Wednesday afternoon April 25.. 1961 at 1:00 o'clock P. M. Present were Mayor Lowe, Commissioner Secor, Commissioner Healy.. City Manager Henderson.. City Attorney Lovelace and the Clerk when the follow- ing proceedings were had: Minutes of the regular session of .pril 18, 1951 were read ~ld it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe.. Commissioner Secor and Commissioner Healy; those voting No.. none. Fetition to Vacate Streets & Alleys in Werre's Rearrangement Mr. H. B. Landoe was present in the interest of the petition of Mr. Don Corcoran presented at the last regular session requesting the vacation of certain streets and alleys in Werre's Rearrangement of the West Side Addition. Special attention was given to the request of the vacation of the alley in Block 5 of said Rearrange- ment. It was pointed out the proposed residence and landscaping would occupy all the block and there would be no need for utilities in the alley as they are installed in the street south of the proposed building site. It was considered the vacating of the other alley and streets would not be in the public interest.. as they will be needed when and if additions are made to the city to the north and west. It was moved by Commissioner Healy.. seconded by Commissioner Secor that, supject to the oondition of the proposed residence being built ~s proposed.. the City Attorney be instructed to prepare a resolu- tion of intention to vaoate the alley in Blook 5 of Werre's Rearrangement of West Side Addition, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Paving Around Town House Apartments Mr. O. Berg, architect, was present to discuss the proposal of Town House, Ino. to pave one-half the width of Harrison Street on the north and one-half' the width of Tracy Avenue on the west abutting the property of Town House, Inc. After viewing the site of the proposed street improvement.. it was decided to approve the proposal to pave one-half the width of Harrison Street.. and approve the paving of Traoy Avenue from curb to curb from Harrison Street south 150 feet. Purchase of Road Oil The following resolution authorizing the purchase of 10,000 gallons of road oil from the State Highway for street improvements was presented and read: WHEREAS the City of Bozeman will have need during the summer of 1951 for limited quantities of road oil for use for pavement sealing and in making emergency repairs on streets in Bozeman, and WHEREAS the City of Bozeman does not have proper facilities for procuring and stor- ing quantities of such oils in Bozeman.. and WHEREAS the Montana State Highway Commission has quantities of road oil of the required types stored in Bozeman from ~ioh it may be able to supply the immediate needs of the City of Bozeman at cost plus handling charge. NOW, THEREFORE.. BE IT RESOLVED: That an emergency does exist and the City Manager is hereby authorized to purchase from the Montana State Highway Commission, from its stocks in storage in Bozeman, approximately 10..000 gallons of road oil as required for use in patching pavement in Bozeman during 1951. Passed and adopted by the City Commission of Bozeman.. Montana at a regular session of said Commission held on the 25th day of April.. 1951. Attest: s~ L. G. Rent Decontrol A letter from Tighe E. Woods, Housing Expediter, was read stating he has received a copy of the commission decontrol resolution, and a letter from the general counsel was read, stating the resolution is being examined as to legal sufficiency, and if all requirements are met, rent control will be decon- trolled by an mnendment speoifying the effeotive date. Preliminary Survey for Trunk Sewer A proposal of the Morrison-Maierle Engineering Company to make a preliminary survey for a seni tary trunk sewer to serve the southwest part of the city was fresented and read. After discussion, it was moved by Commissioner Healy, seoonded by Commissioner Secor, that the proposal be accepted in accordanoe with the terms of the letter, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 708 -- Assessing S. I. D. 364 The Manager stated a resolution levying the assessment in the amount of $1,378.48 for Special Improvement District No. 364, water main on South Twelfth from Curtiss to Koch Street has been prepared. He presented Resolution No. 708, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SFECIAL ASSESSMENT OF TAXES UFON AlL THE PROI'ER'lY IN SFECI.AL IMFROVEMENT DISTRICT NO. 364 IN THE CITY OF BOZEMAN, COUN'lY OF GALLATIN, STATE OF MONTANA, TO DEJi'RAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMFROVEMENT DISTRICT NO. 364. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be passed and adopted, and May 2. 1951 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 707 -- Assessing S. I. D. 363 The Manager stated a resolution levying the assessment in the amount of $2,365.99 for Special Improvement District No. 363. water main on West Beall Street from Third Avenue to Fifth Avenue has been prepared. He presented aesolution No. 707, entitled: A RESOLUTION OF THE COMMISSION OF THE CI1Y OF' BOZEMAN, MONTANA. LEVYING AND ASSESSING A SI'ECIAL ASSESSMENT OF TAXES UPON ALL THE PROl'ER'lY IN SPECI.AL IMPROVEMENT DISTRICT NO. 363 IN THE CI'lY OF BOZEMAN, COUNTY OF GALLATIN. STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 363. It was moved by Commissioner Seoor, seconded by Commissioner Healy, that the resolution be passed and adopted, and May 2, 1951 be set as the date for hearing protests. and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner Healy; those voting No, none. Reports The report of the Direotor of Finance for the month of March. 1951 was presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the report be aocepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none. Tag Day for Cancer Drive The City Commission approved the date of Saturday, April 28, 1951 as tag day for the cancer drive. Report on Water & Sewer Meeting City Manager Henderson reported on the Sewer and Water Works Meeting he attended in Helena. Resignation of Ken Card, Recreation Director The written resignation of Ken Card as Reoreational Director, effective May 31, 1951. was presented 8 and read. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resignation be accepted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Fire Charge for Gene Stanley It was reported the fire truck made a call outside the city limits to the residence of Gene Stanl~. It was moved by Commissioner Healy, seconded by Commissioner Seoor, that Gene Stanley be I billed $25.00 for the oall, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner He&y; those voting No, none. Adjournment There being no further business to oome before the Commission at this time, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
