The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday afternoon. February 13. 1952 at 1:00 o'clock F. M. Present were Mayor Secor.
Commissioner Lowe. Commissioner Erwin, City Manager Henderson. City Attorney Lovelace. and the Clerk
when the following proceedings were had;
1 Minutes of the last regular session were read, and it was moved by Commissioner Lowe. seconded by
... Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those
voting No, none.
Business License for Greyhound Lines
The District Representative of the Greyhound Lines. Inc. has made inquiry about the city business
license and has questioned the liability of his company for such license because of the new state law
that became effective January, 1952, which states that municipalities are prohibited from levying any
additional tax upon common carriers other than provided in the state law. which in this case would
prohibit the city from licensing their buses.
After consideration. the Manager was instructed to write Greyhound Lines, Inc. and inform them
that the city business license covers the maintaining of an office and business establishment in the
city which requires police, fire and health inspection. is not a license on the operation of their
busses, and therefore should be paid.
Renewal of Gas & Plumber's Bond - J. S. Budd
Continuation certificates of J. S. Budd's Gas Fitter's bond in the amount of $2.000.00 and
I Plumber's Bond in the amount of $500.00 were presented. The certificates were approved as to form by
the City Attorney. It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the
certificates be approved and accepted ani the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Secor. Commissioner Erwin and Commissioner Lowe; those votinr, No. pone.
Surety Bond Acceptable in Lieu of Cash Bond for Moving
The Manager reported that inquiry has been made relative to a business of constructing houses on
an as)Fmbly line basis and later moving them onto lots. The question of a bond to cover moving of
such houses was considered. After discussion, the Commission decided that. if the plans for the houses
are acceptable and confoMn with city ordinances. a surety bond of not less than $1.000.00 with a
reputable bond company would be looked upon with favor in lieu of the cash bond normally required to
be posted with an application for a moving permit.
Traffic Ordinance Discussed
Fred and Arnold Kessler of the Kessler Dairy were present to discuss the section of the new
traffic ordinance pertaining to parking commercial vehicles on ci~ streets.
Opening of Sla.ughter House Road Requested
Mrs. Lillian Gardner Young appeared.before the Commission to ask that the roadway known as the
1 "Slaughter House Road" beginning at the northeast part of the city and going eastward toward her
property be re-opened. No action was taken.
Application for Beer -License
The application of the Fark Ice & Cold Storage for a wholesale beer license was presented. It
was moved by Commissioner Erwin, seconded by Commissioner Lowe. that the application be approved
and the license issued and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Reports
The following reports for the month of January, 1952 were presented:

It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Secor, Commissioner Lowe and Commissioner Erwinj those voting No, none.
Annual Meeting of Bozeman Creek Reservoir Company
It was announced the annual meeting of the Bozeman Creek Reservoir Company would be held at 1
the City Hall, February 18, 1952.
Work Project of LCA Fraternity
The Lambda Chi Alpha Fraternity proposes that in lieu of their usual initiation, they a re look-
ing for a work project on which their initiates can put in at least one half day of work. They offer
the services of twelve or more men to work on any project which the City may propose on February 23,
1952.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn and the m~tion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe and
Commissioner Erwinj those voting No, none.
