The Commission of the Ci ty of Bozeman met in regula r session in the Commission Room, e Hy Hall
Building, Wednesday afternoon, April 9, 1952 at 1:00 o'clock p. M. Present were Mayor Secor.
Commissioner Lowe. Commissioner ~rwin. City Manager Henderson. City Attorney Lovelace. and the Cle rk
when the followinr:; proceedings were had:
1 Minutes of the last regular session were read, and it was moved by Commissioner Lowe. seconded
by Commissioner Erwin, that the minutes be af-.,proved as read. and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe;
those votinf" No. none.
North House Street Part of Federal Highway System
It was reported the. t Troy Carmichael, State Highway Enrineer. had made a statement at a recent
meeting in Bozeman that State Higlway and Federal Funds for the improvement of Rouse Street could
be made available if Rouse Street was part of the Federal Hif!,hway System. and that it could be put
on the Federal Highway Sys tem by a request to the Highway Commi ss ion. After disc1)_sS ion, the City
Manager was instructed to write the State Highway Department to f';et the necessary information on pro-
cedure to follow to have Rouse Street made a part of this federal system.
Apartmerd;s in Basement 317-19 West Beall
The matter of construction of basement apartments by Clyde Hushing in the residence buiLdinr,
which he is completing at 317-19 West Beall Street was discussed. Inspection of these premises shows
that cupboards. s inks and other facUi ties to make two basement apartments have been built since
January , 1952 when an appeal by Mr. Rushing was heard before the Board of Adjustment and denial of a
I permit for such construction was upheld. It was moved by Commissioner Lowe, seconded by Mayor Secor,
that the City Attorney be instructed to serve official notice on Mr. Rushin~ that the leasing by him.
or any future owner of these premises, of these basement rooms as separate apartments or the occupancy
of them as apartments or separate family livin!': quarters will constitute a violation of the zoninf
ordinance and that action will be taken against the owner and/or occupants as required by such ordinance
and the motion was carried by the following Aye and No vote: those voting Aye bein~ Mayor Secor.
Commissioner Erwin and Commissioner Lowe; those voting No, none.

The following reports for the month of March, 1952 were presented:
Director of Finance Recreation Director Sanitary Inspector Cemetery Board
It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that the reports be accepted
and ordered filed and the mot ion was carried by the following Aye and No vote: those votin~ Aye beinr,
Mayor Secor, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Traffic Ordinance -- He farking oXl WronG Side of Street
L. W. Keller and Hobert Hoadley appeared before the Commission to discuss that part of the
traffic ordinance which Frohibi ts driving or parking on the wronf side of the street. They stated
1 that they both deliver milk and the strict enforcement of this regulation works a hardship on them
because of the additional time required in making deliveries. They were informed the rep:ulation was
being enforced to help prevent accidents and because of complaints that come to the office. The
Commissiori stated they would give the matter further consideration.
Maintenance of Beautjiication Project on North Seventh
The Manag:er rel>orted a proposal by George Barrett, District Maintenance Enf!ineer of the State
Highway Commission for the City of Bozeman to take over the maintenance of the Beautification Project
on North Seventh Avenue which was constructed and has been maintained by the Hifhway Department.

After discussion. it was decided that the City could not maintain this parking on North Seventh
Avenue wi thout the cost being assessed against the adjoining property and. to do this. a parking
maintenance district would have to be established.
Continuation Certificate - Gas &; Plumbing Bond
The continuation certifi.cate for a Gas Fitter's bond and a Flumbing bond for Frank J. Trunk were
presented. The certificates were approved as to form by the City Attorney. It was moved by Commis- 1
sioner Erwin, seconded by Commissioner Lowe. that the certificates be accepted and approved ,and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner
Erwin and Commissioner Lawe; those voting No. none.
Adjournment
There being no further business to come before the Commission at this time. it was Ill'wed by
Commissioner Lowe. seconded by Commissioner Erwin. that the meeting adjourn and the Illotion was carried
by the following Aye and No vote; those voting Aye bein~ Mayor Secor. Commissioner Lowe and Commi.s-
sioner Erwin; those voting No. none.
