The Commission of the City of Bozeman met in regular session in the Commission Room,' City Hall
Building, Wednesday afternoon, July 9, 1952 at 1:00 o'clock F. M. Present were Mayor Secor,
Commissioner Erwin, Commdssioner Lowe, City Manager Henderson, City Attorney Lovelace, and the Clerk
when the following proceedings were had:
I Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe,
those voting No, none.
Sewer Line on Curtiss to South Twelfth
Mr. Theo. C. Seavy, owner of Lots 1 to 4, Block 7, West Side Addition, appeared before the
Commission to discuss construction of a sanitary sewer to serve his property. The nearest point at
which the property can be connected to the sewer is on Curtiss Street at the alley between 11th and
12th Avenues. Mr. Seavy will consider extending the sewer west in Curtiss Street at his expense but
felt that, if he did so, other properties which might later be connected to this section of sewer
should re-imburse him on a pro-rata basis for his cost of constructing this sewer. The City Engineer
was instructed to determine on a square foot basis the properties which might utilize the proposed
sewer and the City Attorney was instructed to prepare a contract between Mr. Seavy and the City of
Bozeman, the general terms of which are to be as follows:
1. Mr. Seavy will be permitted to construct the proposed sewer in Curtiss Street at his
expense.
I 2. The sewer will be built according to plans prepared by and under the supervision of
the City Engineer.
3. When completed, this section of sewer will become part of the sewerage system of the
City of Bozeman and will be the property of the City.
4. For so long as Mr. Seavy owns the said Lots 1 to 4, Block 7, West Side Addition, no
other owner of property abutting on or which can be directly served by the section of
sewer which will be built by Mr. Seavy, will be permitted to connect to said sewer
until he has re-imbursed Mr. Seavy on a pro-rata basis according to the ratio of the
area of the property to be connected to the area of all property which can be served
by this sewer.
Water Rights for Sewage Flant Site
The Manager reported that, at the time of the purchase of the site for the sewage treatment plant,
the water rights decreed with the property were not transferred with the land. He presented a quit
claim deed from Paul G. and Nora Smith conveying seven miners' inches of water which were originally
decreed from Bozeman Creek with this land to the City of Bozeman. It was moved by Commissioner Erwin,
seconded by Commissioner Lowe, that the deed be accepted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowe, those
voting No, none.
Traffic Violations of Out-of-Town Cars
I Wm. Stutsman, Secretary-Manager of the Chamber of Commerce, appeared before the Commission to
discuss the city's policy on ticketing out-of-town cars for parking violations and the advisability
of issuing courtesy tickets.
Mr. Stutsman was informed that these questions have been given much consideration, that some
difficulty does arise over cars which are parked all night because of interference with street
cleaning and snow removal operations, and that so-called courtesy tickets for out-of-town owners defeat
the purpose of parking turn-over for which parking meters were installed. Every possible consideration
is given to tourists and out-of-town car owners but the whole problem is one which requires co-operation
between the Police Department, Hotel Owners, Business men and the car operators themselves.

Confirmation of Foliee Officer Weir
A communication from the Chief of Folice was read stating that Douglas C. Weir has completed
his probationary period and recommending his confirmation as a regular member of the Folioe Depart-
ment.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe. that the oonfirmation of
Douglas C. Weir as a regular member of the Foliee Department be approved and the motion was carried I
by the following Aye and No vote: those voting Aye being Mayor Seoor. Commissioner Erwin and Commis-
sioner Lowe; those voting No. none.
Fire Relief Claim
Claim No. 4251 in the amount of $5,610.29 for payment of monies to the Bozeman Fire Department
Relief Association was presented. It was moved by Commissioner Lowe. seconded by Commissioner Erwin,
that the claim be approved and a warrant drawn for its payment and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin and Commissioner
Lowe; those voting No. none.
Application for Carnival Lioense - VFW
An application of the V. F. W. Club for a carnival license for Hill's Greater Shows to show
six days beginning July 14th. 1952 was presented and read. It was moved by Commissioner Lowe.
seconded by Commissioner Erwin. that the application be approved and the lioense issued and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Erwin
and Commissioner Lowe; those voting No. none.
Reports
The following reports for the month of June. 1952 were presented: I

It was moved by Commissioner Erwin. seconded by Commissioner Lowe. that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Secor. Commissioner Erwin and Commissioner Lowe; those voting No. none.
Adjournment
Th~re being no further business to come before the Commission at this time. it was moved by
Commissioner Lowe. seconded by Commissioner Erwin. that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor. Commissioner Lowe and
Commissioner Erwin; those voting No. none.
