AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING
AN INITIAL ZONING DESIGNATION OF "RS" (RESIDENTIAL SUBURBAN
DISTRICT) ON 26.606 ACRES SITUATED IN THE SOUTHEAST ONE-QUARTER
AND SOUTHWEST ONE-QUARTER OF SECTION 32, TOWNSHIP 1 SOUTH,
RANGE 6 EAST, PRINCIPAL MERIDIAN MONTANA.
WHEREAS, the proposed zone map amendment to establish an initial zoning designation of
"RS", (Residential Suburban District) on 26.606 acres has been properly submitted, reviewed and
advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on February 6,
2001, to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on February 20,
2001, to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, one member from the general public spoke in opposition to the zone map
amendment; and
WHEREAS, the City Commission elected to waive its Rules of Procedure to postpone its
decision one week and make a decision on said matter; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as
recommended by the Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on February 20, 2001, the City Commission found that the
proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and would
be in the public interest upon annexation of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3531, adopted on the 5th day of August, 2002.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby initially
established as "RS" (Residential Suburban District).
A tract of land being described as Tract A of Certificate of Survey No. 2220, located
in the Southeast one-quarter and Southwest one-quarter of Section 32, Township 1
South, Range 6 East, Principal Meridian Montana, City of Bozeman, Gallatin County,
Montana, and being further described as follows:
Beginning at the Northwest comer of said Tract A, thence along said Tract A through
the following courses:
North 89'28'56" East a distance of 54.51 feet, North 00'04'18" West a distance of
20.00 feet, North 89'55'42" East a distance of 1010.06 feet, North 89'55'09" East a
distance of 1349.78 feet, North 89'50'54" East a distance of 300.03 feet, South
00'04'12" East a distance of 516.51 feet, South 89'56'37" West a distance of 85.70
feet, North 89'50'00" West a distance of 230.48 feet, North 89'58'35" West a distance
of 341.81 feet, North 01'14'44" West a distance of 100.02 feet, South 89'41'50" West
a distance of 153.58 feet, North 89'57'48" West a distance of 120.95 feet, South
89'50'43" West a distance of 121.06 feet, South 89'55'42" West a distance of 121.07
feet, North 89'59'39" West a distance of 127.39 feet, South 89'56'39" West a
distance of 114.38 feet, South 89'56'40" West a distance of 121.00 feet, South

Said tract of land being 26.606 acres, more or less, along with and subject to any
existing easements of fact and record.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 5th day of August 2002.
