September 17. 1952. at 1:00 o'clock P. M. Fresent were Mayor Secor. Commissioner Erwin. City Manager Henderson. City Attorney Lovelace and the Clerk when the following proceedings were had: Minutes of the last regular session were read. and it was moved by Commissioner Erwin. seconded I by Mayor Secor, that the minutes be a~proved as read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting No. none. Building - 135 West Mendenhall H. Elliott Thompson appeared before the Commission in regard to moving the brick house at 135 West Mendenhall. on Lot 10 and part of Lot 9. Block B. Tracy's Second Addition. which is in the Main Business District and in Fire Zone No.2. He asked permission to move the building to the north and east property line of said lots. The wood gables and wood shingles on the building not complying with building regulations in Fire Zone No.2. the City Commission sat as a Board of Appeals to con- sider the request. It was pointed out that. at the present time. the building will be several feet from any other building on this property or adjacent property. It was moved by Commissioner Erwin. seconded by Mayor Secor. that subject to the owner agreeing in writing. said agreement to be made a matter of record at the court house. that, at any time the City of Bozeman requests. the wood gables or wood-shingled roof will be reconstructed to meet the building regulations of this fire zone. the request to move the building be and is hereby approved. and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Seoor and Commissioner Erwin; those voting No, none. Report of Committee on Truck By-Pass I Howard Nelson. Chairman of the oommittee appointed by the Mayor. August 29. 1952. to make a study and reoommendations for a truok by-pass in Bozeman, was present and presented the following recommendations to the Commission: Truck By-Fass -- Should go north on Broadway to Front Street, from Front Street to Tamarack Street. then west on Tamarack Street to North S~venth Avenue. Relief of Main Street Traffio -- By parallel parking and additional tr~ffic control lights. Eighth Avenue Traffic -- No decision reaohed. Mayor Secor thanked the committee for their recommendations. and relieved the committee of any further duties. The report and recommendations were taken under advisement for further study. Objection to Parallel Parking Mr. Earle Jennings was present and stated he has heard numerous objections to parallel parking end that. in his opinion. the business section on Main Street would suffer if parallel parking was put into effect. He asked that advance publici~ be given any proposed action by the City Commission regarding parallel parking. Purchase of Water Meters The recommendation of the Water Superintendent to purchase thirty-six Hersey water meters at a I total cost of $820.44 was considered. It was moved by Commissioner EMWin. seconded by Mayor Secor, that the City Manager be authorized to make this purohase and the motion was carried by the following Aye and No vote: thos.e voting Aye being Mayor Secor and Commissioner Erwin; those voting No. none. Encroachment of Fence at Whittier School The Manager reported that the playground fence at the south end of the Whittier School grounds has been located so that it encroaches four feet into the alley along the property. It was moved by Commissioner Erwin. seoonded by Mayor Secor. that the Manager notify the Trustees of Sohool District 1(}7 No. 7 of this encroachment1 and ask that the fence be moved as soon as is practicable1 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting N01 none. Parking Space at Sheriff's Office The request of the Sheriff's Office to set aside three parking spaces in front of the county I jail for emergency vehicles was considered. The Manager reported that it is the recommendation of the Chief of Police that this space be provided for vehicles of the sheriff's office. It was moved by Commissioner Erwin. seconded by Mayor Secor. that the request be and is hereby approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting No. none. Additional Street Lights The Manager recommended installation of street lights at the following intersections: Fifth and Durston Road Fourth and Short Street Fifteenth and Dickerson Fifteenth Avenue and Koch It was moved by Mayor Secor. seconded by Commissioner Erwin1 that the Manager be authorized to instruct the Montana Power Company to install street lights at these four intersections. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Comrndssioner Erwin; those voting No. none. Reports The following reports for the months of July and August. 1952 were presented: Plumbing & Gas Inspector Building Inspector It was moved by Commissioner Erwin. seconded by Mayor Secor. that the reports be accepted and I ordered fi led and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting No. none. Driveway at 437 East Main Street The Manager presented a sketch of a building proposed to be erected at 437 East Main Street. located on part of Lots 4 and 51 Block F1 Rouse's Addition. The plans show a driveway entrance into the building from Main Street. After examination of the plans. it was moved by Mayor Secor1 seconded by Commissioner Erwin, that subject to the owners securing all required permits and the building being constructed in compliance with regulations of the City. the cutting of the curb and construction of the proposed driveway entrance be and is hereby approved and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting No. none. Police Reward A communication from A. N. Haas1 Chief of Folice, was read relative to a $25.00 reward which Chief Haas had received from Washington State Penitentiary for the capture of an escapee from that institution. Chief Haas proposed that the $26.00 be turned over to the Bozeman Police Protective Association. There being no objection from the Comrrdssion. the City Manager stated that he would approve such disposition of the reward. I Misc. W & C 1952. Additional Rerair Work The Manager presented a sidewalk inspection report listing several places where sidewalks need to be repai red th is fall. It was moved by Commissioner Erwin, seconded by Mayor Secor. that the report be accepted and approved and made a part of this minute entry by its adoption and the City Manager be ordered to notify the property owners to have these sidewalks repaired as required by law. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwin; those voting N01 none. Adjournment 168 There being no further business to come before the Commission at this time, it was moved by Commissioner Erwin, seconded by Mayor Secor, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor and Commissioner Erwinj those voting No, none.
