Montana October 8, 1952 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, October 8, 1952 at 1:00 o'clock P. M. Present were Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No, none. Reports The following reI-orts for the month of September, 1952 were presented: Cashier Librarian Sanitary Inspector Fire Chief Police Chief Sewage Plant Operator and the report of the Director of Finance for the month of August, 1952. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those vo ting No, none. Report of I. C. M. A. Meeting in Kansas City City Manager Henderson reported to the Commission on the meetin~ of the International City Managers' Association held in Kansas City which he attended. Claim to State for Gas Refund I A claim against the State Board of Equalization in the amount of $742.26 for refund of state gasoline tax was presented. It was moved by Commissioner Lowe, seconded by Corruussioner Erwin, tffit the City Manager be authorized to file said claim for the refund and the motion was carried by the following Aye and No vote: those voting Aye being Comrriissioner Lowe and Commissioner Erwin; those voting No, none. Resolution No. 722 -- Final Passage -- Parking Maintenance The Manager stated this was the time and place set for the hearing of protests to the final passage of the resolution levying the assessment for parking maintenance for the year 1952. He presented the affidavit of publication of the notice end stated no protests have been filed and no one is present to protest. He presented Resolution No. 722, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LlWYING AND ASSESSING A SPECIAL ASSESS- M1<:::NT OF TAXES UPON ALL THR PROPERTY IN SPECIAL IMFROVEMENT DISTRICTS OF THR CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, FOR TJ'IE MAINTENANCE OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THE F ARKINGS WITHIN SAID SPEC IAL IMJ'ROVEMRNT DISTRICTS OF THE C TTY OF BOZEMAN FOR THR YEAR 1952. Resolution No. 724 -- Final Fassage -- Sprinkling Maintenance The Manager stated this was the time and place set for the hearing of protests to the final passage of the resolution levying the assessment for sprinkling maintenance for the year 1952. He presented the affidavit of publication of the notioe and stated no protests have been filed and no one I is present to protest. He presented Resolution No. 724. entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UfON ALL THE FROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN. STATE OF MONTANA. TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF 'lEE CITY OF BOZEMAN FOR 'lEE YEAR 1952. It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote~ those voting Aye being Commissioner Lowe and Commissioner Erwinj those voting No, none. Resolution No. 725 -- Final Fassage -- Garbage Assessment The Manager stated this was the time and place set for the hearing of protests to the final passage of the resolution levying the assessment for garbage assessment for the year 1952. He presented the affidavit of publication of the notice and stated no protests have been filed and no one is present to protest. He presented Resolution No. 725. entitled: A RESOLUTION Or' THE COMlfISSION OF THE CITY OF BOZEMAN, MONTANA, L 1YYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN. COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DUR- ING THE YEAR 1952. TO DEFRAY THE COST AND EXFENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the resolution be passed I and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwinj those voting No, none. Resolution No. 727 -- Creating S. I. D. 367 The Manager stated the City Attorney as instructed has prepared the resolution creating Special Improvement Distriot No. 367. installation of water mains on North Seventh Avenue from Durston Road to the City Limits. Re presented Resolution No. 727. entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY Or' BOZEMAN, MONTANA, CREATING A SPECIAL IMFROVE- MENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 367 FUR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN EIGHT INCH WATER MAIN ON NORTH SEVENTH AVENUE BETWEEN DURSTON ROAD AND THE NORTH CITY LIMITS OF THE CITY OF BOZEMAN, MONTANA, AND TO SPECIALLY ASSESS A CERTAIN PORTION OF THE COST OF' SUCH CONSTRUCTION AND INSTALLATION AGAINST THE FROFERTY WITHIN THE BOUNDARIES OF SAID SF'ECIAL IMPROVEMENT DISTRICT SO CREATED ON A FRONT FOOT BASIS, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND FURSUANT TO AND IN CONFDRMITY WITH COMMISSION RESOLUTION NUMBER 721 OF SAID CITY COMMISSI'tN AS PASSED AND AOOPTED BY SAID CITY COMMISS ION ON THE 10th DAY OF SEFTEMBER, A. RESOLUTION NO. 728 -- Intention to Create S. I. D. 368 I The Manager sta.ted the City Attorney as instructed has prepared the resolution of intention to create Special Improvement District No. 368, insta.llation of a sanitary sewer in North Sixth Avenue from Villard to Durston Road. He presented Resolution No. 728. entitled: A RESOLUTION OF THE CITY C01~1ISSION OF THE CITY OF BOZEMAN, MONTANA. DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMfROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS "SPECIAL IMfROVEM~::NT DISTRICT NO. 368 OF THE CITY OF BOZEMAN" FOR THE FURFOSE OF CONSTRUCTING AND INSTALLING A SANITA'RY SF:WER IN NORTH SIXTH AVENUE FROM VILLARD STREET TO DURSTON ROAD. He presented Resolution No. 729. entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS "SPECIAL IMFROVEMENT DISTRICT NO. 369 OF' THE CITY OF BOZEMAN" FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SIX INCH WATER MAIN ON DURSTONROAD FROM NORTH FlFTH AVENUE TO NORTH SIXTH AVENUE, AND ON NORTH SIXTH AVENUE FROM DURSTON ROAD TO VILLARD STREET ,AND TO SPECIALLY ASSESS THE COS T OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE PROPERTY VITTHIN THE BOllNDARIES OF SAID SPECIAL IMPROVEMENT DISTRICT SO CRF..ATED ON A FRONT FOOT BASIS, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED. No Parking Signs at Rosary Sohool Referring to the request presented at the Commission meeting on October 1, 1952 for additional "No Parking" signs at Rosary school. investig;ation shows that sig')ls are placed at this school in the same proportionate numbers as are plaoed at all other schools in the oity. It was therefore considered that additional signs at Rosary school are not neoessary at this time. I Recommendations of Police Department -- School Crossings on North Seventh Following instructions given to him on October 1. 1952, Chief of Polioe Haas and his department have made a special study of traffio conditions on North Seventh Avenue with particular reference to increased hazards from children orossing to and from the new Whittier school. He made the fa Hawing reoorranendat ions: 1. That the intersection of Lamme Street and North Seventh Avenue be designated as a "School Crossing Zone" in accordance with Seotion 38 (I'}, of Ordinance No. 768. the Traffic Ordinance. 2. That a curb. log barrier, or other suitable struoture be installed at the southwest corner of the intersec tion of Durston Road and North Seventh Avenue for better control in keeping traffio in the normal lanes of travel at this point. 3. The t further check and study be made on the need or advisability of instellin[; a "blinker" or traffic warning light at the intersection of North Seventh Avenue and Durston Road. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the City Manager. in his oapaci ty as Director of Public Safety and in acoordance wi th Section 36. Ordinanoe No. 738. be and is hereby instructed to designate the interseotion of Lamme Street and North Seventh Avenue as a "School Crossing Zone" as provided by Section 38 (f) of Ordinance 738 and Sohedule No. III of said ordinance and that he be further instruoted and authorized to have a curb or log barrier constructed at Durston I Roed and North Seventh Avenue as recommended by Chief of Police Haas and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No, none. After examination of the claims in detail by the City Commission, it was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the claims be approved and warrants drawn for their payment and the moti on was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No, none.
