The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, August 6, 1952 at 1:00 o'olock P. M. Present were Mayor Seoor,
Commissioner Erwin, Commissioner Lowe, City Manager Henderson, City Attorney Lovelaoe, and the Clerk
when the following proceedings were had:
I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Seoor, Commissioner Erwin and Commissioner Lowe} those
voting No, none.
Claim of Haggerty-Messmer -- West Sanitary Trunk Sewer
Claims Nos. 4447 and 4448 of Haggerty &: Messmer Company, in the amount of $5,609.97, 'for the
final payment on the oontraot to construct the West Side Sanitary Trunk Sewer was presented. The City
Engineer reports that the contract has been oompleted except for some minor levying in fields which
cannot be oompleted until orops have been harvested. On oonsideration of the reliability of the
contractor, and on their agreement to do the ground leveling required for full completion of the con-
traot, it was moved by Commissioner Lowe, seoonded by Commissioner Erwin, that this final estimate be
approved and accepted, and the motion was oarried by the following Aye and No vote: those voting Aye
being Mayor Secor, Commissioner Erwin arid Commissioner Lowe} those voting No, none.
Claims for the Month
Claims Nos. 4251 to 4487 inclusive were presented on the various funds as follows:

The Manager stated he has audited these olaims and finds them to be true and lawful claims
against the City of Bozeman, and recommends that warrants be drawn for their payment. After examination
of the claims in detail by the City Commission, it was moved by Commissioner Lowe, seconded by Commissioner
Erwin, that the claims be approved and warrants drawn for their payment, and the motion was oarried
by the following Aye and No vote: those voting Aye being Mayor Seoor, Commissioner Erwin and Commis-
sioner Lowe; those voting No, none.

The following reports for the month of July, 1952 were presented:

It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Secor, Commissioner Erwin and Commissioner Lowe} those voting No, none.
Resolution No. 719 -- Tax Levy
Resolution No. 719, setting the tax levy for the year 1952-53 at 37 mills was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DETERMINING THE AMOUNT OF CITY
TAXES FOR ALL PURPOSES, GENERAL AND SPECIAL, TO BE LEVIED AND ASSESSED ON TAXABLE
PROPERTY IN THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE FISCAL YEAR ENDING JUNE

It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Secor, Commissioner Erwin and Commissioner Lowej those voting No, none.
Bids for Dump Truck
A tabulation of the bids received on July 30, 1952 for a dump truck for the Street Department
was presented. The bid of the Northern Auto Company for a Chevrolet truck in the net amount of I
$3,024.00 being the lowest and best bid, it was moved by Commissioner Lowe, seconded by Commissioner
Erwin, that the bid be accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Secor, Commissioner Erwin and Commissioner Lowej those voting No, none.
Pumping Water From Basement -- Gee, North Grand
The Manager reported that, in May, 1952, during a period of heavy rain, the sanitary sewer on
Tamarack Street beoame overloaded causing sewage to baok up into the basement of Mrs. Tom Gee, 809 No.
Grand Ave. The City of Bozeman placed pumps in operation to relieve the situation but it was necessa~
for Mrs. Gee to hire an additional pump to prevent damage to her property. The cost of such pump
hire was approximately $18.00 and Mrs. Gee cites other damage, resulting from the flooding, of approx-
ima tely $40.00. After consideration qy the Commission, it was moved by Commissioner Erwin, seconded
by Commissioner Lowe, that, upon presentation of proper claim, Mrs. Gee be reimbursed for the pumping
cost incurred but not for any damages claimed and the motion was oarried by the following Aye and
No vote; those voting Aye being Mayor Seoor, Commissioner Erwin and Commissioner Lowej those voting
No, none.
Cleaning Up Froperty, Tenth & Story
The Manager reported that, on property at the corner of Story Street and Eleventh Avenue leased I
by H. L. Norine of Norine Motors, Inc., there is debris scattered on the lot and on adjaoent street
area, weeds are not out, and the premises are in a very unsatisfactory oondition. He stated further
that, on two ocoasions within the past thirty days, he has talked to Mr. Norine personally about these
conditions and, on both occasions, Mr. Norine has agreed to have the place oleaned up immediately
but little or nothing bas been done to clean it up. After discussion, the Manager was instructed to
give Mr. Norine writ ten notice that, unless these oonditions are oorreoted wi thin fi va days, aotion
will be taken against him in accordance with the laws applicable in such cases.
Agreement -- Sewer Construotion -- Seavy
The City Attorney as instructed has prepared an agreement between the City of Bozeman and Theo
Seavy for the installation of a sanitary sewer in Curtiss Street from his property to the alley between
Eleventh and Twelfth Avenues. The agreement having been prepared along the lines disoussed at the meet-
ing of July 9, 1952, it was moved by Commissioner Lowe, seoonded by Commissioner Erwin, that the Mayor
and Clerk of the Commission be authorized to sign the agreement for The City of Bozeman, and the
motion was oarried by the following Aye and No vote: those voting Aye being Mayor Seoor, Commissioner

There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seoonded by Commissioner Erwin, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Secor, Commissioner Lowe
