The Commission of the City of Bozeman !let in regular session in the Commission Room. City Hall
Building, Wednesday afternoon, October 24, 1961 at lIDO o'clock P. M. Present were Mayor Lowe,
Commissioner Healy,Comm.i.sioner Secor, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:

Minutes of the last regular session were read. and it was moved by Commissioner Healy, seconded
by Commissioner Secor, that the minutes be approved as read and the motion was carried by the following
Aye and No votel those voting Aye being llayor Lowe, Commissioner Secor and Commissioner H&alYi those
voting No. none.
Claim - Lovell Clay Products Company
Claim No. 229a of the Lovell Clay Products Company in the amount of 1617.86 was presented. The
)(anager stated the claim was .ubjeot to a 2% cuh discount. Atter exemination of the claim, it was
moved by Commissioner Secor, seconded by Comm.issioner a.dr, tbat the claim be approved and a warrant
drawn for its payment, and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Lowe, Commissioner Secor and Commissioner Healy. those voting No, none.
City's Share of Cost for Repai ring South Eighth
The Manager read a letter from Troy Carmichael. State Highway Engineer, stating that the Ci~'8
share in the eost of material for the repair of South Eighth Avenue was 1418.27. This repair was made
by the City during the past summer for which the materials used were secured from the State Highway
Department under a tentative agreement that the State would fUrnish material for the projeot.
After oonsideration, the Manager was instructed to write to the Highway Commission. giving the

ci~ts cost for labor and equipment for the repair of this street, and ask for a detailed statement of
the Highway Commission's cost before approving tne charge by that department.
Report
The report of the Recreation Director for the month of September, 1951 was presented. It was
moved by Commissioner Seoor. seoonded by Commissioner Healy. that the report be aocepted and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Kayor Lowe.
Commissioner Secor and Commissioner Healy; those voting No, none.
Farsons to Accompany Watershed Patrolman
The Manager brought up the question of the Patrolman on the South Side Watershed taking members of
his family, or other persons as may be necessary, with him on his patrols or when he is carrying out
his regular duties in the watershed. It was explained that, when he is patroling the area, it is often
advantageous for him to have another person with him and there are occasions when he has to take persons
with him to do necessary work on the trails. on fences, and on installations at Mystic Lake, etc. It
was moved by Commissioner Healy, seoonded by Commissioner Secor. that the Patrolman on the South Side
Watershed shall be and 1s hereby permitted to take members of his immediate family. or such other
persons as he deems neoessary. with him while oarrying on his patroling or other duties in the watershed

and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe,
Commissioner Secor and Commissioner Healy. those voting No. none.
Jailing Alcoholios
The matter of removing unoontrollable alcoholics from the hospital to the city jail was discussed.
By agreement with the Deaconess Hospital, the hospital furnishes a written statement to the Police
relative to such persons and it was recommended that approval of this statement in writing should be
secured from the physioian attending the person and that. whenever possible, a signed complaint against
the person should be secured from the hospital authority or other person who requests the Police to
remove the offender from the hospital.

Request for Adjustment in Garbage Assessment
The Manager reported that A. J. Roth, 304 Ida. has asked for an adjustment on his garbage assess-
mente Mr. Roth states that he is gone from his home five months out of each year. After consideration.
the Commission directed that the established rule setting at least a six-months consecutive vacancy
as the basis for making abatement of garbage assessments. should be strictly adhered to and deoided
that no exception should be made in this case.
Adjournment
There being no further business to come before the Commission at this time. it was moved by
Commissioner Secor. seconded by Commissioner Healy. that the meeting adjourn and the motion was
carried by the following ~e and No vote: those voting Aye being Mayor Lowe. Commissioner Healy
and Commissioner Secor; those voting No. none.
