HomeMy WebLinkAbout1952-08-13 'I r.: r.: Bozeman, Montana ,tla August 13, 1952 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, August 13, 1952 at 1:00 o'clock P. M. Present were Mayor Secor, Commissioner Erwin, Commissioner Lowe, City Manager Henderson, City Attorney Lovelace, and the Acting Clerk when the following proceedings were had: I Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the following Aye and Novate: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. Proposed Special Improvement Districts North Seventh Avenue The matter of establishing Special Improvement Districts for the installation of a sanitary sewer and a water main along North Seventh AVenue was discussed. Mr. Paul Jones, who owns property on the east side of Seventh Avenue, proposes to ciroulate petitions for establishment of these districts. City Engineer Waldorf has prepared tentative plans for location of the sewer and water main. It is proposed that the sanitary sewer be in the alley between Seventh and Fifth Avenues, that it will extend from a point apFroximately 140 feet south of Aspen Street north to the city limits where it will connect to the West Side Trunk Sewer, and that the cost of it will be assessed on an area basis against that property situated between a line one hundred twenty feet east from and parallel with said alley and the east line of Seventh Avenue. On the wa te r main, it is proposed that an 8-inch pipe be laid in North Seventh Avenue from Durston Road to Hemlock Street. For the usual or nonnal water main, a 6-inch line would be of sufficient I si ze but, in the Morrison-Maierle report on development and expansion of the water distribution system, they recommend an 8-inch line at this location as part of a loop which would be extended from Durston Road north to the city limits, thence east to Rouse Street to connect to the main supply line from Lyman Creek. Since the installation of an 8-inch main instead of a 6-inch main along Seventh Avenue would be for the benefit of the water system as a whole instead of for the benefit of property owners in the proposed North Seventh Avenue district, it is recommended by the City Engineer and the City Manager that, if this proposed district is established and, if an 8-inch instead of 6-inch water pipe ~ is installed, the City of Bozeman should pay that part of the cost over and above the cost of installing 6- inch pipe. It is further proposed that the cost to the property owners in this district be assessed on a front foot basis against the property in the district. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that these recommendations be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. Construction AdditionalW & C , , The City Manager reported that requests have been received to have new sidewalk ordered built on South Grand Avenue along Lots 19, 20 and 21, Block 18, Butte Addition. This would connect existing I sidewalks and would enable owners of property south of the above lots to receive mail delivery. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the above sidewal k be ordered buil t and that, if it has not been built by the owner within 30 days, it be added to and built under the 1952 contract for sidewalk construction and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. The Manager also reported that there are still six properties along which new sidewalk was ordered constructed in 1951 and where the walks have not yet been built. The Manager was instructed 156 to notify owners of these properties tffit these sidewalks will be built under the City's 1952 con- tract for construction of miscellaneous walks and curbs and the cost of the walks will be assessed against the respective properties. Final Passage - Appropriation Ordinance No. 770 The City Manager stated that this was the time and place set for the final passage and adoption of the annual Appropriation Ordinance. He presented the affidavit of publication of the Ordinance, and I stated that no protests had been filed, and no one was present to protest. He presented Ordinance No. 770, entitled: AN ORDlll'ANCE AFPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETORY REQUIREMENTS FOR MAlll'TENANCE ETC., OF THE MUNICIf.AL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1953. It was moved by Commiss ioner Lowe, seconded by Commission Erwin, that the Appropriation Ordinance No. 770 be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. R epo rt The report of the Cemetery Board for the month of July, 1952 was presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the report be accepted and ordered filed and the motion was carried by the fo llowing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. Bond - City Manager Henderson The bond of M. E. Henderson, City Manager, in the amount of $2,000.00 was presented. The bond was apI-roved as to form by the City Attorney, whereupon it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the bond be approved and accepted and the motion was carried by the I following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin and Commissioner Lowe; those voting No, none. Continuation Certificate - Gas Fitters Bond The continuation certificate for the gas fitter's bond of Frank A. Brown dba the Oliver Stout Hardware Co. was presented. The certificate was approved as to form by the City Attorney, whereupon it was moved by Commissioner Erwin, seoonded by Commissioner Lowe, that it be accepted and approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commis- sioner Erwin and Commissioner Lowe; those vo ting No, none. Librarian to Pacific Northwest Librarian Association Meeting Written request of Margaret Hileman, Librarian, to attend the ~acific Northwest Librarian A~sociation meeting in Victoria, B. C. September 8 - 10, was read. Her transportation expenses will be paid by the State Library Association and she requested the City to pay the balance of her expenses. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that, it being in the publio interest, Miss Hileman be authorized to attend this meeting and her expenses be paid from the Library Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. I V-J Day Holiday Governor Bonner having proolaimed V. J. Day, Thursday, August 13th, a state holiday, it was moved by Comndssioner Lowe. seconded by Commissioner Erwin, that the City Offices be closed but that all other city operations be carried on in the usual manner on that day and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Seoor, Commissioner Erwin and Commissioner Lowe; those voting No. none. Appointment of Roy Ayres to Cemetery Board (see next page) 157 Miss Elizabeth Bogert was continued as a member of Sunset Hills Cemetery Board until her death last year and a vacancy has existed on the Board since that time. Mayor Secor announced his appointment of Mr. Roy R. Ayres as a member of Sunset Hills Cemetery Board to fill the unexpired term of Miss Bogert, the expiration date of said term being January I, 1953. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that this appointment be approved and confirmed and the motion was carried by the following Aye and No vote; tho s e vo ting Aye I being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none. Policy re Bill Boards and Signs The situation as to erection of bill boards in the city was discussed. City Attorney Lovelace reviewed the publication and model ordinance on this subject put out by the National Institute of Municipal Law Officers. Special question has arisen because bill boards have been erected on property at Babcock and Eighth Avenue, a Business-Residence District, directly on property line. Pending further study and possible adoption of a new sign, awning, marquee, and bill board ordinance, the City Manager and Building Inspector were instructed that, in granting a permit for erection of any ground sign or bill board, the same requirements of the zoning ordinance and building ordinance shall apply as now apply to any other building or structure and special attention shall be given to required yard spaces. Contract for W & C 1952 The contract of A. Tobin for the construction of Miscellaneous Walks and Curbs, 1952, was presented. The contract was approved as to form by the City Attorney, who stated that the necessary performance bond had been prepared and approved, and was in the process of being executed by the I bonding company. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman, subject to the filing of the approved performance bond, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Secor, Comndssioner Erwin and Commissioner Lowe; those voting No, none.
