June 10, 1953 at 1:00 o'clock P. M. Present were Mayor Secor, Commissioner Lowe. Commissioner Erwin. City Manager Henderson. City Attorney Lovelace and the Clerk when the following; proceedings were had: Minutes of the last regular session were read. and it was moved by Commissioner Erwin, seconded by Commissioner Lowe. that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No, none. Re}.orts City Manager Henderson reForted on the meeting of' the Montana Municipal League held in Billings June 4. 5. and 6. 1953. The following reports for the month of May. 1953 were presented: Sanitary Inspector Building Inspector Cashier end the report of the Director of Finance for the month of April. 1953. It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none. Adjustment of Sewer ehe.rge for Court House The Manager reported tllat the water bill for the court house has decreased considerable since leaks have been fixed in their fixtures. but the sewer service charge figured on water bills of exces- sive use is higher than the past month water bill. After discussion. it was moved by Commissioner Lowe. seconded by Commissioner Erwin. that an adjustment be made on the sewer charge for the Court House. based on the present average usage of water. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin; those voting; No. none. Use of South Sixth Avenue for Soap Box Derby A request from the Optimist Club for South Sixth Avenue to be blocked-off at intersections for the Soap Box Derby to be held July 12th. the same as in former years. was presented. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the street be blocked off and assistance be given as in previous years. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Corrmissioner Erwin; those voting No. none. License Fee for Circus and Carnival Sponsored by Jaycees A letter application from the Junior Chamber of Commerce for a license for Meeker Shows carnival to show in Bozeman on June 23-27 under their sponsorship and for Bailey Bros. Circus to show in Bozeman on July 28th also under their sponsorship was presented. It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that. subject to the payment of a license fee of $100.00 per day. the application be approved. and the motion w8,s-ea-rried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin; those voting No. none. Peti tion for S. 1. D. -- Alley in Block A. Alderson IS Addition A petition from owners of property abutting the all ey in Block "A", Alderson's Addition, between Babcock and Olive Streets. requesting that a Special Improvement District be established to provide the funds for and pave tilis alley. was presented. It was moved by Commiss ioner Lowe. seconded by Commissioner Erwin. that the City Engineer be I I 1 instructed to prepare preliminary estimates of cost and, based on this data, the City Attorney be instructed to prepare a Resolution of Intention to create this district, and the motion was carried by the following Aye and No vote. those votine; Aye beinG Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Sheet Metal Building on North Seventh Avenue in Business-Residence Zone No. 2 I It was reported that inquiry has been made regarding the erection of a prefabricated sheet metal building at the corner of North Seventh Avenue and Tamarack Street to be used as a gas station. Action was deferred on the matter pending further investigation. Attorney's Of -,inion. Re. Votinc Machines for City An opinion of the City Attorney was read, stating that Montana Statutes permit the purchase and use of voting machi-nes by municipalities in this state. Adjournment There being no further business to come before the Commission at this time, it was lIloved by Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none.
