The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, January 30, 1952 at 1:00 o'clock P. M. Fresent were Mayor Secor,
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelace, and the Afj ting
Clerk when the following proceedings were had:
1 Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those
voting No, none.
Poppy Sale - American Legion Auxiliary
A letter from Mrs. Joe Ambrose, Poppy Chairman, American Legion Auxiliary, was presented requesting
that this organization be permitted to sell poppies on the streets of Bozeman on May 24, 1952. I twas
moved by Commissioner Lowe, seconded by Commissioner Erwin, that this request be granted, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin
and Commissioner Lowe; those voting No, none.
Further discussion - Baxter Cabaret
Mr. R. B. MacNab was present and stated that he wished to clarify the plans of the Board of
Directors of the Baxter Hotel if their request for permission to oferate a cabaret was granted. These
plans propose considerable enlargement of the present cocktail lounge and the utilization of a large
portion of the present lobby. As this remodeling would entail a considerable expenditure, he felt
that a definite commitment must be made as to the legality of the operation before the hotel board
I would feel the proposed remodeling justified.
The matter was discussed at length by the Commission, and it was felt that no definite commitment
could be made on the basis of the present ordinances. While the present Commission could make a state-
ment concerning its interpretation of the ordinances, there would be no aSsurance that future Commissions
would hold to this interpretation. It was therefore moved by Commissioner Lowe, seconded by Commissioner
Erwin, that the Commission take no action on the request of the Hotel Baxter, and that the c ann ic ting
portions of the applicable City Ordinances be considered with the intent of amending them so as to
clearly state the nature of the restriotions desired, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting
No, none.
Stimson-McCay Lots - Abstract - Clearing Title
City Attorney Lovelace, having reported that, at the time the city entered into the lease and
option contract for the Stimson-McCay property at the corner of Black and Olive Street, there were
certain deficiencies in the title, he now presented the abstract to show that these deficiencies have
been cleared by proper court action. He was instructed to return the abstract to the Commercial
National Bank to be replaced in escrow with the contract and deed covering this property.
.1 Request for Driveways - Crenshaw Apartments
B. M. Crenshaw appeared before the Commission to request authority to construct driveways on
Babcock Street in front of the Crenshaw Apartments. He had previously made request to the City Manager
to have parking prohibited in front of the entrance to this building and that request was denied. Mr.
Crenshaw was informed that, before the Commission would make any decision on his request for driveways,
he should present a drawing or plan to show exactly what he proposes to do.
Adjournment
There being no further business to come before the Commission at this time, it was moved by

Commissioner Secor. seconded by Commissioner Erwin. that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe
and Commissioner Erwin; those voting No. none.
