SUBJECT: Right of Way Acquisition Project – Amendment #1 to Task Order Number 10.
MEETING DATE: June 5th, 2017

RECOMMENDATION: Approve and authorize the acting City Manager to sign Amendment #1
to Task Order Number 10.
BACKGROUND: Attached is a copy of the partially executed Amendment #1 to Task Order
Number 10 with Dowl for the Right of Way Acquisition Project for parcels on Baxter Lane
between Ferguson and Cottonwood.
Task order 10 included the acquisition of right of way from the parcels on the north side of
Baxter between Ferguson and Cottonwood. Our consultant Dowl, worked with the property owners, but was unable to come to an agreement to obtain the necessary right of way to complete
the full street section. The scope of the project was revised to eliminate the sidewalk for now on
the north side between Flanders Mill and Cottonwood. Those properties will need to install the
sidewalk themselves when they develop. Even with the revised section, a few easements are
necessary. Temporary construction easements are required to connect the driveways to the new curb on the north side. This amendment will add the services necessary to obtain those
easements.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission
FISCAL EFFECTS: The proposed fee for this scope of work is paid on a time and materials basis with a total cost not to exceed amount of $10,375.00.
