The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday afternoon, June 25, 1952 at 1,00 o'clock P. M. Present were Mayor Secor,
Commissioner Lowe, Commissioner Erwin. City Manager Henderson, City Attorney Lovelace, and the Clerk
when the following proceedings were had,
I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote, those voting Aye being Mayor Secor, Comndssioner Erwin and Commissioner Lowe;
those voting No, none.
Request for Building on Used Car Lot
Mr. Bob Freck and Mr. L. L. Christenson, representing Lundgren Ford, Inc.. were present to
request that an exception be made to the building code to permit them to move a frame building, 8' X 20'.
onto the used car lot, at the corner of Black Avenue and Babcock Street, for use as a used car salesmen's
office. This location is in Fire Zone No. 1 where minimum requirements under the building code are
that exterior walls of buildings must be of 4 hour fire resistive rating. From information given by
the applicants, it appeared that the building proposed to be moved would become a permanent building
when it was located on this lot. The Commission reviewed similar requests made during recent years
and found that, in two cases, requests had been granted to locate small temporary buildings on used
car lots within the Fire Zones. In each of those cases certain requirements were made relative to the
distance from other buildings at which the temporary buildings could be placed.
The City Manager was instructed to secure further information regarding this request and the
I matter was taken under advisement pending reoeipt of such information.
Fire Insurance Values on Motor Vehicles
A proposed schedule of values on city motor vehioles for 1952 on which to base a renewal of fire
insuranoe was presented. After examination of the sohedule by the City Commission. it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the schedule be approved and the motion was
oarried by the following Aye and No votez those voting Aye being Mayor Secor, Commissioner Erwin and
Commissioner Lowe; those voting No, none.
Removal of Oil Mixing Bed
The Manager stated that Homer Fisher, as oustodian of Gal~tin County Fair Grounds, has reported
that he has been instruoted by the Gallatin County Fair Board and Gallatin High School Board to request
the City to move its gravel and oil mixing operations now carried on near the Community Cannery at the
Fair Grounds. Keasons given for the request were that odors from the asphalt were objeotionable to
persons using the cannery and had, on oocasion, aff.cted the taste of produce being canned. Mr. Fisher
had suggested a location on the west side of the Fair Grounds to which these operations could be moved.
It is estimated that it will oost at least 11,000.00 to develop a new gravel mixing bed and. if this
I was done on some other part of the Fair Grounds. there is nothing to insure that such a location would
be permanent. The Manager stated that after oonsultation with the City Engineer and Street Superintendent
and examination of possible sites for suoh operations. it is recommended that a gravel and oil mixing
bed be developed on city owned ground near the oi~ dump and adjacent to the unused sewage settling basin.
This recommendation was approved.
Schrieber Confirmed as Folice Officer
A communication from the Chief of Police was read which stated that Harry Schrieber has oompleted
his probationary period as a policeman and recommended that he be confinned as a permanent member of
the Polioe Department. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that Folice

Officer Schrieber be confirmed as a permanent member of the Police Department and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Seoor, Commissioner E~in and
Commissioner Lowe; those voting No, none.
Firemen's Convention
It was announoed that the annual Firemen's Convention will be held in Miles City, July 17 to 19,
1952. Fire Chief MoCrosson and Fireman Huber have been chosen by the members of the Fire Department

as their representatives at this oonvention. It was moved by Commiss ioner Erwin, seoonded by Commia sioner
Lowe, that it being in the public interest, Chief McCrosson and Fireman Huber be authorized to attend
this oonvention, and the expenses of one of them be paid from the General Fund, and the expenses of
the other to be paid by the Firemen's Association and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Seoor, Commissioner Erwin and Commissioner Lowe; those voting
No, none.
Replacing Fence along Dudley's First Addition
The Manager reported that in the platting of Dudley's First Addition, and the opening of the
alley going south from College Street, a fence had to be torn down. Mr. Dudley has requested that this
fence be replaoed by the City. After discussion, the Commission was of the opinion that it is not the
City's responsibility to move or replace this fence.
Culvert at Hemlock & Seventh Avenue
Mr. Myron Westlake, DurstonRoad, appeared and stated the culvert placed aoross Hemlock Street at
Seventh Avenue by the City is not of sufficient size to oarry all the water needed at his property
during irrigation time, and that it causes water to back up and flood property in this vicinity. He
asked that the culvert be replaced with a larger one. The Manager was instruoted to take neoessary I
steps to correct this situation.
Opening of Alley in Block C. Original Townsite
The matter of opening an alley in Block C, Original Townsite, was considered. The City Attorney,
having investigated this matter, stated that, in his opinion, the oity has no obligation to aoquire
ground for street or alley purposes but that, if ground is dedicated or deeded for suoh purposes and
acoepted by the City, the City does thereby assume responsibility for opening or making such streets
or alleys passable and usable. Referring to the alley in question where, if ground was deeded or
dedicated to provide an alley through the block, a bridge across Bozeman Creek would have to be built
to make such an alley passable or usable, the City could and should, in his opinion, build the bridge.
After disoussion. it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City
Manager be and is hereby authorized to notify owners of property in this Block C, that, if they secure
deeds to or dedioation of sufficient ground to provide a satisfactory alley twenty feet in width
through the block, the City will construct the necessary bridge aoross Bozeman Creek to make the alley
passable and usable and the motion was carried by the following Aye and No vote: those voting Aye

Adjournment I
There being no further business to come before the Commission at this time, it was moved by
Commissioner Erwin, seconded by Commissioner Lowe, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Low~ and Commis-
sioner Erwin; those voting No, none.
