M. Present were Mayor Lowe, Commis- sioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were he.d; Minutes of the last re~ular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: ti.ose voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Sidewalk -- 402 West Cleveland The request of J. C. Urquhart, 402 West Cleveland, to construct a sidewalk along the east side of his prof-erty a distance of 2! feet from property line was given further consideration at this time. A sketch prepared by the City Engineer, showing; the proposed location of the walk, was studied by the Commission. It was pointed out that the circumstances in this case are unusual as Fourth Avenue is narrower than other streets in the city; it is very unlikely that a walk will be constructed except on the west side of the street and the walk here will serve only a few homes. After consideration, it was moved by Commissioner Secor, seconded by Commissioner Healy, that J. C. Prquha rt be permitted to construct the walk as ordered 2i feet from his east property line from Cleveland Avenue south approximately 70 feet, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Corrnnissioner Secor and Commissioner Healy; those voting; No, none. Claims Claims Nos. 1854, 1855 and 1856 were r-resented as follows: S. D. S. Revenue Fund Weter Fund ~l,800.00 549.07 Total $2,349.07 The Manager stated the claims were subject to a 2% cash discount, and were true and lawful claims against the City of Boz6man and reconmended that warrants be drawn for their payment. After examina- tion of the claims by the Commission, it was moved by Commissioner Healy, seconded by Commissioner Secor, tha t the claims be approved and warrants drawn for their payment and the motion was- carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Conunissioner Secor and Commissioner Healy; those voting No, none. Proposed Srecifications for Fluoridation Proposed specif'icEl.tions and instructions to bidders for the furnishint; fluoridation equipment for the city water supply were presented and read. It was moved by Commissioner Secor, seconded by Commissioner Healy, that upon approval of tile specifications by the State Board of Health, the Clerk of the Commission be authorized to adverti se for bids, and the motion was carried by the following; Aye and No vote~ those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting; No, none. Building -- 221 East Mendenhall An eprlication of Roy Cattrell, 221 East Mendenhall, to construct an addition of pumice blocks to his property was presented. It was moved by Commissioner Healy, sec(:>nded by Commissioner Secor, that the Building Inspector be instructed to issue a permit to Roy Cattrell for the proposed addition, and the n~tion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. I I I t r;. ') a~) Continuation Certificate -- Gas Fitter -- Frank Brown The continuation certificate for the bond of Frank Brown as a Gas Fitter was presenced. The certificate was approved as to form by the City Attorney, whereupon, it was moved by Commissioner Healy. seconded by Commissioner Secor. that the certi ficate be aPI-roved and accepted am the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No. none. I Continuation Certificate -- City Manager Henderson The continuation certificate for the bond of M. E. Henderson as City Manager was I;resented. The certificate was approved a s to form by the Ci tj' Attorney. whereu:pon. it was moved by Commiss ioner Healy. seconded by Commissioner Secor. that the certificate be aIproved and accer-ted and the motion wes carried by the following Aye and No vote: those votin~ Aye being Mayor Lowe. Annual Audit Approved Copies of the annual audit covering the fiscal year ending June 30th, 1951. as prepared by Doughs Wilson, Ferris, Inc., of Great Falls, Montana were presented. It was moved by Commissioner Secor. seconded by Commissioner Healy. that the audit be acceFted and ordered filed and the motion was carried by the following Aye and No vote: those votine; Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Appropriation Ordinance No. 763 -- Final Passage The Manager stated this was the time and place set for the final passage and adoption of the annual appropriation ordinance. He presented the affidavit of publication of the Ordinance. and stated that no protests have been filed and no one is present to protest. He presented Ordinance No. 763. entitled: I AN ORDINANCE AFFROPRIATING MON IES FOR EXFENDITIJRES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETORY REQU IREMEN2S FOR MAnn ENANCE ETC.. OF THE MUNIC!FAL GOVERNM~TT OF; THE CITY OF BOZEMAN. MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1952. It was moved by Commissioner Healy. seconded by Commissioner Secor. that the Ordinance be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none. Resolution FurcLasing Road Oil The Manager stated that approximately 15,000 gallons of road oil would be required for pavement patching and repair. and presented the following resolution authorizing such purchase from the State Highway Commission: RES 0 L UTI 0 N WHERF~ the City of Bozeman. by resolution adopted on April 25. 1951. authorized the purchase by the City Manager from the State Highway Department of ten thousand gallons of road oil, and WHEREAS conditions have develoied which require the use of additional quantities of road oil in the City of Bozeman during the sununer of 1951, an d VfrYEREAS the City of Bozeman does not have proper facilities for procuring and storing quanti- ties of such oils in Bozeman. and I Wh"EREAS the Montana State Highway Commission has quanti ties of road oil of the required types stored in Bozeman from which it may be able to supply the i:nmedia te needs of the City of Bozeman at cost plus handling charge. NOW. THEREFORE, BE IT RESOLVED: That an emergency does exist and the City Manager is hereby authorized to purchase from the Montana State Highway Commission. from its stocks in storage in Bozeman. approximately 15.000 gallons of road oil as required for use in pavement sealing and repair in Bozeman dur- ing 1951. Amendment to Zoning Ordinance -- Ordinance No. 764 The Manager stated the City Attorney as instructed has prepared Ordinance No. 764 amending; the Zoning Ordinance permitting the sale of beer for off-premises consumption in all business and all business - residence districts, together with the zoning of new additions in the city. Commissioner Secor and Commissioner Healy; those voting No, none. Traffic Ordinance Proposed amendments to the Traffic Ordinance were discussed by the City Commission and the Chief of F'olice. Adjournment There being no further business to come before the Commission at this tim9, it was moved by Commissioner Secor. seconded by Commissioner Healy, that the meeting adjourn, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Conwissioner Secor and Commissioner Healy; those voting No, none.
