The Commission of the City of Bozeman met in regular session in the Commdssion Room, City Hall
Building, Wednesday afternoon, September 3, 1952. at 1:00 o'clock F. M. Fresent were Mayor Secor,
Commissioner Lowe. Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded I
by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the following
Aye 8.11d No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; thos e
voting No, none.
Restaurant in Business Zone No. 2
Mr. & Mrs. S. E. Thelander were present to request approval of moving the building known as the
Snack Shack. now located at 1202 So. Sixth Avenue, to No. 720 So. Tenth Avenue and to operate a
restaurant in it in the proposed new location. The proposed new location is in Business District No.2.
In discussion it was pointed out that, while moving an old building into Business District No. 2
is undesirable, there is nothing in present ordinances which prevents that from being done nor which
prevents operation of a restaurant at the proposed location on South Tenth Avenue. It was therefore
moved by Commissioner Lowe. seconded by Commissioner Secor, tha t, subject to their securing the
required moving and improvement permits, the request of Mr. and Mrs. Thelander be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner
Lowe and Commissioner Erwin; those voting No, none.
Audit Report for 1951-52 Approved
The audit report for the fiscal year ending June 30th, 1952 prepared by C. E. Coulston, C. f. A. I
was presented. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that 'the report be
accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Secor, Commissioner Lowe and Commissioner Erwin; those voting No, none.
Reports
The fbllowing reports for the month of August, 1962 were presented:

and the annual report of the Fire Chief.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Secor, Commissioner Lowe and Commissioner Erwin; those voting No, none.
Claims for the Month
Claims Nos. 4488 to 4720 were presented on the various fUnds as follows:

The Manager stated he has audited these claims and finds them to be true and lawful claims against
the City of Bozeman, and recommends that warrants be drawn for their payment. After examination of the
claims in detail by the City Commission, it was moved by Conunissioner Erwin, seconded by Commissioner

Lowe. that the claims be approved and warrants drawn for their payment. and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin and
Commissioner Lowe,; those voting No. none.
Resolution No. 720 -- Intention to Create S. 1. D. No. 366
The Man~er staten the City Attorney as instructed has prepared the resolution of intention
I to create Special Improvement District No. 366. installation of a sanitary sewer in the first alley
east of North Seventh Avenue from Aspen Street to the City Limits. He presented Resolution No. 720.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA. DECLARING IT TO BE
THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY
TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 366 OF THE CITY OF BOZEMAN"
FOR THE FURPOSE OF CONSTRUCTING AND INSTALLING A SANITARY SEWER IN THE NORTH AND SOUTH
ALLEY IN BLOC KS ONE (l). TWO (2i. THREE (3) AND FOUR (4), OF THE NORTH SEV~TH ADDITION TO
THE CITY OF BOZEMAN, AND THE EXTENSIONS OF SAID ALLEY BETWEEN A POINT LOCATED DUE EAST
FROM THE SOUTHEAST CORNER OF' LOT FIVE (5) OF' SAID BLOCK ONE (l) AND THE MANHOLE AT STATION
47 plus 35 OF THE WEST SANITARY TRUNK SEWER, SAID MANHOLE BEING LOCATED 5 FEET SOUTH OF
THE NORTH CITY LIMITS OF THE CITY OF BOZEMAN. AND TO SPECIALLY ASSESS THE COST OF SUCH
CONSTRUCTION AND INSTALLATION AGAINST THE FROPERTY WITHIN THE BOUNDARIES OF SAID SPECIAL
IMPROVEMENT DISTRICT SO CREATED ON AN AREA BASIS, PURSUANT TO THE STATUTES IN SUCH CASES
MADE AND PROVIDED.
It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the Resolution be passed
and adopted and September 24th, 1952 be set as the date for the hearing of protests and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin
and Commissioner Lowe,; those voting No, none.
Board of Adjustment to Meet with Commission
The Manager reported a violation of the Zoning Ordinance in regard to requirements for basement
ap a rtmen ts. Because several similar cases have come up. the Commission suggested that the Board of
I Adjustment meet with them at their next regular meeting to discuss this problem and the Manager was
instructed to arrange such a meeting.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Lowe. seconded by Commissioner Erwin, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe and
Commissioner Erwin,; those voting No. none.
