The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, May 7, 1952, at ltOO o'clock P. M. Present were Mayor Secor,
Commissioner Lowe, Commissioner Erwin, City Manager Henderson, City Attorney Lovelaoe, and the Clerk
when the following prooeedings were hadt
I Minutes of the last regular session held April 30, 1952 and of the special meeting held May 2,
1952 were read, and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes
be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Seoor, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Claims for the Month
Claims, Nos. 3571 to 3805 inclusive, were presented on the various funds as follows:

I The Manager stated he has audited these claims and finds them to be true and lawful claims against
The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the
cla~8 in detail by the City Commission, it was moved by Commissioner Erwin, seconded by Commdssioner
Lowe, that the clainus be approved and warrants drawn for their payment, and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Seoor, Commdssioner Erwin and Commissioner
Lowe; those voting No, none.
Reports
The following reports for the month of April, 1952 were presented:
Cashier Librarian Plumbing Inspector
Cemetery Board Chief ot Police Sanitary Inspector
Building Inspeotor Xecreation Director

and the reports of the Building Inspector and the Plumbing Inspector for the months of January, February
and Karch, 1952.
It was moved by Commissioner Lowe, seoonded by Commissioner Erwin, that the reports be acoepted
and ordered filed and the motion was oarried by the following Aye and No vote: those voting Aye being
Mayor Secor, Commissioner Erwin and Commissioner Lowe; those votillg No, none.
Bond of Cashier Henry
I The bond of Donald L. Henry, Cashier and Water Collector, in the amount of '2,000.00, was presented.
The bond was approved as to form by the City Attorney, whereupon, it W88 moved by Commissioner Erwin,
seconded by Commissioner Lowe, that the bond be approved and acoepted and the motion was carried by the
following Aye end No vote; those voting Aye being Kayor Secor, Commissioner Erwin and Commiss ioner
Lowe; those voting No, none.
Maintenance Agreement for U. S. 10 & 191
The Maintenance Agreement between the State Highway Commission and the City of Bozeman was presented.
The Highway Commission will maintain U. S. Higbway,Nos. 10 and 191 within the city limits of Bozeman,

exoept for snow removal. sanding, ~eeping and flushing op&rations. which remain the oblScation of
the City. It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the agreement be
approved and signed by the Commissioners and the Clerk of the Commission for the City of Bozeman,
and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Secor.

Miscellaneous W & C 1952
The written report of sidewalk inspection and recommendations with referenoe to needed oonstruo- I
tion of new walk for the year 1952 was presented and examined. Inspeotion of the proposed new oon-
struction of sidewalk having been made and considered, it was moved by Commissioner Lowe, seoonded by
Commissioner Erwin, that the report covering the oonstruction of Mise. W & C 1952 be and the same is
hereby aocepted, approved and adopted and the report of the needed new construction be made a part of
this minute entry by such adoption, and the Clerk of the City Commission be ordered to notify the
proper~ owners to have the same constructed as required by law, and the motion was carried by the
following Aye and No vote. those voting Aye being Mayor Secor, Commdssioner Lowe and Commissioner
Erwin; those voting No, none.
Licenses - Re: Peddlers
A committee from the Chamber of Commerce oomposed of Ken Sullivan, Harry Miller, Erwin Krejci,
Joe Wantulok, Wm. Hanshaw, and wm. Stutsman were present to disouss city licenses tor peddlers.
The gentlemen were infor.med that the city now collects lioenses from peddlers when it is entitled
to do so, but a lio80se which is disor~inatory is not enforceable, and therefore has not been adopted
by the city. Persons selling produce grown or raised on their own premises are not subject to a city
license. The adoption of a "Green River" Ordinanoe or a Nuisance Ordinance would not prohibit the

soliciting by telephone.
They concluded that it was a problem that could not be solved solely by legislation, and all
merchants should try to meet their own competition.
The Commission stated they would write a letter to the committee. stating the present situation
for lioensing peddlers, and that the City Commission is willing to study the ordinance further and will
oonsider amendments or recommendations which are aooeptable and enforceable.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn and the motion was oarried
by the following Aye and No vote; those voting Aye being Kayor Secor, Commissioner Lowe and Commis-
sioner Erwin; those voting No, none.
