Wednesday afternoon, October 15, 1952 at 1:00 o'clock P. M. Present were Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Cle rk when the followinlS proceedings were had; I Minutes of the last regular session w~re read. and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting A,ye bein~ Comrnissjoner Lowe and Commissioner Erwin, those voting No, none. Resolution No. 730 -- 1952 W & C Assessment The Manager stated the resolution levying the assessment in the amount of $3.791.21 for construc- tion of Miscellaneous W & C for 1952 has been prepared. He presented Resolution No. 730, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON C~RTAIN PROPERTIES IN THE CITY Or' BO2F..MAN , COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THF: COST OF CONSTRUCTING AND INSTALLING AND/OR REPAI RING MISCELLANEOUS SIDEWALKS AND C1TRBS DURING THE YEAR 1952. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be provisionally passed and October 22nd, 1952 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin, those voting No, none. Misc. W & C 1952 Claim Claim No. 4941A of A. Tobin in the amount of $1,658.92, the Engineer's final estimate in full I under the Misc. W & C contract for 1952, was presented. The City Manager recommended payment of said cIa i m. and also that the 90-day 10% reserve not be held. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. that the claim be approved and paid in full with W & C 1952 warrants and the motion was carried by the following ~ye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin, those voting No, none. Request for Composition Roof -- 116 S. Tracy Mr. August Gnehm was present and requested that, in the construction of the "Ski Shop" being built at 116 South Tracy, he be permitted to cover the roof wi th composi tion or asphalt roofing. He stated the building is of temporary nature en d sets twenty feet from any building on adjacent property. The Commission, setting as a Board of Appeals, considered the request, and it was moved by Commissioner Lowe. seconded by Corrmissioner Erwin, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No. none. Request for Replacement of Damaged Windshield The Manager reported that Earl Hannon, while drivinr, his car through the intersection of Sixth Avenue and Koch Street, by applying brakes suddenly to avoid dips in the pavement, had thrown a I passenger into his windshield and broke it. He has requested that the city pay to rerlace the wind- shield. The Commission stated the city could not assume any liability or responsibility in replacing this windshield. Report The report of the Ceme~ery Board for the month of September. 1952 was presented. It was moved by Commissioner Erwin, seconded by Conunissioner Lowe, that the reI,ort be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No, none. 1.78 fetition and Recommendations on Prohibiting farking on South Side of Cleveland Street A petition of property owners on the south side of Cleveland Street from Willson to Sixth Avenue was presented requesting that parkinp; be restricted on the south side of Cleveland Avenue from Willson Avenue to Sixth Avenue. The matter was taken under advisement for one week. Written recommendations from Chief of Police Haas in connection with the above petition were presented. These recommendations concur in prohibiting parking on the south side of Cleveland Street provided that prohibition is I effecti ve 24 hours a day. As an al ternative recommendation Chief of Police proposed that Cleveland Street be made a one-way street for west bound traffic and Garfield Street be made a one-way street for east bound traffic. Gravel Mixing Bed The Commission stated they were in accord with plans of the Street Department to have a gravel mix- ing bed on Eleventh Avenue at the west end of Main Street. Lease of Gravel fit The Manager stated that usable gravel has run out at the pit now leased by the City. He reported that similar gravel could be obtained from a pit owned by Mrs. Cora M. Huffine. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Attorney be instructed to prepare a lease with Mrs. Cora M. Huffine for the obtaining of pit run gravel on terms similar to the present lease, fl1 d the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Cormnissioner Erwin; those voting No, none. Delegate to Law Enforcement Institute The Manager reported that F'. B. I. Law Enforcement Institutes will be held in Missoula, October 30th and 31st, and in Billings, November 12th and 13th. It was moved by Commissioner Erwin. seconded I by Commissioner Lowe, that the Chief of Police or his designated representative be authorized to attend one of these meetings and his expenses be paid from the General Fund, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those votinf; No, none. Lovelace to Legislative Meeting City Attorney Lovelace is a member of the legislative committee of the Montana Municipal League and a meeting of that committee is to be held in Helena, October 17th. 1952. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Attorney be authorized to attend this meeting and his expenses be paid from the General Fund. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lowe and Commissioner Erwin; those voting No, none.
