount made by the bidder in extending a total. 3. That. if the conduit for underground cable shown in the plans and specifications. or if any part of such conduit, is not required by the City to be installed, deduction shall be made from the basic bid at the installed price per foot or unit shown in the bid, for conduit and fittings not installed. 4. That the completion time of 168 days shown in the bid be modified to show that the work will be completed within 45 days after arrival of required materials and condi- tioned on the City having the necessary trenching done. 5. That General Electric signals and controllers be installed. A contract including the above conditions, except that pertaining to General Electric equipment, was presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the bid of Arthur L. Stuart, doing business as the Bozeman Electric. be accepted as per the proposed contract and that the Mayor and the Clerk of the City Commission be authorized to sign the contract for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin; those voting No, none. City License Re: fin-Ball Machines Mr. D. C. Overturf appeared before the Commission relative to the licensing of pin-ball machines. The City Attorney stated that there is question in the state law as to the city's authority to license such machines and that. in his opinion, the place of business should be licensed, and not individual machines. The City Commission stated that, based on the opinion of the City Attorney, businesses of this nature should be licensed as retail stores. Fetition for S. 1. D. Storm Sewer West Part of City Petitions signed by owners of seventy properties in the area to be affected were presented request- ing that a Special Improvament District be created, to inolude all the area within the city limits west of South Eighth Avenue, west of North Seventh, and between Beall Street and College Street, to provide the funds for and to construct a storm drainage system to serve the area described. In discussion of this proposal it was pointed out that some part of the campus of Montana Stat e Colleg,e should be included in this distriot. It was moved by Commissioner Erwin, seconded by Commissioner Lowe. that the City Engineer be instructed to prepare the necessary preliminary data and that. based on those data. the City Attorney be instructed to prepare a Resolution of Intention to create the proposed Special Improvement District and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. I I I Delegates to Sewage and Water Meeting It was announced that the Montana Sewage and Industrial Wastes Association will meet in Kalispell April 23rd, and the Montana Seotion of the A. W. W. A. will meet there April 24 and 25, 1953. It was moved by Commissioner Lowe, seoonded by Commissioner Erwin, that the City Manager, the City Engineer, the Water Superintendent and the Sewage Plant Operator be authorized to attend I these meetings, and their expenses be paid from the Water .Fund and S. O. S.Revenue Fund, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. The Commis s ion authorized the City Manager to invite the members of the Montana See tion of A. W.W. A. to hold their annual meeting in 1954 in Bozeman. Improvements on House of Water Shed Patrolman The Manager reported the house of the Water Shed Patrolman needs new siding. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to purchase $500.00 of material for siding for the house, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Bond of Director of Finance The bond of L. G. Shadoan, as Director of Finance in the amount of $20,000.00 was presented. The bond was approved as to fonn by the City Attorney. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the bond be accepted and approved, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; I those voting No, none. Water Service Outside City Limits -- Hugo Eck The written request of Hugo Eck, presented at the last meeting, relative to a water service for the house he proposed to build outside the city limits was discussed. The City Attorney reported that the law in effect in 1917, the year the deed was given requiring the city to furnish water to this property, did not give the city any authority to furnish water outside the city limits, and the law in foroe at the time the deed was given must control. He stated that, in his opinion, the city does not have to furnish more than one servioe to this property and this one service was installed in 1925. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the request be denied, and the City Attorney so notify Hugo Eck, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seoonded by Commissioner Erwin, that the meeting adjourn, and the motion was I oarried by the following Aye and No vote: those voting Aye being Mayor Seco r, Commissioner Lowe, Commissioner Erwin; those voting No, none.
