The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, August 1, 1951 at 1:00 o'clock P. M. Present were Mayor Lowe,
Commissioner Secor, Commissioner Healy, Ci~ Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded
by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Lowe" Commissioner Secor and Commissioner Healy;
those voting No, none.
Reconstruction of South Eighth Avenue
CorresporJdence between the State Highway Department and the City Manager regarding the reconstruc-
tion of South Eighth Avenue was reviewed and disoussed. The City Commission decided that, in order to
olarify questions concerning this improvement, the City Manager be instruoted to arrange for another
conference with the State Highway Commission at the earliest praoticable date.
Restrictions on Water Usage for Irrigation
The Manager reported that, as Director of Public Safety, he issued official notice on July 27th
restricting the use of water for irrigating purposes to eight hours a day.
Request for Irrigating Privilege
Mr. Earl Jennings, 1310 South Third, appeared to ask pe~ission to irrigate his newly planted
lawn during restricted hours. He was info~ed that exoeptions to the restrictions for irrigating
could not be made and his request was therefore denied.
Bids for West Trunk Sewer
The bids for the construction of the West Sanitary Trunk Sewer received on July 25th, 1951,
were oonsidered further at this time. City Attorney Lovelace reported that, in his opinion, the bid
of the Studer Construction Company of Billings was legally insufficient due to the faot that Mr.
Studer failed to sign the bid bond and therefore oould not be required to sign a contract. Mr. J. A.
Maierle and Harold Eagle, of Morrison-Maierle, Ino., Consulting Engineers, stated the bid of the
Studer Construotion Company was approximately 10.8% below their estimate for this projeot, and stated
furthe~ that if the job was completed satisfaotorily, it is very doubtful if there would be a reason-
able profit left for the constractor.
It was thereupon moved by CommiSSioner Healy, seconded by Commissioner Seoor, that in view of
the statements of' the City Attorney, and the Consulting Engineers, the bid of the Studer Construction
Company be rejected, and the motion was carried by the following Aye an d No votea those voting Aye
being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
The bid of Haggerty-Messmer Company of Bozeman in the amount of' $49,512.00 being the next lowest
bid for this projeot, it was moved by Commissioner Healy, seconded by Commissioner Seoor, that this
bid be aocepted, and the City Attorney be instruoted to prepare the neoessary bond and oontraot, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner

Easement for West Trunk Sewer -- N. F. Railway
An agreement between The City of Bozeman and the Northern Pacific Railway Company for the two
railway crossing right-of-ways for the West Sanitary Trunk Sewer was presented. The agreement having
been examined by !e Consulting Engineers, the City Engineer, and arproved as to form by the Ci~
Attorney, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the Mayor and the
Clerk of the Commission be authorized to sign the agreement for The City of Bozeman and the motion was

carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor
and Commissioner Healy; those voting No, none.
Appointment of Judges & Clerks for 1951 Elections
The City Commission announced the appointment of the following Judges and Clerks for the

Commission notify the above named persons of their appointment to the City Election Board, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Secor and Commissioner Healy; those voting No, none.
Fire Hydrants at Commission Yards

A request from M. C. Story for the installation of two fire hydrants for fire protection at the
Livestock Commission Yards northeast of the City was read. After consideration, action was deferred
pending the working out of further details.
Offer of Payment for Fire Call
An offer from M. C. Story of $250.00 for the fire call made to the Bozeman Livestock Commission
Yards was read. It was moved by Commissioner Healy, seconded by Commissioner Secor. that the offer
be accepted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Miscellaneous W & C 1951 -- J. C. Urquhart
Mr. J. C. Urquhart, 402 West Cleveland, was present in regard to an order to construct a
sidewalk on the east side of his proparty along F'ourth Avenue. He stated that because Fourth Avenue
is a narrow street and of the few homes the walk would serve, he would like permission to build a
narrower walk than ordered and also set the walk so as to have an extra one foot of street area for
his yard in order not to tear up his present landscaping. The Commission stated the matter would be
taken under advisement for a week.

Compl aint -- Violation of Zoning Ordinance
The Manager reported that Peter Alberda, 412 West College. has moved a garage on his property
which does not comply with the zoning ordinance. He has notified Mr. Alberda that the garage must be
moved to comply with the Zoning Ordinance and he has done nothing about it. It was moved by Commis-
sioner Healy, seconded by Commissioner Secor, that the City Attorney be instructed to file a complaint
against Mr. Alberda for violation of the Zoning Ordinanoe and the motion was carried by the following
Aye and No vote. those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those
voting No, none.

Public Hearing -- Appropriation Ordinance
The Manager stated this was the time and place set for public hearing on the annual appropriation
ordinance for the fiscal year ending June 30. 1952. He presented the affidavit of publication of the
Notice of Hearing. and stated no inquiries have been made or protests filed, and no one is present to
protest. It was moved by Commissioner Secor. seconded bY Commissioner Healy, that the Appropriation
Ordinance be published as required by law. and the motion was carried by the foll~ing Aye and No vote:
those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No, none.

After examination of the payroll, it was moved by Commissioner Healy. seconded by Commissioner
Secor, that the claims be approved and warrants drawn for their payment, and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commil-
sioner Healy; those voting No, none.
Easement for Trunk Sewer -- Jessie Francis
A right-of-way easement across the property of Jessie Francis for the West Sanitary Trunk Sewer
was presented. The easement having been prepared by the City Attorney, it was moved by Commissioner
Healy. seconded by Commissioner Seoor, that the Mayor and the Clerk of the Commission be authorized
to sign the easement for The City of Bozeman, and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner Healy; those voting
No. none.
Abstracts for Water Rights
The Manager reported the City does not have abstracts for the water rights they own in Mystic
Lake. Bozeman Creek. and Lyman Creek, and recommended employing the Gallatin Abstract Company to
prepare abstracts oovering these water rights. It was moved by Commissioner Healy, seconded by
Commissioner Secor, that the recommendation of the City Manager be approved and the motion was oarried
by the following ~e and No vote; those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner
Healy; those voting No, none.
Fay for Drafted Firemen and Firemen Outside City Limits
Reoommendations of the Acting Fire Chief presented at the last regular Ineeting regarding the pay-
ment of men drafted to help fight fires and the payment of firemen called to fires outside the city
limits was considered.

It was thought that a definite policy covering all cases could not be established, and that
each oase would be handled individually.
Reward for Police Officer Krueger
The Manager reported the Farmer's Union Grain Terminal Association has offered a $25.00 reward
to Police Sergeant Louis Krueger for his work in solving a robbery and capturing the criminal at

their plant on July 27, 1951. The Manager stated he was approving the reward to Sergeant Krueger.
Contract for West Trunk Sewer
The contract of Haggerty-Messmer Construction Company for the oonstruction of the West Sanitary
Trunk Sewer was presented. The contract was approved as to form by the City Attorney, whereupon. it
was moved by Commissioner Secor, seconded by Commissioner Healy, that the Mayor and the Clerk be
authorized to sign the contract for The City of Bozeman, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Lowe", Commissioner Secor and Commissioner Healy; those
voting No, none.
Policy Regarding Folioemen frobation Period
At the request of the City Manager, the Chief of Police met with the Commission to discuss
policy pertaining to polioe personnel. A particular point in question was whether or not exoeption
should be made to the present policy whereby polioemen are employed on probation the first six months
at a salary less than that paid regular polioemen. It was the opinion of the Commission that no
change should be made at this time in the present policy.
Donation of Law Books to Municipal League
The City Attorney informed the Commission that he has a set of MacQuillan Municipal Law books

which have become obsolete by reason of purchase of a later edition of these same books. He
recommended that the obsolete set be donated to the Montana Municipal Lea~ue for their reference
library. His recommendation was approved.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Healy, seconded by Commissioner Secor. that the meeting adjourn, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor
