M. Fresent were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the fol10w- ing proceedings were had: Minutes of the regular session of April 25, 1951 were read and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Request for Sign on Lamp Post Rev. Wm. Fospicil, of the Church of God, was present in the interest of a request to place a directional sign for his church on a lamp post on Main Street. He was informed the policy of this Commission was not to permit placing of any signs on street areas except those which are in the general public interest. Such signs can be placed on private property. Replacing Water Main -- South Tracy The Manager reported that on South Tracy between Harrison Street and Cleveland Street, there is a two-inch water main and, because of the fact that a portion of Tracy Avenue will be paved from Harrison Street south, he recommended this water main be replaced with a six-inch main. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the City Manager be authorized to have the present 2-inch water main replaced with a 6-inch water main, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 706 -- Intention to Vacate Alley, Block 5, Werre's Rearrangement The Manager stated the City Attorney as instructed has prepared a resolution of intention to vacate the alley in Block 5 of Werre's Rearrangement of West Side Addition. He presented Resolution No. 706, enti tled: A RESOLUTION OF THE COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, DECLARING IT 10 BE THE INTEN- TION OF SAID COMMISSION TO VACATE mE ALLEY IN BLOCK FIVE OF WERRE'S REARRANGEMEN'I OF THE WEST SIDE ADDITION TO THE CITY OF BOZEMAN, MONTANA. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be passed and adopted, and May 9, 1951 be set as the date for hearing protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Rerorts The following reports for the month of April, 1951 were presented: Librarian Cashier Folice Chief Fire Chief Folice Judge Sanitary Inspector Building Inspector Wa ter Collector It was moved by Commissioner Secor, seconded by Commissioner Healy, that the reports be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner He&Yi those voting No, none. Folice Reserve SDS Revenue Withholding Tax Water 908.79 3.88 86.15 1,462.21 1,171.60 4,696.58 Tot a 1 $28,383.77 The Manager stated that he has audited these claims and finds them to be true and lawful claims against The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Healy, seconded by Commis- sioner Secor, that the claims be approved and warrants drawn for their payment, and the motion was carried by the following Aye end No vote: those voting Aye being Mayor Lowe, Commissioner Secor end Commissioner Healy; those voting No, none. Resolution No. 707 -- Final Passage The Manager stated this was the time and flace set for the hearing of protests to the final passage and adoption of the resolution levying the assessment for Special Improvement District No. 363, water main on Beall Street from Third Avenue to Fifth Avenue. He stated that no protests have been filed and no one is present to protest, whereupon Resolution No. 707 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN, MONTANA, LEVYING AND ASSESSnW A SPECIAL ASSESSMENT OF TAXES UPON ALL TIlE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 363 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMlOOVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 363. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 708 -- Finel Jassage The Manager stated this was the time and place set for the hearing; of protests to the final passage and adoption of the resolution levying the assessment for Special Improvement District No. 364, water main on South Twelfth Avenue between Koch and Curtiss Street. He stated that no protests have been filed, and no one is present to protest. He presented Resolution No. 708, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA. LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE FROPER'l'Y IN SFECIAL IMi'ROVEMENT DISTRICT NO. 364 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE. OF MONTANA, TO DEFRAY THE COST OF CONSTm.JCTING AND MAKING THE IMl'ROVEMENTS WITHIN SAID SIECIAL IMPROVEMENT DISTRICT NO. 364. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Request to Purchase Fire Bell The Manager rSI-,orted a request from the Catholic Church of Three Forks to purchase the fire bell formerly used by the Fire Department. After consideration by the Commission, it was moved by Commissioner Healy, seconded by Commissioner Secor, that it shall be the policy of this Commission that no dispos1- tion will be made of the fire bell and that it will be kept for its historical and sentimental value, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commis- sioner Secor and Commissioner Healy; those voting No, none. Agreement U. S. G. S. A renewal agreement between the City and the U. S. G. S. for the oI-eration and maintenance of the gauging station on the East Gallatin River was presented. It was moved by COllilllissioner Secor, seconded by Commissioner Healy, that the City Manager be authorized to sign the agreement for The City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commis- sioner Secor and Commissioner Healy; those voting No, none. Appointment -- Stephenson to Police Commission Mayor Lowe announced the reaI-pointment of Ed Ste}henson as a member of the Police Commission, term I I I I I I to eXfire May 1. 1954. It was moved by Commissioner Healy. seconded by Commissioner Secor. that the appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No. none. Communication -- Board of Realtors A co~nunication from the Bozeman Board of Realtors was read expressing their appreciation for the manner in which the facts were presented at the public hearing regarding rent decontrol. A copy of a letter from the Board of Realtors to all landlords was read stating it was the wish of the Board of Realtors to have the landlords stay within reasonable limits and not make unnecessary raises in rents. Furchase of Oil and Chips for Street Repair The City Manager and the City Engineer discussed with the Commission the matter of sealing old pavements. Some pavement sealing was done in 1950 but. unless this is carried on progressively and continuously. much of the pavement in the city will require replacement in a relatively short time. It is considered that a progressive program of sealing will add years to the life of all paving. It was recommended that a program be followed to seal 25 to 50 blocks of paving each year as part of the regular street maintenance in the city. To have necessary materials to seal 35 to 40 blocks of pavement will require approximately 600 cu. yds. of chips and 15.000 gals. of oil. The Gallatin Sand and Gravel Co. has quoted a price on chips of $3.00 per cu. yd. at their plant at Belgrade. These chips must be ordered well in advance of the time of their expected use. The Commission expressed approval of this maintenance program. and it was moved by Commissioner Healy. seconded by Commissioner Secor. that the City Manager be authorized to order 600 yds. of chips and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time. it was moved by Commissioner Seoor. seoonded by Commissioner Healy. that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe.
