October 1. 1952. at 1:00 o'clock P. M. Present were Mayor Secor. Commissioner Lowe. Commissioner Erwin. City Attorney Lovelace and the Clerk when the following pro- ceedings were had: Minutes of the last regular session were read. and it was moved by Commissioner Lowe. seconded I by Commissioner Erwin. that the minutes be approved as read. and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe. Commissioner Erwin; those . voting No. none. Request for No Parking Signs Mr. T. G. Haggerty. representing the Rosary PTA. appeared before th e Commission and requested two signs to be placed in front of the Rosary School. prohibitint~ parking between the hours of 8:00 A. M. and 4:00 P. M. After consideration. the Commission expressed approval of such a request. Request for School Signs -- Wllittier PTA A committee from the Whittier FTA were present end requested a school sign at Seventh Avenue and Durston Road to slow the traffic at this intersection so children could cross Seventh Avenue more safely. They also suggested that an area be designated as a safety area. at this intersection, while children are waiting to cross the street. as all the area near Ralph's Store is driveway and the pedestrian has no place to stand while waiting to cross. The Corrunission was informed that additional school signs were being made and that a cross walk would be painted at the intersection of Durston Road and Seventh Avenue and at the intersection of Lamme Street and Seventh Avenue. The Commission also recommended that the Police Department make a I study of traffic near the Whittier School end have recommendations for the next regular meeting. Hearing S. 1. D. 367 -- Water Main on North 7th Avenue The Clerk stated this was the time and place set for the hearing of protests to the creation of Special Improvement District No. 367. installation of water mains on North Seventh Avenue from Durston Road to the city limits. He presented the affidavit of the publication of the Notice to property owners. and the Clerk's mailing certificate that all property owners have been notified. There being no protests filed and no one present to protest. it was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the Ci~ Attorney be instructed to prepare the resolution creating the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin and Commissioner Lowe; those voting No. none. Resolution No. 726 -- Creating S. 1. D. 366 The C1e rk stated the City Attorney as instructed has prepared the resolution crea ting Special Improvement District No. 366. installation of a sanitary sewer from approximately Aspen Street to the north ci~ limits in the first alley east of North Seventh Avenue. He presented Resolution No. 726. entitled: A RESOLUTION OF' THE CITY COMNIISSION OF THl!: CITY OF BOZEMAN. MONTANA, CREATING A SPECIAL IMFROVE- I MENT DISTRICT OF' SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPHOVEMENT DISTRICT NO. 366 FOR THE I'URFOSE OF CONSTRUCTING AND INSTALLING A SANITARY SEWER IN THE NORTH AND SOUTH ALLEY IN BLOCKS ONE (1). TWO (2). THREE (3) AND FOUR (4) OF THE NORTH SEVENTH ADDITION TO THE CITY OF BOZEMAN. AND THE EXTENSlmJS OF SAID ALLEY BETWEEN A POINT LOCATED 150 FEET SOUTH OF THE SOUTH LINE OF WEST ASPEN STREET AND THE MANHOLE AT STATION 47 PL.mr-35 OF THE WEST SANITARY TRUNK SEWER. SAID MANHOLE BEING LOCATED 5 FEET SOUTH OF THE NORTH CITY LIMITS OF THE CITY O'F BOZEMAN. AND TO SPECIALLY ASSESS THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE PROPERTY WITHIN THE BOUNDAllIES OF SAID SPECIAL IMPROVJi;MENT DISTRICT SO C'RRATED ON AN AREA BASIS. PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED AND PURSUANT TO AND IN CONFORMITY WITH COMMIS- SION RESOLUTION NUMBER 720 OF SAID CITY COMMISSION AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 3RD DAY OF SEPTEMBER. A. D.. 1952. It was moved by Commissioner Lowe. seconded by Conunissioner Erwin. that the resolution be passed and adopted and October 22nd. 1952 be set as the date for opening of bids. and the motion was oarried 17t by the following Aye and No vote: those voting Aye being Mayor Secor. D. -- Sewer on North 6th between Villard & Durston A petition representing 22.66% of the property owners requesting that a special improvement district be created to install a sanitary sewer in Sixth Avenue from Villard Street to Durston Road was presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Attorney be instructed I to prepare the resolution of intention to create the district and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No, none. Fetition for S. I. D. -- Water Main on North 6th From Villard to Durston A petition representing 25.6% of the property owners requesting that a special improvement di strict be created to install a water main in Sixth Avenue from Villard Street to Durston Road. and in Durston Road from Fifth to Sixth AVenue was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Attorney be instructed to prepare the resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe, Commissioner Erwin; those voting No. none. Reports The following reports for the month ot' September, 1952 were presented: Police Judge Water Collector It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those votin~ Aye being I Mayor Secor, Commissioner Lowe, Commissioner Erwin; those voting No. none. Resolution No. 725 -- Garbage Assessment Resolution No. 725 levying the assessment in the amount of $24,078.84 for the collection of garbage for the year 1952 was presented, entitled; A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DUR- ING THE YEAR 1952, TO DEFRAY THE COST AND EXFENSE OF COLLIOC:TING AND DISPOSING OF GARBAGE UNDER THF. PROVISIONS OF ORDINANCE NO. 696 OFTBE CITY OF BOZEMAN. Resolution No. 724 -- Sprinkling Assessment Resolution No. 724 levying the assessment in the amount of $1,079.09 for street sprinkling for the year 1952 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE C 1TY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON ALL THE PRQFF.;RTY IN STREET SPRINKLING DISTRICTS OF TRE CITY OF BOZEMAN, COUNTY OF GALLATnI. STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SFRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE Y~ 1952. MONTANA. LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMFROVEMENT LIGHTING DISTRICTS NUMBERS 361, 362. 284, 288. 289. 290, 296. AND 300 OF THE CITY OF BOZEMAN. FURSUANT TO THE PROVISIONS OF SECTIONS 5266 R. C. M. 1935. It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that the resolution be provisionally passed and October 8th. 1952 be set as the date for the hearing of protests and the motion was ca rried by the following Aye and No vote: those voting Aye being Mayor Secor. LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXI~S UPON ALL THE PROPERTY IN SPECIAL IMFROVEMENT DISTRICTS OF THE CITY OF BOZEMAN. COUNTY OF GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THE PARKINGS WITHIN SAID SPECIAL IMfROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR THE YKAR 1952.
