The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
building, Wednesday afternoon, April 29, 1953 at 1:00 o'clock P. M. Present were Ma;yor Secor,
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:

Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin;
those voting No, none.
Fublic Hearing S. T. D. 370
This was the time and place set for the hearing of protests to the creation of Special Improvement
Distri ct No. 370 , sanitary sewer on South Church Avenue from Story Street south approximately 400 feet.
The City Manager presented the affidavit of publication of the Notice and the Clerk's Mailing
Certificate that all property owners have been notified. No protests having been filed and no
one was present to protest, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that
the City Engineer be instructed to prepare the plans and specifications and the City Attomey be
instructed to prepare the resolution creating the district and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those
voting No, none.
Public Hearing S. I. D. 371
This was the time and place set for the hearing of protests to the creation of Special Tmprove-

ment District No. 371, paving on Third Avenue from Garfield to Lincoln Street. The City Manager
presented the affidavit of publication of the Notice and the Clerk's Mailing Certificate that all
property owners have been notified. The written protests of owners of 8.6% of the property in the
district were presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the
protests be overruled as insuffic ient and the City Engineer be instructed to prepare the plans and
specifications and the City Attorney be instructed to prepare the resolution creating the district
end the motion waS carried by the following Aye and No vote: those voting Aye being Mayor Secor,
Commissioner Lowe, Commissioner Erwin; those voting No, none.

presented the affidavit of publication of the Notice and the C~rk's Mailing Certificate that all
property owners have been notified. The written protests of owners of 8.8% of the property in the
district were presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the
protests be overruled as insufficient and the City Engineer be instructed to prepare the plans and
specifications and the City Attorney be instructed to prepare the resolution creating the district,

and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor.

Traffic Survey
Mr. H. C. Helland, Planning Survey Engineer, and Paul DeVine of the State Highway Department were
present to discus s a proposed traffic survey for the City of Bozeman. They explained the type of
survey proposed and stated the cost would not exceed 25% of $5,000.00, the estimated cost of the survey.
After coos ideration, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City
of Bozeman enter into an agreement as required. with the State Highway Department for the conduct of
a traffic survey during the summer of 1953 at a cost of' not to exceed $1.250.00, and the motion was

carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe,
Commissioner Erwin; those voting No, none.
Encroachment Fermi t with State Highway Department
An Encroachment Permit from the State Highway Department for the installation of a water main
on North Seventh Avenue was presented. It was moved by Commissioner Erwin, seconded by Commissioner
Lowe, that the Mayor be authorized to sign the permit for the City of Bozeman, and that the State
Highway Department be requested to investigate the necessi~ of issuing such Encroachment Permits,
and the motion was carried by the following Aye ~ld No vote: those voting Aye being Mayor Secor,
Commissioner Lowe, Commissioner Erwin; those voting No, none.

1'he City Manager reported on the meeting of the A. W. W. A. that he attended in Kalispell,
Montana.
Application for Beer & Liquor License
The application of the Bozeman Country Club for a city beer and a city liquor license was
presented. It was moved by Commissioner Erwin, seconded by Cornmissioner Lowe, that the applications
be approved and the licenses issued and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
Purchase of Sewer Tile
The Manager stated that the sewer tile in the alley to serve Langohr's Addition would cost
approximately $600.00.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be
authorized to purchase approximately $600.00 of 8" sewer tile, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Secor, Conunissioner Lowe, Commissioner Erwin;
those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Com:missioner3rwin, that the meeting adjourn, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe.
Commissioner Erwin; those voting No, none.
