HomeMy WebLinkAbout1952-09-10 164 Bozeman, Montana September 10, 1952 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, September 10, 1952, at 1:00 o'clock P. M. Present were Mayor Secor, Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: Minutes of the last regular session were read. and it was moved by Commissioner Lowe. seconded I by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Legislative Program Recommendations of the Legislative Committee of the Montana Municipal League for proposed new legislation were read. Industrial Accident Indemnity during Sick Leave The Manager reported the Industrial Accident Board will not pay indemnity in case of accident when the City of Bozeman pay for sick leave. as it is the policy of the Industrial Accident Board to pay only for loss of earnings. The Manager stated that, in his opinion, the City of Bozeman was being penalized because the Industrial Accident Board did not pay city employees for disability during- this period and the city pays insurance premiums for this coverage, and stated this matter would be taken up with the Accident Board. Zoning Ordinance discussed wittl Adjustment Board Members of the Board of Adjustment met with the City Commission to discuss zoning regulations and particularly regulations for basement apartments. It was suggested that the regulations for basement I apartments should be checked with regulations of other localities, otherwise no changes in the Zoning Ordinance seems necessary at this time. Confirmation of Folice Officers Dorman and Latta A communication from the Chief of Police was read stating Clyde Latta and Walter Dorman have com- pleted their probationary periods as Pol ice Officers, and recommending their confi:rme. tion as regula r members of the Police Department. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the confirmation of Clyde Latta and Walter Dorman as regular members of the Police Department be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those vo ting No. nOn!!. furchase of' Car for Fire Department Fire Chief McCrosson reported that the present 1940 Chevrolet used by the F'ire Department could be traded-in on a 1948 Dodge coupe at Rolfe and Wood for an additional $700.00. He stated the mechanics of the car had been checked by members of the department, and recommended the purchase of this car for use in the Fire Department as the Chief's car and for inspection purposes. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, tm. t the City Manager be authorized to make I this purchase and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe. Commissioner Erwin; those voting No, none. Continuation Certificate of Stimson - Gas & Plumbing The continuation certificate for the bonds of K. J. Stimson as a Master Plumber and Gas Fitter were presented. The certificates were approved as to form by the City Attorney, whereupon, it was moved by Commissioner Lowe, seconded by Connnissioner Erwin, that the certificates be approved and accepted and the motion was carried by thf~ following Aye and No vote~ those voting Aye being -lJi5 Mayor Secor. Commissioner Lowe, Commissioner Erwin; those votinE No. none. Rerorts The report of the Cemetery Board and the Sanitary Inspector for the month of August. 1952 were presen ted. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the rerorts be accepted I and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those voting No. none. Resolution No. 721 -- Intention to Create S. I. D. No. 367 G'/ The Manager stated the City Attorne~ as instructed)has prepared the resolution of intention to create Spe~ial Improvement District No. 367. installation of water mains on North Seventh Avenue from Durston Road to the City Limits. He presented Resolution No. 721. entitled: ARESOtUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NUMBER 367l1FDR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN EIGHT INCH WATER MAIN ON NORTH SEVENTH AVENUE BETWEEN DURSTON ROAD AND THE NORTH CITY LIMITS OF THE CITY OF BOZEMAN, MONTANA. AND TO SPECIALLY ASSESS A CERTAIN PORTION OF THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF SAID SPECIAL IMFROVEMENT DISTRICT SO CREATED ON A FRONT FOOT BASIS, FURSUANT TO THE STATUTES IN SUCH CASES MADE .AND FROVIDED. It was moved by Commissioner Erwin. seconded by Commissioner Lowe, that the resolution be passed and adopted and Wednesday the 1st day of October. 1952 be set as the day for hearing protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin. Commissioner Lowe; those voting No. none. Adjournment There being no further business to come before the Commission at this time. it was moved by I Commissioner Erwin. seconded by Commissioner Lowe, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor.
